Abstract:Circulation of rural land contracted management right has been a hot spot in Rural land issues even "Three Rural Issues" research in the academic circle.Transferring the operation of the contracted land lawfully must base on the presupposition that there exists wholesome and favorable legal system,which the circulation can abide by.In view of the main characteristics and impersonal demands of the circulation combined with the imperfection existing itself and in the process of carrying on this system in the reality,this research pays much attention to ten aspects on perfecting the circulation of rural land contracted Management Right system and eventually puts forward special legal suggestions of the circulation.

Abstract:By interpreting main research aspects,contradictions and dilemmas,and future reform of rural land system,this paper makes an outlook for the follow-up studies in the process of urbanization.Results show that domestic and foreign scholars have made many achievements by deep discussions on rural land system,but there are still shortcomings.There are many contradictions in the process of urbanization such as contradiction between urbanization and arable land,contradiction between peasant migration and the fixed location of homestead,etc.The imperfections of property rights and highlights of land fragmentation phenomenon are the main dilemmas.In the future,agricultural land property system should be improved,a unified land market is supposed to be established and homestead system should be innovated to effectively safeguard farmers' rights and interests.

Abstract:To protect cultivated land in China, new round land use planning has absorbed the concept of gross control of urban-rural construction land. It would have a great influence on future land use. One of these influences which could be foreseen is that we can't meet the demand of land of urban-rural construction in a sole way any more, which is transforming cultivated land into construction, and it should be replaced by a balance between the old way and an improvement of land use's internal efficiency. There is no doubt that rural residential land is the most potential, so the distribution change of rural resident land will be implemented in a large scale. There are two modes of the distribution change of rural resident land the writers will discuss, and they are distribution change in original villages, moving to center villages. After distribution change, we have to face another problem which is how we can deposit the old houses on original location. There are three ways, such as continuing using or demolishing it to turn back to cultivated land or leaving it lying waste. At last, the author develops a new mode named exploiting one place after another to integrate distribution change and disposition manners of old houses on original location. Government should weigh the advantages and disadvantages, then go after advantages and avoid disadvantages, and guide the owners to make proper choice, and then provide financial support and policy supply, so as to guide the rural resident land distribution change to an ideal circumstance which is more efficient and fair.

Abstract:Urbanization and industrialization have achieved great promotion since market economy was adopted last century in China. City, the most important carrier to support urbanization, of course, realizes quality and quantity optimization on production factors such as population, land and capital. Whereas, housing inequality becomes serious due to urban-rural dual structure during urbanization. People pay more attention to floating population urban housing problems than before. Based on new-type urbanization, the paper firstly analyzes indemnificatory housing’s difficulty in construction as well as its implement and combines the reality of commercial residential building in stock, utilization to justify the rationality of housing vouchers policy. Finally, for the sake of easing urban housing problems, the paper puts up an idea and constructs floating population urban housing purchase system via housing vouchers, where containing housing vouchers financial channels, subsidy objects and cash approaches.

Abstract:Rural homestead system is an important part of China’s rural land system. It is the result of the birth of China’s land, which is poor in per capita resources and needs fair and reasonable distribution to protect the rights and interests of the majority of people. In recent years, the system of rural homestead use right in China has been developing and improving, but there are still many practical problems, such as the unclear subject of homestead use right, restricted circulation of homestead use right, restricted inheritance, withdrawal of homestead use right and imperfect guarantee mechanism. The rural land system in China still needs to clear the land obtained subject, improve the system of right to use homestead circulation, explore out of housing land use right and its guarantee mechanism, etc. This paper aims to draw on these issues and put forward some suggestions for effective reform of China’s rural homestead use right system.

Abstract:In the current circumstances,employment pressure has increased and the social security system needs to be perfect.If farmers lose land,it means losing basic survival protection and being poor in urban area,so we should change the current low standards of resettlement and land requisition form.Otherwise,the result will inevitably affect the building of a harmonious society.Based on Ningbo example,we think that we should establish the social security system of landless peasants at the core of employment,based on the innovative mechanisms and the combination of new rural construction.

Abstract:Rapid urbanization has transformed cities by improving the quality and quantity of production factors, such as population, land, and capital gain optimization. However, housing problems of the floating population (liudong renkou) have seriously increased during the urbanization process. This study reviews the history of indemnificatory housing development in China and explore its effectiveness in the context of sustainable urbanization. Difficulties in the housing subsidy policy are identified, and an optimization-based framework for housing subsidy system that focusing on housing voucher is designed with the consideration of capitation grant, occasion for implementation, cost estimation, implementation procedure, and supplementary policy. The appropriateness of the housing voucher policy was tested on Zhejiang Province, and expert interview was conducted to evaluate the proposed housing subsidy system. This study provides an effective alternative housing subsidy policy which can facilitate the settling down of floating population in cities and also contribute to sustainable urbanization.

Abstract:With the proposal of new urbanization strategy in China, people-centered urbanization turns to be the core, and the housing problem of the urban population becomes extremely important. In order to satisfy the primary needs of families with financial difficulties among the urban population, Chinese government made a great effort to establish a housing security system. However, actual execution process deviates from the original intention of the system. Local government as a dual agent of the economic development and housing security, it is not only to pursue efficiency mechanism, but also to meet the legitimacy mechanism. Under the incentive of efficiency mechanism and restraint of legitimacy mechanism, local government carries out the “goal displacement” in the implementation process of the housing security system. Therefore, this paper studied on the mechanism of housing security system, and further provided policy suggestions to the development of affordable housing in China’s urbanization process.

Abstract:With the acceleration of China's urbanization and industrialization process,a large number of rural labor force continued transfer to urban,rural land circulation is widespread and increasing year by year.However,the rural land transfer market is not sound,there is lack of circulation information and intermediary services,and land circulation information is asymmetry.The land transfer appeared spontaneity,blindness and randomness,infringement behave have occurred and become one of the main problem of the rural instability.The article analyzed the main transfer's interests and direct at problems of rural land circulation,puts forward countermeasures scheme from strengthen land circulation intermediary organizations,and speeding up the construction of information platform,establishes the land bank credit support to strengthening wealth and so on.

Abstract:In this paper,welfare theory based on Sen's capability approach is chosen to analyze the peasant households’welfare who rent out farmland.Firstly,functions that exist in farmland circulation are found,and then the evaluation system of peasant households’welfare is established.Secondly,the method based on structure equation model is presented,so relationship between farmland circulation and change of peasant households’welfare which off-farm employment is incorporated into can be analyzed.Results support the care that farmland circulation realization cannot improve all aspects of welfare.Actually,farmland circulation enhances peasant households’income,but farmland circulation has no positive effect on the improvement in peasant health and social security.In addition,farmland circulation has both the positive and negative effect on social contact.Consequently,when the peasant households’income is enhanced,they also lose some functions,which are as important as income.If the condition of farmland circulation and family in the future is changed,the effect,which is brought by farmland circulation,will affect the peasant households’subsistence.

Abstract:Nowadays,land circulation and large scale farming has been one of the most important policy orientation of China's rural reform.Choosing America,Japan,Taiwan of China and Vietnam as the typical cases,this paper introduced the operations and experiences of land circulation and large scale farming of countries(areas) with different man-land relationship,so as to get some apocalypses to mechanism construction of land circulation in China.From the experiences of typical counties(areas),it is learned that clear land property right is the precondition of land circulation and the separation of ownership and management right can speed up land circulation.The perfection of supporting institution such as pensioning off the peasants,training the peasants for non-agricultural work and pushing agricultural mechanization,provides a guarantee for land circulation.Special agency for land circulation plays an important role in communication and cooperation between farmland demanders and suppliers.

Abstract:The current rural land transfer rules on entering urban land market actually bounds the real value of rural land due to governmental monopoly,which further restricts the development of rural area.This paper compares the local institutional design and practical effectiveness of the rural construction land transfer policies in Chengdu and Wuxi.The results show that the institutional settings in Chengdu,carried in forms of farmers dominance,social forces' participation and supervision of the government,virtually return rights to farmers.This mode is of great advantage in solving the problems of rural development.Therefore,we argue that releasing rural land value is a new way of promoting the development of rural area as a latecomer.The paper concludes with some policy recommendations.For instance,the government can release the rural land value if it aims to promote rural development;a well functioned market mechanism is also a key for rural development;land use policy reform can be a new way of integrating the rural-urban co-development;farmers can have more power and rights for protecting their own interests during the transfer.

Abstract:The purpose of this paper is to analyze the feasibility of rural housing system construction based on collective land circulation and to land expropriation, and to present some ways for integral housing system for urban and rural areas. Methods employed include documentation and comparative analysis together with field investigation. It is concluded that China is in the process of rapid urbanization and lots of its population are moving from the countryside to urban areas. They need a great number of houses, but the present conditions in cities can not meet their requirements. The improvement of rural housing system and the construction of new countryside are effective ways to promote sustainable urbanization process.

Why the land ownership cannot produce high income to China's farmers

Abstract:In China, the urban land belongs to the state but the rural land belongs to the rural collectives. However, the urban land has brought considerable property income to urban residents, while rural land has not given the farmers corresponding earnings. Based on the comparison analysis of residents' property income since 2000 in China, this study shows that there is great disparity between urban and rural residents in property income. Moreover, the property income of rural residents was excessively low. Therefore, it is very significant to increase farmers' property income. It's one of the essential conditions for establishing harmonious society to reduce the income gap between the city and countryside. The case study of Liandu district of Lishui city in Zhejiang revealed that the source of farmers' property income was limited because of existing rural land property rights system, which is in urgent need of reform. Finally, in order to improve farmer's property income, the paper proposes that the rural land system's reform should be conducted from the aspects of clarifying collective land ownership, improving land expropriation compensatory system, speeding up the circulation of land contractual management right and innovating homestead management system.

Abstract:Taking targeted measures to solve the problems of peasant workers of new generation was first proposed In the No.1 Central Committee Document in 2010.Eliminating land and housing policy barriers of peasant workers harmoniously into cities is one of the targeted measures.Land and housing policy barriers about harmonious urbanization of peasant workers are analyzed through the methods survey and literature.The results show that:(1) the system of land transfer and housing protection in city is a key barrier to harmonious urbanization of peasant workers.(2) The successful bidder of urban residential land should be the real estate company who has comprehensive advantages with biding high,Selling price low and reasonable planning,not the one who only has the highest biding price currently.(3)The system barrier of housing protection should be resolved through the pattern of multi-phase.The collective dormitories and rental housing should be key supported recently in order that peasant workers have room to live.Lease and purchase houses should be key supported in long-term in order that peasant workers be the owners of their living house.(4) The imperfections of circulation market system of agricultural land and circulation illegal of residential land cause extensive rural land use.Circulation market system of agricultural land should be improved and circulation of residential land should be legitimized as soon as possible.(5) The new generation of migrant workers,especially landless ones among them,should be given priority to in urban access policy for peasant workers.
Liberalizing Rural-to-urban Construction Land Transfers in China: Distribution Effects

Abstract:China's land market is characterized by a dual urban-rural system, with the government in control of rural-urban land transfers. In recent years, different types of pilot projects have been implemented to experiment with liberalizing markets for rural-urban construction land transfers. The objective of this study is to gain insights into the distributional effects of three different types of land liberalization rules by making a comparative analysis of three pilot projects carried out under each of these liberalization rules. We find that transfers facing more liberalized rules result in higher shares of land revenue flowing to the rural sector and thereby reduce the ruralurban income gap. But direct transfers between rural and urban land users also contribute to growing income inequality within the rural sector, as households living in urban fringes benefit relatively more from such transfers. A tradable quota system can reduce the impact of location on the price of land, and thereby contribute to a more equal distribution of the revenues of rural-urban land transfers within the rural sector.

Abstract:The rural collective land system plays an important role in urbanization; however, it hinders the capitalization of rural homesteads. Despite the significance of this system, the existing literature mainly focused on debates on privatization and nationalization of rural homesteads. However, only a few studies have proposed feasible plans for capitalizing fixed assets. To fill this research gap, this study discusses the conflict between market demand and legal limitation of the marketization of rural homesteads. The weaknesses and strengths of radical nationalization and privatization are also comprehensively evaluated. The concept of market-driven nationalization is proposed to overcome the weakness of radical nationalization and privatization while maintaining their strengths as much as possible. Finally, an assessment of the proposed market-driven nationalization is conducted based on an institutional analysis and development (IAD) framework. The key contribution of this study is its investigation into whether radically changing the rural collective land system is appropriate in contemporary China. In addition, this study proposes a potentially feasible path for advancing the capitalization of rural homesteads.
