Legislating for Tourist Attractions Rights

Abstract:Land(or land ownership) is the most important issue affecting China′s social and economic development for thousands of years.Scholars at home and abroad now hold two completely different views on land ownership.Some maintain the current socialist public ownership of land;they think there is only a need to improve the principal-agent system in the use of the rural collective land.Another group advocates privatization of land ownership;they insist that private ownership is the only solution.But for commercial development of tourist attractions in rural land,neither can completely solve the conflicts between developers and rural communities in how to equitably distribute tourism revenues generated by tourist attractions.This is because the use of tourist attractions is obviously different from other non-agricultural uses of rural land;it does not normally entail the transfer of land property rights or changes in land use patterns.Based on long-term field research on two typical cases —the Longji Terraced Landscape in Guilin and Dai Nationality Garden in Xishuangbanna Prefecture in China,this paper firstly points out that the Tourist Attraction Property Rights(TAPR)-the exclusive rights to dispose of the intangible value of tourist attractions which are in possession-have been an existing fact with strong social basis.After that,the necessity and legitimacy to establish this new kind of non-visible property right of TAPR are fully analyzed from the points of view of law and economics.In view of situation that the existing categories of rights listed in the Property Law in China are not fully applicable to the use of the intangible value of tourist attractions,this paper discusses in detail the specific legislative arrangements of TAPR in the framework of the Property Law.In the development of rural tourist attractions in China,the supply of rights is more important than economic compensation.Only a well-established property right system can effectively protect rights from any infringements of power.There is an urgent need to legislate for TAPR in the Property Law in China to break the current dilemma of rural community participation in tourism development and to thoroughly solve the disputes of tourism income distribution among communities,investors and governments.
