Abstract:Since the International Maritime Organization (IMO) introduced the Port State Control (PSC) programme in 1982, it has been playing a vital role in the enforcement of safety law at sea worldwide. This paper addresses the effectiveness of PSC and the effectiveness of the methods for selecting ships to be inspected adopted by regional PSC. Data on ship total loss (from 1973–2003) and on the PSC records (from 1994–2005) have been collected. The study reveals that the enforcement of PSC is effective in improving the safety level of maritime transport. The methods adopted by regional PSC are compared on their effectiveness, efficiency and stability in identifying substandard ships. Suggestions are made on the improvement of the enforcement of PSC.

Abstract:Anchored on stakeholder management theory, this study applies the Structure-Conduct-Performance framework to analyse the effects of various stakeholders' participation on sustainability integration and organisational performance of maritime transport firms. Survey data were collected from 156 maritime transport firms. It was found that sustainability integration fully mediates the effects of stakeholders' participation on organisational performance, which highlighted the importance of developing sustainability in a business context and engaging stakeholder participation in the planning and management of sustainable maritime transport activities. The findings enrich theoretical research on stakeholder management and provide directions for maritime transport firms and transport policymakers to achieve better sustainability results.

Abstract:This paper studies the contributing factors of maritime piracy by analyzing previous incidents that have been reported to the International Maritime Organization (IMO). Part of the analysis is to filter those ship types that are particularly vulnerable to piracy attacks. The paper also introduces the guidelines developed by the IMO and the industry envisaging to minimize the risk to ships that are exposed to attacks from pirates. It further describes the initiatives taken to develop a sustainable mechanism in the high-risk area (HRA)(1) to suppress piracy and other maritime crimes. This study reflects the fact that maritime security and piracy issues' importance has been increasingly recognized in the 40 year history of Maritime Policy & Management.
Efficiency of Port State Control Inspection Regimes: A Comparative Study

Abstract:Port State Control (PSC) guarantees that foreign ships do not jeopardize marine safety, security, and the environment when entering foreign ports. To share inspection information and improve the efficiency of PSC, countries in the same regions cooperate and follow memoranda of understanding (MoUs). Globally, a total of ten MoUs govern three different inspection regimes designed to select and inspect substandard ships. In this study, we use a super-slacks-based measure (super-SBM) to evaluate and compare the inspection efficiency of the three inspection regimes implemented by these ten MoUs and relies on the Malmquist production index (MPI) to identify the most applicable regimes. Our analyses produce three main conclusions. First, we use the average scores of the super-SBM in the past 11 years to confirm the efficiency rankings of the ten MoUs. Second, we combine the average efficiency scores of the three inspection regimes to show that the New Inspection Regime (NIR) is more economically efficient than other inspection regimes. Third, we use MPI scores to obtain a better understanding of the efficiency changes in MoUs? productivity over time and confirm that the NIR is more stable than other inspection regimes.

Abstract:In order to expand registered fleet tonnage and strengthen ship management, China began to introduce a special tax-free ship registration (STFSR) policy in July 2007. However, more than eight years following its implementation, the policy ended in complete failure at the end of 2015. This paper comprehensively evaluates the main content and implementation process of the Chinese STFSR policy, analyzes the effects of the policy, and summarizes the concrete reasons for the policy's failure and lessons to be learnt. A new governance framework is being designed and future directions are being developed to explore how the government can implement a successful ship registry policy. This research is intended to provide new ideas and information to the Chinese shipping industry's policymakers and stakeholders in order to handle the “flagging out” problem, thereby mitigating the current adverse situation of ship flagging overseas while strengthening the management of ship operation.
The Effectiveness of the New Inspection Regime for Port State Control: Application of the Tokyo MoU

Abstract:Port State Control (PSC) ensures that foreign ships do not sail until they can proceed at sea without posing a danger to maritime safety and environment. Since 2011, a New Inspection Regime (NIR) has been implemented by the PSC of the Memorandum of Understandings (MoU) member countries to identify potential substandard ships and increase the effectiveness of inspections. The NIR process and whether the target factors in the NIR can effectively reduce risks at sea are worth exploring. We take the Tokyo MoU as an example and retrieve 125,259 cases from 2015 to 2017 using computer programing. Based on the big data, we adopt a binary logistic regression to analyze detention decisions, which we then supplement by applying a decision tree to conduct a multi-factor decision-making analysis. The ships' characteristics such as age, type, deadweight, number of deficiencies, and others, namely, port State, performances of flag State, and recognized organization, may also shed light on the risks associated with detentions. Based on the empirical results, we derive three conclusions. First, the following factors are essential: ship age, ship type, performance of flag States, and the number of deficiencies that NIR considers significant. Second, ships older than 6 years seem more likely to be substandard. If a ship has five or more deficiencies, the probability that it will be detained is high. Third, discrepancies exist when carrying out the PSC among port States in the Tokyo MoU.

Abstract:Land and sea are closely intertwined in coastal areas; however, the governances thereof are in isolation, which may lead to complex conflicts that threaten coastal sustainability. The development of marine economic functions is inseparable from the land. Further, most maritime activities also extend to land, thus exerting impacts on local social and economic development. As such, China considers land and sea as integral entities and promotes land-sea coordination (LSC) through territorial spatial planning. This is one of the pioneering attempts in the world to compulsorily promote the integration of land and sea at the national level. Therefore, this study combs the policy background of LSC development and summarizes that the key challenges of LSC in the context of the new round of land and space planning are the determination of planning scope, the connection of the evaluation system, and the coordination of management. This study analyzes the local experience from the perspective of practice to deal with these challenges and proposes three directions for optimization for further research. In this way, LSC could be a sound framework to integrate land and sea sections for the optimal allocation of resources and eco-environmental protection.

Abstract:Abstract International marine environmental law has found its primary sources in international legal principles and conventions. At the regional level, some organisations prefer soft laws as their main instruments for regional marine environmental protection. This article proposes that coastal states could use soft law instruments in the South China Sea ( scs ) region to protect the marine environment through robust institutional processes, addressing environmental degradation concerns against a tense geopolitical backdrop. Based on discussions of regional practices, this article proposes that scs coastal states could strengthen their regional cooperation efforts using the existing soft-law structures by strengthening implementation cooperation through specific and targeted measures.

Abstract:<p>Many maritime countries have implemented the Marine Spatial Planning (MSP) approach in their respective regions to rationally exploit and conserve their biological and non-biological resources. Australia was the first to implement the MSP approach to govern its territorial waters (e.g., the Great Barrier Reef). Following the Australian example, various maritime countries have adopted the MSP approach to ensure safety, healthy and productive marine environment. Therefore, this study outlines the considerations of the MSP approach to purse its progress in developed and developing countries that would help to establish a planning framework for China-Pakistan Economic Corridor (CPEC) coastal and marine areas of Pakistan. The newly launched CPEC project is expected to greatly contribute to the industrialization and urbanization of the coastal and marine areas of Pakistan. Therefore, various special economic zones have been established along the CPEC coastal and marine areas. However, marine environmental safety policies that govern the protection of these coastal and marine areas are either limited or completely missing. Therefore, this study evaluates the MSP approach through SWOT (Strength, Weakness, Opportunities, and Threats) analysis in order to determine the extent to which its implementation supports the sustainable development along <span>CPEC</span> coastal and marine areas of Pakistan. The implementation of the MSP approach along the CPEC coastal and marine areas is also expected to induce a sustainable socio-economic development, and simultaneously improve available ecosystem services in the study areas. This study also provides a baseline for CPEC policy makers, planners and developers in the country to follow the MSP (social, economic and ecological) framework in order to minimize the conflicts amongst users and between users and the environment.</p>

Abstract:Marine electronics technology is a special branch of electronic technique application, because of its unique problems in application environment,energy supply,long-distance communication and information security issues. Marine electronics technology can't be improved by drawing lessons from other electronics technologies. Marine electronics technology hasn't been paid enough attention in our country, and a big technology gay was generated between Chinese marine research and international advanced level. This fell behind situation of our country should be changed by treating the marine electronics technology as an independent discipline. In this paper, we expound the research significance, development direction and implementation strategy of marine electronics technology. For speeding up this technology's development and enhancing the ocean exploitation ability in our country,some proposals are put forward.

Abstract:Abstract China’s role in the international maritime transport industry is undeniably growing: the country has become the second-largest ship-owning nation, its maritime ports are ranked among the top globally, and its national maritime transport company, COSCO Group, is ranked 4th among major shipping companies. However, its current legal framework is behind the commercial practices of the maritime transport industry and its operators. With both the evolution of China’s position on the global stage and the emergence of new judicial maritime practices, a revision was inevitable, particularly as China aims to build itself into a maritime power. Although the revision of the Maritime Law was included in the 13th National People’s Congress agenda for the period from 2018 to 2023, the revised Law has not yet been promulgated but is expected in near future. While the reform project focuses solely on the Chinese Maritime Law, China’s new ambitions could turn this moment into an opportunity to overhaul and rethink the role of Chinese maritime law in the current global context. Whether by modernizing its maritime law while maintaining its existing structure, or by rethinking its entire approach, China should consider the legal experience of current maritime powers, such as France, which could serve as a valuable source of inspiration for Chinese legislature in the future.

Abstract:Abstract Over the last two decades, countries worldwide have become increasingly aware of the potential of marine space, which has led to a significant development in marine spatial planning (MSP) and the proliferation of studies and practical exploration of MSP issues. In China, MSP is undergoing a new series of reforms. Despite discussions in the academic community on the methods and mechanisms of MSP, issues related to planning, system designs, and implementation priorities for the next stage of MSP in China remain unresolved. This study describes the multiplan integration characterization of MSP in China. It intends to address these issues by presenting a potential MSP system and defining the specific contents and tools that need to be applied to coastal spatial planning (CSP). CSP will be at the core of MSP in China in the future.

Abstract:As provided by the Resolution IMO A.787 and A.882 Port State Control (PSC) represents the complex of control and inspection powers exercised by the state on foreign ships in the port to ensure the compliance with the safety standards and regulations by the relevant provisions of the international conventions. Recently the Directive 2009/16/ EC of the European Parliament has established new rules to prevent maritime accidents, with reference to environmental damage, to the protection of staff, passengers and others as well as to the identification of procedures to reduce the accidents’ consequences. In particular, the Directive has introduced a second line of defense against substandard shipping imposing that the monitoring of compliance with the international standards for safety, pollution prevention and on-board living and working conditions should also be ensured by the port state and not only by the ship’s flag state.

Abstract:Nowadays,amendments to the Maritime Code have become a heated topic in China's academic circles.Scholars vary in their ways of modification.Judging from China's status quo and by reference of foreign experience,and with respect to the amendment principles of the Code,this paper proposes: while amending the Code, we should take into account both medium-scaled and small changes;we should give consideration to both the domestic and foreign elements;and we should stress both timeliness and prudence.The Code,after amendments,should be geared to developments of the day and to the advance of China's shipment economy and judicial practice.It should be expected to play a more important role in China's statutory framework.

Abstract:The European Union has a legally-binding framework for the establishment of maritime spatial plans in the sea areas covered by the exclusive economic zones of its Member States by 2021. The European Commission is supporting EU Member States in their planning efforts with concrete tools and financing. The European Union is well positioned to use its experience and expertise in promoting international and transboundary maritime spatial planning to help address global and regional governance gaps and challenges in ocean management, thereby contributing to improved international ocean governance. In this paper, the European Commission's Bernhard Friess and Marie Grémaud-Colombier explain the EU's legal framework for maritime spatial planning, and elaborate on how the Commission supports EU Member States in the preparation of their maritime spatial plans and the establishment of lasting mechanisms for cross-border cooperation. They set out how the EU's MSP experience led to intensification of its work on international MSP, including with the adoption of the joint DG MARE – IOC-UNESCO Roadmap on International MSP which sets out a clear forward looking and global perspective towards implementing the Agenda 2030.

Abstract:This paper addresses the growing concern over air pollutant emissions (NOx, SOx, PM, CO2) from ocean-going vessels in harbor areas and the role of Onshore Power Supply (OPS) systems in mitigating these emissions during vessel berthing. However, the slow progress in global shore power facilities is attributed to safety- and specification-related concerns. Our study conducts a comprehensive analysis, comparing international shore power regulations, with a specific focus on the IEC/IEEE 80005-1 standard and guidelines from various ship classification societies. We introduce checklists, scoring tables, and spider diagrams to evaluate the regulatory content, highlighting the strengths and weaknesses of each approach. Furthermore, this paper emphasizes the significance of a well-defined operational process for high-voltage shore connection (HVSC) to ensure the safety of OPS operations. We present process diagrams for key operational stages, based on IEC/IEEE 80005-1 specifications and evaluation criteria. The ultimate goal of this research is to drive the global adoption of shore power and foster the establishment of shore power facilities worldwide. This aligns with the broader environmental protection objectives of achieving cleaner ports and reducing emissions for a sustainable future.

Abstract:Building a "Maritime Community with a Shared Future" (MCSF) is a maritime development concept with Chinese characteristics proposed by Chinese President Xi Jinping in 2019. It is based on the rich cultural tradition and unique historical value of China's maritime civilization. It aims to solve real ocean problems and has outlined the future direction of human ocean development from the perspective of China. The essence of the MCSF is an issue of both ocean cultural and development concepts. It is a conceptual issue that transcends specific national boundaries and regions and is based on how all of humankind, with common interests and common values, can develop in harmony with the oceans. It is not a covert discourse strategy adopted by China in order to realize its "maritime power" ambition, as occasionally described by some Western countries. Starting with an analysis of the essential nature and implications of maritime culture by Chinese researchers, this article clarifies and summarizes the interaction, exchange, and integration of Chinese maritime culture in East Asia from a historical perspective, and extracts the unique characteristics and values of Chinese maritime culture. From the perspective of human–sea interactions, the three historical stages, as well as the existing problems of transforming and upgrading human–ocean culture, are analyzed. The article also contrasts Chinese and Western maritime cultures and proposes to absorb the outstanding achievements of both Chinese and Western maritime civilizations into a common framework in order to fundamentally reverse the antagonistic human–sea relationship that has existed historically. Finally, we propose giving full play to the fundamental role of marine cultural exchange and integration and, through international cooperation on specific issues in the field of global ocean international relations, propose specific and feasible practical pathways to promoting the realization of the MCSF.

Abstract:The 1982 United Nations Law of Sea Convention” signed by more than 150 nations went into effective on 16 November 1994, and has brought about great changes in peoples’ sense of oceans. According to some provisions of the Convention, great changes take place in the ranges of jurisdictional sea areas and the ownership of marine resources and rights and interests of maritime nations and also in the resources and rights and interests of the international waters of all the countries in the world. Since the Convention entered into force, the international maritime order has been greatly restructured, and the new concept “sea land” comes into being. Oceans have become the focus of world attention. People get more and more aware that the 21st century is an era of ocean. The authors introduce the aims and contents of the Convention, expound principles adopted by China and the neighboring countries, declare the development of marine economy of China and the developed countries, and describe contents, forms and characteristics of the marine integration management.
