On Administrative System Reform in Rule of Administrative Organization Law

Abstract:At present, China still faces problems of institution shortage and legal system absence, which usually cause some degree of tension to the self-reform of law or governments in practice. To achieve the major integral part of such reform, i.e. the administrative system reform, much need to be done, such as borrowing the spirit and principles of the constitution and rule of law, reshaping the system in way of law, clarifying related questions of the administrative reform right, realizing the administrative authorized strength transfer from political adjustment to legal one, clearing the objective and orientation of government functions, improving the system of government organization law, fastening the system construction of administrative procedures, and re-adjusting the administrative power. By these, the administrative system reform will match with the requirement of rule of law and deep-seated institutional barriers during the process will be conquered, avoiding anomie or disorder.
