What A World View Does the Chinese Law Need?

Abstract:Currently the world view upon which Chinese legal development is based is not only affiliated to the western society but also deeply exposed to the cognitive model of binary opposition.Such conception in relation to the "world" tends to lead to the extreme understanding that the world is sole and concrete,which imposes the obstacle of intelligent observation on the development experience of the Chinese law system,on the future development of law,on China's disposal of development of law in the world and on the formation of an international political ideology required by multilateral international relations.Now,with the enhancement of China's status brought by the rise of China and the reconstruction of the international legal order,to set forth a new world view is requred,which should emphasize that in a multidimensional world,China should demand a diverse understanding of the world,actively figure out the proper and feasible countermeasures and help China to view the world from the perspective of being the "object" to "subject",which is compatible with the Chinese thinking pattern and behavior philosophy.Therefore,such new world view is capable of assisting Chinese law to get rid of the established pattern of binary opposition,to surpass the opinion of sole-centralism,and furthermore,to make an attempt to observe and reflect itself and the whole world with the communication and cross-perspectives of East and West,so that China's legal development can be accessible to a broad meaning.
