On the Fundamental Issues in Sport Law

Abstract:This article attempts to provide a theoretical basis for the revision of the Chinese sports law.By a comparative study,it divides the issues into two categories: the basic issues,which may be of constitutional significance,and the important ones,which may are related to the fundamentals of sports.This article argues that China needs to adopt an integrated legislative model,intervening in some special fields with the support of a stable national sports policy, and taking a laissez-faire approach in the fields requiring greater flexibility.This article supports a centralized legislative approach to the sports law,arguing that local sports laws,which are based on and supplementary to the national law,need to set higher local standards and responsibilities.In the discussion of aforementioned matters,this article also covers such important issues as physical education,sports for all,spectator violence,anti-doping,dispute settlement,the media,funding and sponsorship,with special attention to China's national conditions.
