Pre-Litigation Compulsory Mediation: A Concept Worth Negotiating

Abstract:Since its inception, mediation has steadily grown into a viable dispute resolution mechanism. Indeed, it has grown from a seldom understood concept - frequently confused with meditation - to a common platform that has risen so high in popularity that the USA Network has even based a sit-com on it! Anthony M. Lanzone, who has contributed to many ADR panels, defines the mediation process as “a non-binding, confidential dispute resolution process before one or more third party neutrals. Individuals and entities generally participate in mediation in order to resolve their dispute through non-binding negotiations.” From humble beginnings, mediation is now a staple of the administrative charge and litigation process. Many governmental agencies have implemented mediation into their charge handling process. For instance, the Equal Employment Opportunity Commission (EEOC) offers mediation to charging parties and respondents both at the onset of a discrimination charge filing and later in the process if a “probable cause” finding is made and the case is set for a trial before an administrative law judge. The process has been so successful for the EEOC that they now boast a 70% settlement success rate. Similar success rates have been stated in other mediation settings as well. Regardless of the actual settlement percentages touted, it cannot be denied that mediation is an extremely valuable and viable dispute resolution mechanism.The growth and acceptance of mediation in the court system has been clearly evident in the past decade. It is common to see courts employ a team of both staff and volunteer mediators to help resolve disputes and ease an overly congested court docket. But while the concept of voluntary mediation has been readily accepted by the legal community and the parties that they represent, the acceptance has been largely due to the fact that there is little cost to participate, the process has an advantageous confidentiality component, and - most importantly - the decision regarding participation in mediation is just as voluntary as the option to enter into a negotiated resolution. Everyone has a choice to walk away from the concept of mediation just as they have the option to walk away from a potential resolution at the table. No harm, no foul. But what if parties were forced to mediate their disputes? What if no case could proceed to trial unless there was first an attempt at mediation? Better yet, what if virtually all civil lawsuits/complaints could not be filed in court without first presenting evidence that the parties have attempted to mediate their dispute? Is this a crazy concept? Perhaps it is, but as we will see, the concept is not unheard of, and it is definitely plausible!

Negotiating violence in family law mediation

Abstract:Purpose The purpose of this study is to understand mediation in divorce cases where intimate partner violence (IPV) is a concern. These cases may involve managing power imbalances, coercive control or risk for continued violence. Design/methodology/approach In this paper, the authors use feminist and sociological theoretical approaches and grounded theory to analyze triangulated ethnographic data to explore how mediators construct and manage the issue of IPV in mediation. Findings The results indicate that mediators often share a common discourse about IPV that asserts that mediators are professionals with the skills to both identify IPV and to appropriately conduct mediations where IPV is present. However, to achieve successful mediations mediators sometimes choose to discount the seriousness of IPV in assessments. They also use a set of fluid strategies to handle potential power imbalances that allow them to represent themselves as unbiased, even while those strategies risk the equity of the mediation. Practical implications The authors share several strategies that could enhance the social justice of the process for all parties, including uniformity in assessing whether IPV is a concern and oversight of mediators’ practices and training. Social implications The results indicate mediators often share a common discourse about IPV that asserts mediators are professionals with the skills to identify IPV and to appropriately conduct mediations where IPV is present. To reach settlement mediators use a set of fluid mediation and accommodation strategies to handle potential power imbalances due to IPV that allow them to represent themselves as impartial, even while those strategies may risk equity in the mediation. Originality/value The unique data provide a behind-the-scenes look at mediation generated from participant observation of mediation training and actual mediations, along with interviews with 30 practicing mediators.

Abstract:The purpose of this piece is to reflect on the role currently played by mediation in the resolution of international commercial disputes. This objective is both broad and ambitious and the chapter benefits from the fact that this book contains over a dozen contributions from prestigious authors in the mediation sector who adroitly address a broad range of aspects of international commercial mediation. The chapter’s main focus is consequently the outlining and discussing of a specific series of issues that aim to complement the analysis developed by the other contributors in this edited volume.Section II therefore explores the new meaning that some scholars have attached to the widely used acronym ADR (alternative dispute resolution). Considering mediation an important part of the ‘appropriate dispute resolution’ mechanisms available to commercial disputants suggests that a new light is shining through this important sector and the principles that it embraces, such as access to justice. This central idea is developed in Section III, which addresses various highly topical issues in the framework of commercial mediation: the dilemma of compulsory mediation in non-family contexts; the impact of developments in information and communication technology on the mediation milieu; the role of ethics in the contemporary mediation world, and the structure and main objectives of training schemes in international commercial mediation. Section IV concludes the discussion and leads on to the thematic studies of international commercial mediation.
Mediation in Criminal Misdemeanor Cases

Abstract:Diversion of criminal misdemeanors to mediation by district attorneys has been practiced since the 1970s, but research on its impact on critical outcomes like recidivism is scant and outdated. This quasi-experimental study compares 78 mediated cases from a county that diverts cases to mediation with 128 cases in a similar neighboring county that does not, using phone surveys and case review to ask whether recidivism in mediated cases differs from cases prosecuted or treated as usual over the subsequent year. Controlling for case factors and attitudes toward conflict, a case that is not mediated was five times more likely to result in judicial action, five times more likely to result in jury trial demand, and ten times more likely to result in supervised probation or jail time, and mediated cases were almost five times less likely to return to criminal court in the subsequent year than those that were not mediated.

Abstract:Confidentiality is a central essential feature[1] of mediation, a fundamental principle, and one of the most important ethical obligations[2] of a mediator which enhances open, honest communication[3] between the parties and the self-expression of their interests, needs, and concerns in a safe environment.[4] Confidentiality is often an incentive to initiate a mediation process because the interest of confidentiality can be realized from a continuum of dispute resolution systems through the use of the mediation process which ensures the non-disclosure of information. A special interest of a party in confidentiality may be driven by the desire to avoid the precedent of a court decision. The article analyzes the importance of confidentiality in terms of privacy, the obligation of a mediator to inform the parties, and the standards for the safe sharing of confidential information. Abstract:We used discourse analysis to study how mediators and parties negotiate competing priorities and values during the family mediation process. We drew on understandings of practical morality, specifically the concept of a moral order, to study UK mediation session talk. Our analysis highlighted the contradictory moral orders drawn on by parties and mediators. The saliency of moral categories and concerns in parenting is demonstrated, and we consider the problems this causes in the “no-fault” context of mediation.

Abstract:Every transaction has the potential to go wrong and international commercial contracts are not spared this plight. It is when an international commercial contract fails – irrespective of the reasons, that the impact of different legal and cultural backgrounds of the parties come to light. The obvious venue for commercial disputes to be decided is generally understood to be in court (litigation) or before an arbitral tribunal (arbitration). However, there are numerous other alternative dispute mechanisms4 available to parties that are less well known and also deserve consideration; not least because they offer parties methods of resolving the dispute between them in a more time and cost-efficient manner, and with a stronger focus on the commercial interest of the parties. Mediation is one of these mechanisms.This chapter provides an overview of the basic concepts of mediation; how it distinguishes itself from but can also be employed together with other dispute resolution mechanisms such as, in particular, arbitration; the legal framework; and practical guidelines when drafting a mediation agreement in the context of international commercial contracts.

Abstract:Securing fast, inexpensive, and enforceable redress is vital for the development of international commerce. In a changing international commercial dispute resolution landscape, the combined use of mediation and arbitration has emerged as a dispute resolution approach which offers these benefits. However, to date there has been little agreement on several aspects of the combined use of processes, which the literature often explains by referring to the practitioner’s legal culture, and there is debate as to how appropriate it is for the same neutral to conduct both mediation and arbitration. Identifying the main ways of addressing concerns associated with the same neutral conducting both mediation and arbitration (same neutral (arb)-med-arb), this book examines how effectively these methods achieve the goal of fast, inexpensive, and enforceable dispute resolution, evaluating to what extent the perception and use of the same neutral (arb)-med-arb depends on the practitioner’s legal culture, arguing that this is not a ‘one-size-fits-all’ process. Presenting an empirical study of the combined use of mediation and arbitration in international commercial dispute resolution, this book synthesises existing ways of addressing concerns associated with the same neutral (arb)-med-arb to provide recommendations on how to enhance the use of combinations in the future.

Abstract:Alternative Dispute Resolution Mechanisms (ADRM) are a possibility to resolve conflicts without the need to go to trial. The most used are mediation, conciliation, and arbitration. In this review we will focus specifically on mediation as an alternative for the resolution of medical legal conflicts. Where the history of the ADRM in Mexico and the evidence of the failure of the adversarial method for the resolution of doctor-patient conflicts will be reviewed. In addition, the incomplete role of the application in our country of the ADRM in the legal field will be highlighted and finally the successful experience of mediation to resolve this type of conflict in other countries of the world will be presented. In this way, the objective of this narrative review is to show that mediation can be an effective and beneficial option to resolve medical conflicts in a fair and equitable manner for all parties involved.

Abstract:Medical treatment and narratives are interrelated. We examined this interrelation by evaluating the medical dispute mediation system in Taiwan. We conducted 16 semi-structured interviews with legal and administrative specialists in medical mediation and physicians involved in mediation meetings. The interview data were reproduced into almost verbatim text for coding and analysis. We examined how narratives were discussed in the field of medicine and identified two approaches to narratives. One was the narrative from a patient's storytelling, that is, narrative-based medicine. The other was the narrative of medical staff, which included shared decision-making and decision aids. Discussions of these approaches revolved around the avoidance of conflicts during medical treatment. However, knowing how to handle unsuccessful medical treatment is crucial. By applying polyphony in narratives, physicians can comprehend the role of narratives in unsuccessful medical treatment, helping themselves to practice how to develop narratives to communicate with patients and their surrogates when encountering any difficulty in different stages of medical treatment.

Abstract:Conflict-related and disputable situations have been present in our lives since ancient times, when people have become aware of the need to protect their rights and interests, sometimes at odds with the aspirations of others. The conflict that emerges between people disturbs their relationships and poses a threat to the proper functioning of people, bringing with them negative emotions. However, it can be an opportunity for development, be treated as a change in interpersonal relationships and can ultimately produce positive effects. Mediation offers a possibility of converting the negative aspects of the conflict into constructive solutions. Being voluntary, confidential, non-formal, out-of-court proceedings, it enables the parties to come to an agreement, offering them the opportunity to actively participate in shaping the legal and social situation and exercising their rights and interests in the spirit of consensus. In the mediation process, the parties use the support of a professional, impartial, neutral mediator. The authors of the article promote the idea of mediation with full conviction that it is a valuable and effective way for conflicted parties and third parties and their relatives to reach a consensus on various issues, including family matters.
Multilevel Access to Justice in a World of Vanishing Trials: A Conflict Resolution Perspective

Abstract:This paper proposes a novel approach to access to justice by introducing a complex multilevel model that addresses the stages of conflicts in an age of vanishing trials. It provides a nuanced understanding of various modes of access to justice that correspond with different needs of disempowered populations before they enter the legal system and as they make their long journey within it. Parties trying to resolve their disputes through the civil justice system end up nowadays drifting through an incoherent, inconsistent and opaque process generally resulting in some form of reluctant compromise. ADR processes such as mediation do not necessarily help in providing a genuine alternative throughout the legal process, in which reliable data regarding expected case disposition and outcome (on the basis of similar cases) are not made available to the parties. No systematic screening mechanism directs parties to holistic conflict resolution alternatives. The involvement of judges in promoting consensual disposition of legal cases is rare and limited in scope. Accordingly, many people who initiate lawsuits as default find themselves within an adversarial and incoherent negotiation process in the shadow of the courts. This problem is particularly true for unrepresented litigants, a growing population that seeks access to justice in contemporary court systems. It is also true for conflicts that never reach the court or any legal processing due to the barriers of cost and legal information. To address the question of access to justice in an age of vanishing trials, in light of the failure of ADR to become the prevailing paradigm for resolving conflicts and the decline of litigation, this paper develops an interdisciplinary multilevel model that draws on legal theory together with methodology from law and society scholarship. This model addresses ways for improving access to justice during each stage of the civil conflict, focusing specifically on the stage of pretrial hearings, as it is currently the main public sphere in which parties seek justice. Our findings regarding the role of judges in pretrials, based on court observations and interviews, suggest that that judges develop their own methods and perspectives to promote access to justice in an age of vanishing trials and in this paper we outline some of them. We propose to expand the horizons of access to justice by adopting our modular multilevel model embedded within a coherent Dispute System Design approach and inspired by public health perspectives on law.

Abstract:Provision for appropriate dispute resolution clauses in international commercial contracts has evolved to become an essential ingredient in contemporary competitive markets. They also serve as a pre‐emptive remedy, necessitating further demands for cheaper remedies in dispute management, specifically alternative dispute resolution2 2. Hereinafter referred to as ‘ADR’. Further, there is the question whether the business community could sustain the average commercial fees for dispute settlement without becoming a source of resentment or revolt in the long term. Abstract:This article seeks to explain the role and salience of culture in interstate conflict management efforts. Past studies of cultural similarity in conflict management involving third parties often focused on two-way cultural relationships: either examining cultural similarity between disputants or similarity between third parties and each of the disputants as individuals. However, we argue that this first wave of research should be augmented by a focus on triads. Our study asks the question: to what extent does cultural similarity among disputants and potential mediators predict the likelihood of a mediation offer? We test our hypotheses using data from the International Conflict Management Dataset between 1945 and 1995 and find that mediation offers are most likely to emerge when the triad is ethnically or religiously similar, while shared political culture is not a reliable predictor of mediation offers to disputing dyads.

Abstract:The study aims to identify the manifestations of legal anomie in the legal regulation of alternative conflict resolution in Russia’s legal system and, based on the analysis of regulation in foreign countries, to offer possible ways to minimize anomie manifestations. Dialectical, formal-legal and comparative-legal methods were used in the research process. The article considers the legal regulation of mediation in Russia in a comparative-legal aspect with foreign countries and analyzes the current legislation and practice of its implementation. The study also revealed anomalous manifestations at the institutional and other levels of Russia’s legal system. Declarative fixation of legal responsibility of mediators, as well as insufficiency of normative requirements to their professional level; absence of normative fixation of mandatory centralized bodies (associations) of mediators, which in turn generates insufficiency of corporate regulation of their activities. The study proposes to borrow foreign experience in the legal regulation of mediators’ certification. The study also makes proposals to improve the current legislation.

Abstract:Aim: Conflict and conflict resolution are as old as humanity. At different ages, people try to remedy conflicts between individuals or groups in different ways. The sending of ambassadors or the court of the king's bench, as an institution of arbitration, or even the archaic form of mediation, can be found in thousands of years of historical sources. In this study, the focus is exploring the processes.Methodology: In this paper, we follow alternative dispute resolution methods from the ancient Greeks' conflict management tools to the development of modern mediation and the EU legal harmonization. Methodologically, we used the processing and comparison of contemporary sources.Findings: In both Hungarian and European cultures, there is a tradition of a type of mediation process. In several European cultures, this can still be felt.Value: This article highlights the fact that the third neutral party's presence in the interpersonal dispute resolution is an archaic human need. Its role is inevitable in everyday (alternative) dispute resolution.
