On Several Issues of Deepening Judicial Reform

Abstract:In order to deepening judicial reform, it is necessary to insist on the concept of the rule of law, follow the inherent laws of justice, perfect and guarantee the mechanism which ensures the judicial and procuratorial powers to be exercised independently, improve the style of leadership of the CPC leads on judicial work, and clarify the relationship between commissions for discipline inspection and procuratorial organs and the relationship between the organs of state power and judicial organs. In addition, the system, in which personnel affairs and financial support of judicial organs are enslaved to the party and government organizations at the same level, must be reformed, and the shortcomings existed in the principle of dividing responsibilities for their own work, coordinating their efforts and checking each other between public security organs, judicial organs and procuratorial organs should be solved by effective measures. Moreover, the investigative procedure of major and serious criminal cases should be standardized, making sure the gang crackdown activities are carried out in a manner prescribed by law, suppressing the tendency of judicial administerization, and further standardizing the relations between judicial committees, presidents and the collegiate bench and the relations between superior and subordinate courts. The system of performance appraisal should be reformed scientifically and reasonably. It is necessary to further promote the professionalism of judge, enhance the treatment of judge, and standardize the selection of judges, particularly leading cadres.
