How to Justify the Interest in the name of Collective:A Comment on the Case of Nail House in Liede,Guangzhou

Abstract:The interaction between Democracy and the Rule of Law shows that Citizens’ Right for Property shouldn't be decided by the Majority Rule, for Property Right itself is a legal one, which is originally created by the majority through a democratic procedure. It is only a moral principle that collective interest is prior to that of the individual and collective to that of the state. We can deduce that to upgrade a moral principle to a legal one would inevitably be based on such an illusory proposition, arguing that the interests of the individual, collective and the state are in full accord. Heavy emphasis on the priority and legitimacy of the collective interest will lead that Citizens’ Right for Property would therefore be extremely unstable and in result could not be protected by themselves. In one word, we should be alert to the invasion, which is in the name of collective interest, to individual interest.
