Abstract:The findings of this research include:(1) since China's entry into WTO,the protection of IPR from U.S.has been strengthened,but not without a time lag in effectiveness until 2oo4 when the situation began to improve for American copy rights.As the protection of records and music,entertainment software and books from the U.S intensifies,the loss in the three categories of trade with China diminishes.(2) Considering the small ratio of IPR trade in Sino-U.S.bilateral trade volume and the complementary nature of the Sino-U.S.trade structures,trade disputes in IPR are unlikely to escalate into trade wars.U.S.trade sanction threats against China will meet with intense opposition from quite a few interest groups in the U.S.,and provoke retaliation from China.As a result of these forces working together,U.S.will restrain the imposition of trade sanction on China while China will amend its IPR laws and enforce IPR laws with new vigor.

Abstract:Abstract This paper critically examines the trade relations between China and the United States, with a particular focus on the sensitive issue of intellectual property rights (IPR) trade frictions and disputes. It delves into the root causes of IPR conflicts between the two nations by analyzing IPR cases that have arisen since China acceded to the World Trade Organization. Notably, during the period from 2001 to 2016, the United States initiated a total of 243 “337 investigations” cases against China, which represents 77.66% of all such investigations targeting China. This study also considers the strategic implications of these cases and assesses the impact of the evolving IPR system in China. In 2008, China’s IPR policies were notably centered on enhancing protection, which is reflected in text mining results where the keyword “protection” emerged as one of the top eight high-frequency words, with occurrences ranging from 25 to 73. Furthermore, this analysis forecasts the future trends in China’s legal globalization, informed by the evolution of its intellectual property law.

Abstract:This paper uses GL index and Binary Choice Model,and gets some valuable findings.In detail,(1) twenty-seven goods were involved into the exclusion order of U.S.intellectual property rights(IPR) disputes against China,and twenty-three goods of them had rather small intra-industry trade(IIT) indices during 1995—2006;moreover,the U.S.suffered trade deficit imbalance from twenty goods of them.(2) The probability of U.S.IPR disputes against China increased along with the decrease of IIT index of these goods.Thus,U.S.IPR disputes against China were not caused by the ITT competition effect of these goods but caused by the IIT imbalance effect.(3) The probability of U.S.IPR disputes against China decreased along with the increase of the effect of intellectual property agreement.However,it is proved that U.S.-China trade balance of these involved goods is not significant statistically.The proposals are that China should enhance gradually the degree of U.S.-China bilateral IIT through technology import and industry upgrade,and that China should utilize actively bilateral agreement effect facing U.S.IPR disputes against China.The optimal approaches,which can lead China out of the disadvantage of IPR protection,are that China changes the mode of foreign trade growth,adheres to the developing mode of self-innovation and promotes the competitive advantage.

Abstract:The United States has been expanding its intellectual property protection overseas all the time in order to maximize its interest.In pursuit of effective international forums,ranging from UNESCO,WIPO,WTO to the recently initiated Anti-Counterfeiting Trade Agreement,the US has adopted a multiple strategy of forum selection,including participation in or withdrawal from a form,change of and establishing a new forum,etc.,with the purpose to extend its increasingly enhanced domestic intellectual property protection globally.To support its policy,unilateral,bilateral and multilateral trade measures,including "Special 301",free trade agreements and WTO disputes settlement mechanism,have been employed interchangeably.Those giant transnational companies play an active role in encouraging the extension of US extraterritorial intellectual property protection,while American pragmatic philosophy supports its forum selection policy.Through examination and analysis of the history of the global expansion of the intellectual property rights and its policy of forum selection,we can realize the essence of the globalization of intellectual property rights,understand its intrinsic conflicts,keep abreast of its reasonable direction,and,know clearly that international intellectual property protection should not be an unconditional extension of intellectual property law of one single country.Further,we may learn from relevant experiences and lessons,so as to adopt some forward-looking measures with clearer aims in diplomatic activities involving intellectual property rights.

Abstract:On January 15, 2020, the representatives of Sino-US trade signed Phase I Economic and Trade Agreement Between the Government of the People’s Republic of China and the Government of the United States of America in Washington, which symbolizes the temporary settlement of two-year Sino-US trade war in relatively peaceful method and lays a good foundation in mutual trust for subsequent Phase II negotiation. This Agreement includes eight chapters involving Sino-US economic and trade and is called the model of the international bilateral agreement by virtue of its wide field and rigorous details. The impact of clauses about intellectual property rights on China’s current legal system and the future revision direction of China’s relevant laws for conformance with the Agreement will be discussed emphatically so that the author can rapidly understand the impact and significance of Sino-US trade agreement to Chinese law.
An American Intangible Empire of Intellectual Property Rights and Its Dilemmas

Abstract:The United States of America has a long tradition of pursuing a commercial empire to avoid the possible fate of decline or dissolution facing every traditional empire. Since the early 1980s, domestic intellectual property regime had been fortified in the US to promote innovations and high-tech industry. Meanwhile, international intellectual property system had been globalized by establishment of the WTO and enforcement of the TRIPS in 1995 which could safeguard the technical and the corresponding commercial advantages of the US on world markets. An intangible empire of intellectual property rights had been constructed by the US for maximization of its interests. The distinctly American empire also has its intrinsic dilemmas. Internationally it could limit development of economy and social welfare of developing countries, and domestically it may incur patent trolls as such that may ruin rationale of the patent regime, and both may cause alienation of intellectual property regime that may further risk or demolish the intangible empire itself. Reasonable measures shall be taken to control the over-stretched intangible empire of intellectual property rights and to avoid its possible negative effects upon public interest both domestically and internationally.

Abstract:The US declared trade war after substantial defections from the internationalist (in geo-strategy and economics) lobby in US politics to a new coalition between conflict-is-inevitable proponents and anti-globalization activists. Many internationalist businesses changed sides after experiencing disappointments on economic fronts including China's non-compliance with some of its WTO obligations; China's acquisition of foreign technology at lower-than-expected prices; and the serious inadequacies in the WTO's governance of global trade. Many of the disillusioned internationalists have given too much weight to the contribution of globalization to negative developments in the US labor market, and too little weight to the role of powerful capital-biased technological changes and to the inadequacies of state-provided programs for social insurance and human capital formation. Resolution of the trade war and prevention of its frequent occurrence will become more likely when (a) China adopts much greater reciprocity in its economic engagement with the advanced countries despite its status as a developing country under WTO rules; and (b) US stops equating geostrategic competition with economic competition; recognizes that economic dynamism and economic resilience comes from strengthening indigenous innovation capability rather than from holding China back technologically; and institutes social programs to significantly reduce the trauma that is created by frequent job changes. Deep reform of WTO is urgently needed but is unlikely to happen in the medium run. For the medium-run, the US should mobilize country cooperation in regional settings (like the TPP) to introduce policy innovations to serve as templates for a re-designed WTO architecture, and to harness collective market power to be used in future negotiations on WTO reform.

Abstract:It is well recognized that intellectual property rights (IPR) violations are at the heart of the economic conflict with China. Little agreement, however, exists about the origin and solutions for this provocation. Broadly speaking, two prescriptions have been proposed: the natural evolutionary and the rule of law views. While both have merits and add to our understanding, they do not go far enough to address the more fundamental IPR policy issue: China has benefited from a rule of law overseas and a rule through law at home, manufacturing unfair advantage to its firms, many of which are owned and/or influenced by the government. While recognizing China’s recent effort in improving IPR protection, we point out the intrinsic contradiction in the political economy of China between maintaining the one-party rule, on the one hand, and protecting IPR by an independent court, on the other. Understanding this tension in the application of IPR law can help the international community search for more effective policy options.

Abstract:Through legislative changes, tariff wars, and executive actions, the Trump Administration has injected a new urgency into international technology and supply chain management, particularly between the United States and China. Analytically, the situation invites a perspective that links practical/on-the-ground responses by commercial actors in the politics of technological competition between superpowers, i.e. a discussion that bridges the gap between policy and process. This article therefore approaches management of supply chain disruption in terms of a key security issue motivating recent changes to the trade environment: the protection of intellectual property. After reviewing critical policy developments and trade statistics, we draw upon data on IP-intensive industries from global patent offices, trade classifications for products made by these IP-intensive industries, and concordance data on patent classifications to illustrate the centrality of IP to extended supply chains. With these key relationships in mind, we outline specific opportunities that intellectual property licensing provides for managing supply chain linkages between the United States and China in the current geopolitical environment. Viewing intellectual property as both a driver of and a solution to trade difficulties highlights the sorts of cross-jurisdictional nuances that can better inform policy and business decisions alike in the broader international trade regime.

Abstract:The main axis of the US-China game deepens from Trump's trade war to Biden's tech wars. At the same time, the chip industry has gradually become the main battlefield for the United States to suppress and curb China's scientific and technological fields. Whereas chips are an essential part of modern military equipment, communications facilities, nuclear power plants, transport systems and other critical infrastructure. Early mastery of the core chip technology can be early not to be constrained by others, to avoid the risk of being "necked".This paper will analyse the reasons why China makes the US feel that its national security is threatened, the impact of the US-China trade friction on China's science and technology sector, and find out the measures that China can take to deal with the US sanctions related to the science and technology sector, as well as the right way for China to get along with the US.

Abstract:Industrial policy (IP) toward technology innovation (TI) is a focus of the US trade war against China. The US is forcing China to stop IP uses in promoting TI that directly threaten the US technology leaders, like its reaction to China's plan of "Made in China 2025". Does China have too many IP? Does the US use IP? What TI patterns affect IP? This paper develops the following points as conclusions: (a) Due to market failures, all countries implement IP in their economic development; (b) original innovation (OI) involves a lot of risks and uncertainties such that entrepreneurship rather than government plays a key role, while imitation innovation (II) is much less risky and uncertain so that more rooms are left for IP; (c) technology-leading countries like the US has to conduct OI to maintain their advantages, and catching-up countries like China do more II, thus more IP are adopted in China than the US; and (d) the US engaged substantially IP in the history and is deploying various IP to meet challenges from China; and (e) economic and political institutions matter.

Abstract:Three major concerns drove the U.S. into initiating the trade war, and they are (a) the concern that China’s chronically large trade surplus was depressing job creation in the U.S. (b) the concern that China was using illegal and unfair methods to acquire U.S. technology at an effectively discounted price; and (c) the concern that China seeks to weaken U.S. national security and its international standing. On the dispute over China’s exchange rate and trade imbalance, the first conclusion is that it was marked by analytical confusion over the meaning of the term ‘equilibrium exchange rate’. The second conclusion is that China’s trade imbalance reflects the economic conditions in both China and U.S., and that the efficient and fair solution of the problem requires policy changes in both countries. On the industrial policy dispute, the first conclusion is that the issue of forced technology transfer is largely a dispute about China using its market power to benefit itself at the expense of its trade partners. The second conclusion is that China’s use of market power can last only until the other large countries could unite and retaliate as a group. The inevitability of retaliation means that China should replace the joint-venture (JV) mechanism for technological diffusion with other ways to strengthen its technological capability. On the U.S. concern about whether China trade weakens its national security, the first conclusion is that the notion of national security that is commonly adopted in the U.S. trade policy debate is ignorant about the primary determinants of U.S. capability in innovation. By focusing instead mainly on how to hold down China technologically, the long-run outcome will be a technologically weaker U.S. and hence, a more vulnerable U.S. The second conclusion is that the U.S. must identify a clear, short list of critical technologies and critical infrastructure for the recently reformed Committee for Foreign Investment in the United States (CFIUS) to cover, and update this list constantly. Otherwise, the broad and changing nature of notions about national security would allow the bureaucratically driven phenomenon of mission-creep to steadily expand the coverage of the CFIUS process, thereby steadily rendering CFIUS to be operationally capricious. Our principal policy suggestion to China is that, because China’s economy in 2018 is very different from that in 1978 (e.g. many parts of China now look like Singapore and China is Africa’s biggest donor), there should be more reciprocity in China’s trade and investment relations with the advanced economies despite China’s status as a developing economy under WTO rules. Our principal policy suggestion to President Trump is to stop equating strategic competition with economic competition. Strategic competition is normally a zero-sum game. While fair economic competition is usually a zero-sum game in the short run, it generally creates a win-win outcome in the long run.

Abstract:Geographical indications (GIs), signs used on products that identify their geographical origin and special quality or reputation, are atypical intellectual property. The conflicts of interest between the New World and Old World and the diversity of legal regimes have obstructed the international harmonization of GI protection. Neither the Lisbon Agreement nor the TRIPS Agreement have been able to establish a widely accepted international GI registration or protection system. Though the Geneva Act has remarkably improved the treaty regime of GIs, the different approaches of the European Union and United States still seem irreconcilable. This article examines the Chinese dual GI system from a treaty perspective and explores the common functions of GIs and Trademarks, concluding that China's Trademark Law can ensure GI protection that is compliant with the TRIPS Agreement and the Geneva Act. The Chinese solution can be a reference for other countries which protect GIs with a trademark system.
China'S Experience in Dealing with Wto Dispute Settlement: A Chinese Perspective

Abstract:The year 2009 witnessed the rise of China as one of the major players in World Trade Organization (WTO) dispute settlement since it alone accounted for half of the fourteen new WTO disputes initiated in that year. This paper examines China’s growing involvement in major WTO dispute settlement activities and concludes that China’s participation has been a gradually evolving process. This article explains that China’s defensive and offensive positions are generally balanced and argues that China seems to approach WTO disputes on a case-by-case basis rather than by applying any preset litigation avoidance strategy. When faced with negative rulings, China has so far been quite restrained in its reactions and has generally maintained a good record of compliance, but China’s future behaviour in this regard may not always be as consistently positive. As to overall performance, this paper demonstrates that China’s record has been typical of the bigger WTO Members. Finally, it would be unfair to assess this record only with reference to the global ranking of China’s trade volumes and economic size while ignoring China’s short period of WTO membership and lack of historical experience in international dispute settlement proceedings.

Abstract:The recent US trade policy change during the past two years has given rise to a series of trade frictions between the U.S. and many other countries. The Sino-U.S. trade war is probably the most intense and significant aspect of these trade frictions. While the U.S. resorts to trade protectionism and unilateralism in pursuit for a fair trade order, China tries to set up an image of a defender of trade multilateralism centered on the WTO. Neither the U.S. nor China will benefit from the trade war. While the U.S. would suffer from erosion of its leadership and credibility, China would face immense difficulty in the future if the persistent global concerns over its economic model remain unaddressed. The trade war necessitates the international community to reflect on the notion of fair trade order and to take measures to realize it.

Abstract:This study examines the trade dispute between the United States and China from a neo-realist perspective. The relationship between the United States (US) and China became a public concern during the leadership of US President Donald Trump. How could it not be, the two countries were involved in a trade war which ultimately had an impact on the global trade sector in 2019. The method used in this research is qualitative, qualitative provides an in-depth explanation of a phenomenon by collecting related data, highlighting the importance of accuracy and detail in the information provided. studied. The aim of this research is to analyze the trade conflict between China and the US from a neo-realism perspective. This aim can help understand how power can influence. The research results show that the trade war started because Trump did not agree with his country's trade. then linked to neo realism where each country will respond based on its own aspirations for the sake of national interests. Until finally this trade dispute was resolved by the World Trade Organization (WTO). The WTO says the United States has violated global trade rules by imposing tariffs worth billions of dollars in its trade war with China. The WTO decision immediately angered Washington.

Abstract:The authors maintain that, while unable to hamper the legislation of domain conflicts, the controversy of the legal nature of the domain challenges the uniformity of the application of laws. Based on an analysis of the U. S. domain laws,the paper posits that the vicious snatching of domain names is in effect an infringement upon the rights of the trade mark owner,and that it is necessary that China's trade mark laws include jurisdiction of domain conflicts.
