Culture and Transplantation of Law

Abstract:There are debates between different schools of legal theories, such as cultural evolution vs. cultural dissemination, legal autonomy vs. mirror image of law, and efficacy of law vs. symbolism of law, over the issue of the relationship between culture and transplantation of law. All of the above-mentioned schools are biased on this issue and, therefore, a new theory needs to be constructed. In the primitive society, culture and law were integrated and law was not transplantable. After the emergence of states, political factors began to influence the transplantation of law, but the role of culture was still not be underestimated; at the stage of nation state, the influence of political factors began to be strengthened and the influence of culture gradually weakened. At the time of globalization, the influence of culture on the transplantation of law is further weakened and three models of trans-cultural transplantation of law have emerged. As a result, a new theory is needed to interpret the relationship between culture and transplantation of law.
