Civil Society and the Change of View of the Rule of Law——The Analysis from "State-Society" Framework

Abstract:The civil society theory in the studies of the Chinese jurisprudence is more and more important,and forms the civil society theory of the rule of law.But many theorists of the Chinese jurisprudence use the civil society theory and the state-society framework in the premise of recognizing the western modernity picture,so the researches are in the course of the construction of lacking the reflection idea.By the reflection,we can see the contradictions of the civil society theory of the rule of law,it hypothesizes the universal effects of the way of the western modernization and the rule of law,and ignores the substantial differences of the real conditions of the way of the civil society and modernization between China and the west states.
