Abstract:In the 1940s, Qu Tongzu put forth the proposition of "Confucianization of the ancient Chinese law", producing a great effect on the academia home and aboard. Due to the discovery of new historic materials born on bamboo slips in the Qin and Han dynasties, different views have been proposed since the 1970s. China’s legal system features two basic characteristics—moralism and mixed law—for the entire Chinese history. The Confucian legal thoughts prior to the Qin Dynasty represent the theoretical summary of legal experience and practice in ancient China. Legalism in the Warring States Period and Qin Dynasty dismisses the patriarchal clan system and advocates "rule by law" on the basis of the centralized state power. Meanwhile, legalists partially incorporated li (rites or rules of proper behavior) into law. After the Western Han Dynasty, ancient Chinese laws began the process to be turned into part of Confucianization in a comprehensive way. The Confucianization of law represents the integration of Confucianization and Legalism in terms of academic thoughts, the integration of Confucianization and luxue (the study of law in ancient China) in terms of judicial professional training, the gradual socialization of the mixedlaw in the mode of law, and the transformation of patriarchal clan system into statute law in the criminal legislation.

Abstract:The Confucianization of Chinese law was a real historical process. This process was embodied in the changes of kinship legal institutions. Both pre-Qin Confucianists and Legalists admitted patriarchal families, but the patriarchal spirits and structures envisaged by the two schools were quite different.Confucianism preferred the model of large joint families, the patria potestas was diffused in the mourning clothing system which contained both the principles of filiality and affection. To Confucianism, as the foundation of all other orders, the family had independent values and precedence over state power. Legalists favored patriarchal small families. The patria potestas was subordinate to requirements of the raison d’état to help the monarch manage family members and cultivate the obedience of subjects, while small families facilitated the government’s social control and fiscal extraction. To Legalism, as an administrative unit that did not bear ethical values, the family could not resist the intrusion of state power. The law of the Qin Empire mainly embodied the Legalist color. From the Han Dynasty to the Tang Dynasty, law obviously experienced Confucian transformation. This change was concentrated in the institutions related to kinship ethics, and the Confucian color in this field was still deepened until the Qing Dynasty. The legal privileges of officials and nobilities, which was given importance by the traditional narrative of legal Confucianization,was actually only thriving in the period of the Wei, Jin, and Southern and Northern Dynasties, when the imperial power was weak, but was strictly restricted in the later period when the imperial power was restored to normal. In the civil law since the Song Dynasty, the patriarchal family law gradually compromised to the practice of private property rights. In major historical changes, the role of ideas and ideologies should be taken seriously.

Abstract:Abstract: Confucianism and Legalism are not only the two most influential ideological schools in pre-Qin China but also the main schools of thought in ancient Chinese intellectual history. This is due to their respective social nature and contrasting political values. In Pre-Qin Confucianism, rooted in the belief in the innate goodness of human nature, there is a strong emphasis on the significance of historical traditions. It promotes values such as benevolence, righteousness, propriety and wisdom, and seeks to redefine “Rite” by incorporating new values. It places great importance on the rule of virtue and aspires to achieve a state of Universal Harmony. Pre-Qin Legalism, driven by the inherent human inclination towards self-interest and personal gain, formulates a governance philosophy grounded in utilitarianism. It prioritizes the present and advocates for profound transformations through the implementation of strict “law” to attain national prosperity and military strength. As a result, ancient China formed different traditions of the rule of virtue and law, laying the foundation for the complementary nature of Confucianism and Legalism. This article analyzes the factors of differentiation and the process of integration in Confucian and legalist political philosophy, aiming to provide insights into the construction of contemporary political philosophical systems.

Abstract:This paper analyzes the origin of Chinese legalism, its major propositions and characteristics. It compares the difference between Chinese legalism and other Chinese philosophies including Confucianism, Taoism and Mohism. It also discloses the difference of Chinese legalism and Western legalism in relation with morality. Western legalism defended the rule-of-law but argued against the morality of law. In contrast, Chinese legalism, especially in the early Pre-Qin era, did not separate morality from law. However, the fidelity to law in Chinese legalism was interpreted as the fidelity to the monarch, and thus being different from the Western rule-of-law.

Abstract:Han Fei (c. 280-233 B.C.) was a fierce general in the anti-Confucian struggle of the late Warring States period and was also an outstanding pre-Ch'in Legalist theoretician. Han Fei Tzu, this piece of writing, which was critical of Confucius and full of a violently militant spirit, vividly recorded the course of the difficult combat of the landowning class which led to its victory over the slave-owning class. It summed up the historical experience of the struggle between the Confucian and Legalist lines during the Spring and Autumn and Warring States periods and expounded the theoretical foundation for establishing the unified, centralized feudal state. It was a work that crystallized Legalist thought. Abstract:The article studies political and legal thought in Ancient China. Ancient Chinese thinkers in their works reflected their approaches to understanding law. Shang Yang in "Shang jun shu" ("The Book of the Ruler of the Shang Region") considers the law as the only regulator of social relations. Legalists equate the concept of law and law, law is considered as a set of rules of conduct emanating from the state and protected by it, which corresponds to the normative concept of legal understanding. Another version of legal understanding was developed by representatives of Taoism. Lao Tzu in his work “Tao Te Ching” (“The Book of the Way and Grace”) paid special attention to the exposition of his teaching about Tao as the highest law of the development of the universe, nature, society and man. Tao acts as a natural law of immediate, direct action. Taoists are supporters of the natural law concept. In Confucius' work "Lun Yu" ("Conversations and Judgments"), the main regulator of social relations is not the Tao or the law, but the norms of ritual li. The right is not reduced to the law, but is considered as a set of legal relations, and the legal order that develops on the basis of them. Legal understanding of Confucius can be attributed to the sociological concept. In the work of Xun Tzu, there are attempts to bring together the Confucian rules of the ritual "li" and the Legalist law "fa". A new, orthodox Confucianism is emerging, which no longer completely denies the law, but advocates management both on the basis of li and on the basis of fa, with the dominant role of li. In China, a new type of legal understanding is emerging - integrative or synthetic. The article concludes that within the framework of the political and legal thought of Ancient China, there were various approaches to understanding law. After the proclamation in II BC. updated Confucianism with the official ideology of China, the integrative type of legal understanding becomes dominant, both in theory and in law enforcement practice.

Abstract:This article argues that Shang Yang’s philosophy of law was not only a means to enrich the state and strengthen its army, but also envisioned the orderly rule of all All-under-Heaven. Through a fair, universal, and reliable use of rewards, punishments, and also teaching, this vision of laws could ultimately lead to the promotion of moral values, popular consensus, and people’s self-governance. While the authors admit that in Shang Yang’s own historical context, law was no more than a tool used by the ruler to suppress his people, potentially his ideas could contribute to a future Chinese society fully ruled by law and morality, and inspired by the rule of law.

Abstract:The basis of revenge is the ethics of loyalty and filial piety in Western Zhou Dynasty. One man's revenge against the enemies who has offended his father or lord will be recognized as a behavior of practicing loyalty and filial piety and will honor him undoubtedly. The Chinese revenge ethics changed significantly during the period from Pre-Qin to Han Dynasties,which became from absolutism to relativism,and from family standard to state standard. It is more and more emphaticly that loyalty is higher than filial piety,and the revenges against emperors were forbidden strictly. These changes are the results of the establishment of unified centralization government,the development of national legal system,and the contendings of Confucian classical scholarism in Western Han and Eastern Han Dynasties.

Abstract:Even though the thoughts of both Mo Tzu and Bentham belong to utilitarianism,they are different in many ways.When Mo Tzu talked about interests,he was paying attention to the situation of survival.Therefore,anything that has nothing to do with survival would be considered as wasting.However,Bentham talked about interests from the aspect of pleasure,which justified the reason for people to be luxury and have a way of living based on consumerism.The political philosophies represented by Han Fei Tzu and Hobbes respectively.Although they were not used in the diplomatic speeches of politicians very often,they were actually used in their political practices.They are the basic principles applied in making rules for public administration respectively by Chinese or Western politicians.

Abstract:The article does an expansive research on the theory of Hume's "fact-judgment" and "value-judgment " by utilizing the theories of Marx Webber's "ideal type" and Wittgenstein's "family resemblance", helping to draw a conclusion to the transformation of Hume's theory from absolute rationality of the essentialism to relative rationality of non-essentialism reason. Based on non-essential "fact-judgment" and "value-judgment", and illustrating the "Rite-punishment" in the Confucianism theory before the Qin Dynasty, the author puts forward two ideal types of research on the Chinese traditional legal ideology-rehabilitation and explanation, advance and creation. On the basis of the two ideal types, we can overcome the blindness and confusion of research on the traditional Chinese legal thoughts and can establish minimum rules in explanation and dialogue so as to deepen the research on the study, and promote the creativity of thought.

Abstract:Abstract This article studies the promulgation of law in Qin and Western Han China (221 b.c.e.– 9 c.e. ) based primarily on excavated legal and administrative texts. It shows that a new law was handed down from the emperor to the relevant offices on the day of enactment. The article argues that, to an extent, the subject matter and function of a law determined for whom it was passed and promulgated. Depending upon the location, rank, and official duties of the offices, the laws known and used could be quite different. Although it was required that documents of imperial decisions be forwarded swiftly and safely by courier at the prescribed speed, delays in forwarding such documents to distant local offices were probably common in Qin and Western Han China. Evidence indicates that district- and prefecture-level officials publicized laws that needed to be made known by the common people, by reading them aloud in local gatherings, for example, or posting them in conspicuous places. The article further argues that a law came into effect in offices on the day it arrived at local courts or on the day it was enacted in the central court, depending on the existence of related extant laws. It concludes that a new law in Qin and Western Han China was ex post facto , as it reached backwards to a past action and retroactively attached liabilities to the action at the point when it was performed.

Abstract:Characteristics of the ancient Chinese law could be well summarized by the three words of “Emotion (Qing), Reason (Li) and Law (Fa)” which have formed the core spirit of the traditional Chinese legal culture. This paper is intend to clarify the relationship between the three words and consider that concepts of emotion, reason, and law are not independent but a union, showing different sides of the same procedure. Meanwhile, the dynamics of these three concepts form a more generalized concept of “law” in which “emotion (Qing)” is the basis and reason; “reason (Li)” represents the actual social norms and “law (Fa)” is the method to maintain social order.

Abstract:Starting with the analysis of Qin bamboo text Wei Li zhi Dao,which makes three requirements for the officials,namely conduct,competence and political attitudes,combining with Qin's Officials as Teachers system,this article points out Qin's requirements for the and reflects that through one unified and regarding Officials as Teachers,the Qin Dynasty tried to achieve their political thinking of the of law.Furthermore,this article theoretically analyzes the state of Qin's rule of law and its ideological approach,and illustrates that through the integration of different levels of standards such as ceremony,custom and law,the Qin Dynasty tried to make a set of unified social evaluation mechanism and social order model,and by shaping the who were its political terminals,the Qin Dynasty tried to realize the implementation of its political vision in the folk areas.Finally,based on a case-study analysis of Yu Shu,this article tries to clarify the intrinsic link between the rule of law ideas and dense laws and the intrinsic links of these unfavorable situations,such as the severe and cruel officials and local strong boycotts.

Abstract:The essay designs a thought experiment of Shangyang vs.Qiuju and examines a rising claim that the rule of law in china should be transformed from the popularized model to the monopolized one.It demonstrates that the ways and ends of the rule of law transform will not only fail to help lawyers to establish the monopolized rule of law,but tend to sink into the despotism and tyranny,due to the provided dominance of the popularized rule of law which make no difference of the knowledge and power between the experts and the laymen.Chinese lawyers should,therefore,overcome the legal professionalism and elitism and try to establish the consensus foundation among all the people for a Chinese road to the rule of law.

Abstract:In Late Qing Dynasty, the Chinese Law Family was disintegrated and the Western Law was introduced into China. Finally, China adopted the European continental Roman law tradition. This paper analyzes the reason for China’s borrowing of such legal system and probes its development and reform in the later years. It also tries to answer the question of what will be the possible impact upon the current Chinese legal system since China now implements the policy of “one country two systems” in order to realize its reunification with Hong Kong, Macau and Taiwan. In addition, it will make some prediction upon the future development of Chinese legal system.
