Civil Code and Discretionary Power of Judges

Abstract:Between the general clauses of the Civil Codes and the discretionary power of the judge, there is a type of "symbiosis" relation. The general clauses are essentially vague, abstract and general, such characters make them the safeguard of the openness of the Civil Codes. Nevertheless, the complementary, correctional and creative functions of the general clauses can only be realized through the discretionary power of the judge. On the one hand, the Civil Codes contain necessarily some omissions even errors, the interpretation of the judge is the most efficient way to fill such gaps; on the other, all tentatives to limit the discretionary power of the judge will restrict the evolution of the Codes, accelerate its scleroses and impair its vitality. Today, the real problem is not the legitimacy of the creative power of the judges, but the increasing menace to such kind of power: law is more and more technical, legal rules contain more and more technical details, the latitude of the judge's interpretation is more and more compressed. In such sense, the future Chinese Civil Code should leave more institutional space for the interpretation by the judges.
