Abstract:Inquisition by torture,vital cause of misjudged cases in China,prevails because it is part of the "right of legitimate hurt".The right of legitimate hurt is a kind of "low-risk hurt capacity",which indicates that the official with the right of legitimate hurt may utilize the state power to hurt the object within the frame of discretion while the person who exerts the right will burden very low cost and risk.The inquisition by torture should be eliminated by creating strict regulations and dispelling the motive of torture,and rational substitute for obtaining verbal confession by torture should be found to avoid negative tendency that strictly prohibition of extorting confession by torture becomes an empty slogan.
