On the Regulatory Technique in Chinese Contract Law

Abstract:Regulatory technique is a means,by which a law or code moulds itself in terms of the language style,the expression method and the structural arrangement etc.Up to now the technique and its application in Chinese contract law was researched seldom by academics.Focusing on the constructural general-abstract method,the general clauses method,the method of extracting of"concrete"rules and ancillary generalisation method,this paper researches preliminarily on the regulatory technique features in Chinese Contract Law. Chinese Contract Law used in general the generalisation technique with many detailed different methods to compile its rules.However,the techniques were not exercised in its full maturity,e.g.the abstract technique was applied mainly in the level of principles but nor of the concrete rules,the ancillary generalisation method was used still unskilfully.The author hopes that it should be payed more attention to the regulatory technique in the compilation of our future civil code,in order to make the whole rules of code in the aspect of generalization more logical.
