Reflection of the Banking Crisis Management in China from a Legal Perspective

Abstract:We can't deny the fact that banks play a key role in our society, while it is impossible to avoid banking crisis even under the strictest supervision. The current legal system in China for banking crisis management is imperfect. It lacks both sufficient means to resort to, and enough protection for individual depositors in case of a crisis. The main practices in foreign developed countries are the lender of last resort (LOLR), the deposit insurance system and Market-withdrawal system. LOLR aims to save the banks which run into payment crisis temporarily. Usually this operation is performed by a country's central bank. The deposit insurance system is designed to divert the risk. Once a bank crisis occurs, the deposit insurance institution will repay the depositors' deposit in certain proportion. In order to make banks adaptable to market competition, we should enact banks market withdrawal legislation.We need to improve our bank crisis management mechanism in following aspects: (a) improving the restructuring mechanism; (b) constructing the emergency measures; (c) improving the merge and bankruptcy system; (d) reforming the lender of last resort system; and (e) establishing the deposit insurance system as soon as possible. We need to enact detail rules to regulate the take-over system, including the definition, precondition, object, terms, limitation and redress of the take-over action. Apart from take-over system, we should form certain short-term contingency plans. Banks tend to merge to improve their competitiveness and some of them can't avoid bankruptcy in market economy, so we should enact relevant laws and regulations. Since abuses of LOLR system will result in disrupting the market competitive system and lead to moral hazard, it is necessary to formulate strict standards in order to apply LOLR system cautiously. The deposit insurance system, which has proven satisfactory in western developed countries for decades, needs to be established in our country as soon as possible.

Abstract:The development of Internet banks puts forward the new challenges to our present laws. Market access and quitting of Internet banks, the protection to the right of privacy of Internet banks' customers, the conflict of Internet banks and legal system of commercial instrument, supervision about Internet banks, legal effect of electronic signature and the legal responsibility of Internet banks. The safety of Internet banks can be guaranteed by passing the legislation of electronic signature law, strengthening supervision, regulating the behavior of Internet banks and enhancing the practical standard of Internet banks.

Abstract:China’s banking system has a relatively high level of state control, while an important task in regulating the banking system is to manage the profitability of banks. Using the stochastic frontier approach to assess the profitability of commercial banks not only allows for the bank’s ability to generate profits relative to the leading banks in the industry to be assessed but also takes into account the specifics of the management technologies used and the influence of the market environment. This article analyzes the profitability of the Chinese banking system for the period 2012–2020 using the stochastic frontier approach from the position of the central bank. The specifics of the analysis from the bank’s perspective imply a focus on the position of most banks regarding the level of best practices and trends in changing the overall level of profitability. Analysis may be of interest to banking regulators and researchers. In general, the Chinese banking system demonstrates a high level of profit efficiency and cost efficiency, although the dynamics of these indicators are negative. The reason for the negative dynamics is a decrease in the economic growth rate of the economy, the instability of the financial market and ongoing reforms. State-owned commercial banks are becoming highly profitable, while national joint-stock commercial banks are facing increasing competition and reducing efficiency of profitability. City and rural commercial banks maintain a high level of profitability due to state support.
Bank Reform Should not Blindly Worship Ownership

Abstract:A critical year for Chinese banking industry, the year past saw ever fiercer disputes over the paths bank reform should take. Though a majority of experts are inclined to agree that "attraction of foreign fund is beneficial for the optimization of the structure of bank property rights and is an effective way to reform", the public are still cynical about whether investment, redemption, sale of equity to foreign fund can essentially revitalize Chinese bank. Research on the Threshold of Symbiosis Between Finance and Real Economy – Empirical Test Based on Banking Panel Threshold Model

Abstract:Purpose Starting from the theoretical mechanism of profit sharing between finance and the real economy, this paper reviews and analyzes the profitability of China's banking industry and makes a horizontal comparison with the banking industry of the United States, Japan, and Germany. Design/methodology/approach Based on the panel threshold model, it is found that there is a dual-threshold asymmetric effect between banking profit and the growth of real economy. When the net profit rate of the banking industry is lower than 0.491%, the increase in banking profitability will inhibit the growth of real economy due to profit grabbing; when the rate falls within the range of 0.491–0.801%, the increase in bank profitability is conducive to the growth of real economy. Findings Finance and the real economy are in the most comfortable symbiotic state; when the rate is higher than 0.801%, the continued increase in bank profitability will weaken the promotion effect of finance on the real economy, but bank profitability and the growth of real economy are still in a symbiotic state of positive promotion. Originality/value The promotion effect of China's bank profitability to the growth of real economy has shifted from the suboptimal state to the optimal range as a whole, which is attributed to the strong deleveraging and strict supervision of the Chinese government after 2016, the timely and decisive “stepping on the brakes”, pulling the financial sector back from the “illusion” caused by “self-circulated” profits and preventing it from harming the real economy.

Abstract:The current paper contributes to the empirical literature on bank profitability by testing the joint-impact of different types of risk, competition in different banking markets and different types of efficiency on bank profitability using a sample of Chinese commercial banks over the period 2003–2017. In particular, we fill in the gap of the empirical studies by examining the impact of efficiency on profitability when banks undertake different levels of risk-taking behaviour and face different degrees of competition. The results show that competition in the Chinese banking markets (deposit market, loan market and non-interest income market) is stronger over the period 2003–2005 and also 2014–2017. In addition, it is found that bank size, cost efficiency, profit efficiency and inflation are significantly related to bank profitability. Finally, we find that the positive impact of cost efficiency on profitability is stronger when banks undertake higher levels of risk and face more competition.
Financing Cost,Financing Substitution,and the Profit Volatility of the Pawn-Broking Industry in China:Empirical Evidence and Theoretical Explanations

Abstract:This paper offers a possible explanation to the profit volatility of the pawn - broking industry in China from the perspective of firm financing cost.Using both firm survey and cross - country data,we find the pawn-broking industry in China is characterised by the fact that its demand is largely driven by the financing purpose of small and medium firms,which is distinct from other economies.Based on this finding,we construct and analyse a behavioural model of firm financing to find a key to the profit volatility.Our explanation is that the relaxed financial policies in China after the outbreak of the global financial crisis significantly reduced the financing cost through banks as opposed to the cost of financing through pawning which basically remained rigid.As a reasonable response,firms are inclined to borrow from banks instead of pawn - brokers,causing a plummet in demand for pawn - broking.Tight monetary policy has the opposite effect.The empirical relationship between the directions of macro policies and the profitability of the pawn - broking industry positively supports our hypothesis.

Abstract:Considerable excess deposits over loans of Chinese commercial banks will decrease their operational profits and also foretells the possible financial default risks.Overcoming the negative effects of excess liquidity of Chinese commercial banks lies in the following two key factors: First,the banks should face the fact of "double excess"—excess liquidity of banks and excess productivity of firms,adjust the structure and scales of loan stocks and increments,improve ability to prevent loan risks,reform the traditional operation method that greatly relies on interest income business,and diversify financial services and clients by M&A,restructuring,financial innovation and inter-bank cooperation.Second,the macro operational environment of commercial banks should be improved: fully carrying out reform of interest marketization,greatly enlarging operational scopes of commercial banks,and really strengthening operational autonomy of commercial banks.

Abstract:Chinese commercial banks are transforming their activities into more non-interest income businesses under a highly regulated financial system. This paper investigates the effects of this transformation on profit and risk efficiencies. We find that commission and fee income significantly reduce risk efficiency due to the circumvention of the regulation on deposit interest rate and the assumption of risk that should have been borne by customers. In terms of trading income, it significantly reduces profit efficiency due to the upper limit of the loan-deposit ratio, the lack of investment channels and low returns of bond markets. The regulatory authorities are supposed to further liberalize the banking industry and grant banks more rights.

Abstract:In the economic transitional period, the problem in financial transaction between banks and enterprises is a distorting credit relationship.Through analysis on the theory of incomplete contract,asymmetrical information and credit sub-optional game,this paper demonstrates that the harmful choice and moral hazard in financial transaction between bank and enterprise cannot be avoided.Based on such analysis,some countermeasures such as institutional arrangement,improvement of micro economic environment and credit breeding in financial transaction between banks and enterprises are recommended.

Abstract:The banks' overall net profits have increased year by year since the start of banking reform in our country in 2003. It has caused great concerns in at home and abroad. Adopting a ROE model, this article analyzes the profitability of the state-owned commercial banks in China based on the data of the Bank of China and the Agricultural Bank of China. It proposes such measures of profitability as the banks' strengthening their financial innovation on the basis of stabilizing the existing profitability and decreasing the average cost levels by expanding the scale.

Abstract:All the income of commercial banks is divided into traditional interest rate spread income and various non-interest income, all along, the bank's income mainly comes from its deposit and loan spread, that is, net interest income, and other businesses develop slowly. However, with the deepening of interest rate market-oriented reform and foreign exchange system reform, the diversified development of commercial banks has become increasingly prominent, becoming one of the basic hubs for bank transformation and financial risk prevention and control. Based on the revenue data of 10 listed commercial banks in China from 2011 to 2021, this paper analyzes the impact of commercial banks' profitability on their income structure and exchange rate changes, so as to explore the business strategies that can bring profit improvement to banks in the context of changing macro economy.

Abstract:This article investigates the profitability of Japanese banks following the major financial crisis that affected the country's economy in the mid-1990s. Further, it examines the determinants of bank profitability for a sample of banks with different ownership structures (City, Trust, Regional, Second Association Regional, Shinkin and Other Credit Cooperatives). We find evidence that well capitalized, efficient banks, with lower credit risks tend to outperform less capitalized, less efficient counterparts with higher credit risks. Second Association Regional banks and Shinkin banks (but not other ownership types) appear to benefit from diversification advantages which feed through to profitability. Furthermore, we find that industry concentration, Gross Domestic Product (GDP) growth and the extent of stock market development play an important role in determining the profitability of Japanese banks.

Abstract:The global financial crisis triggered by American subprime mortgage crisis results from the financial systems,led by Wall Street,of Europe and the United States which violate such three principles of financial industry as being rooted in industry and commerce,strict risk management and control,as well as moderate leverage rate.China's financial industry should prevent such five trends as excessive overlapping policies,increasing enterprises' financing cost,too much privileged consciousness,too high income and weak service consciousness.Crisis-prevention should use such four balances as the gross proportion of loan to GDP 1∶1,gross proportion of securities market value to GDP 1∶1,gross proportion of total real estate value to GDP 1∶1,and gross proportion of national sovereign debt plus social security expenditure to GDP 1∶1.Crisis solution should not only depend on self-circulation of financial industry but rely on scientific and technological progress and tangible economy development.

Abstract:China's innovation capacity has been growing rapidly in recent years, but the country still needs to improve its national innovation system and form a financial services system that is compatible with the full life cycle of science and innovation companies. Looking back at China's history of financial development, the choice and feedback of commercial banks on regulatory policy has been an important factor influencing regulatory policy. With China's financial market gradually opening up to the outside world and an influx of foreign commercial banks, Chinese commercial banks are facing increasing competitive pressure. Improving the profitability of Chinese commercial banks to enhance their competitiveness has become a key to financial innovation and reform in the Chinese banking sector. Therefore, this study investigates the profitability and profit efficiency levels of Chinese banking industry over the period 2012-2020 using stochastic frontier approach. The empirical analysis leads to the following conclusions: The result is that national joint-stock commercial banks and city commercial banks, which have been given more management freedom, are trying to adapt to the dynamically changing environment and show an increase in efficiency. State-owned commercial banks maintain high levels of efficiency, but are more conservative to change. Agricultural commercial banks, for the most part, are showing efficiency gains, with no strong deterioration shown. Abstract:Enhanced profitability is an important guarantee to improve the well-being of people and better exert the functions of commercial banks in promoting economic, social and production growth on the premise of the existence and development of commercial banks. Interest rate liberalization is one of the key factors which can affect the profitability of commercial banks. An empirical study is thus carried out on 16 Commercial banks (from 2007 to 2018) to analyze the impact of interest rate liberalization on the profitability of commercial banks. We draw main conclusions from this study: (1) the progress of interest rate liberalization has improved the profitability of banks. (2) This kind of impact is inverted U-shaped, that is, with the advancement of interest rate liberalization, the impact will be reversed in the future. (3) For banks of different sizes, the impact is different. Specifically, small and medium-sized banks are more sensitive to the liberalization of interest rates, while for larger banks, the impact is not strong.
