Abstract:The most important point in relation to constitution of a crime lies in the mechanism of substantive determination of a crime.However,if the significance of the constitution of a crime is only limited at substantive level,one may come to a kind of one-sidedness.As a matter of fact,constitution of a crime is regarded as an integrated guiding concept in the process of criminal proceedings.A complicated consideration of proceduralism exists behind the construction of its system.Taking systems established in Germany,Japan,Britain and America as the backdrop of the discussion,and emphasizing the link between constitution of a crime and proof of criminal proceedings as an entry point,this article offers a preliminary extension of procedural value of the system of constitution of a crime,and provides a critical approach to the improvement of the system of constitution of crime in China as well.The article notes that constitution of a crime serves as a conceptual framework to guide the proof of the criminal proceedings,not only because all essential elements of constitution of a crime determine the basic idea of "substantive form",thus restricting a general scope of targets to be proofed;but also because the hierarchy of constitution of a crime provides the order of burden of proof,as shift and moving forward of burden of proof is precisely arranged on the basis of the system of hierarchy.Moreover,it is even more important that the systemic structure of constitution of a crime determines the limits of distribution of burden of formal proof and regulates the standards of proof.The basic issues in terms of proof of criminal proceedings should,in a sense,be traced back to the level of constitution of a crime.Only thus can we hit on a proper and reliable solution.
