Abstract:We present an efficient algorithm to solve a class of two- and 2.5-dimensional (2-D and 2.5-D) Fredholm integrals of the first kind with a tensor product structure and nonnegativity constraint on the estimated parameters of interest in an optimization framework. A zeroth-order regularization functional is used to incorporate a priori information about the smoothness of the parameters into the problem formulation. We adapt the Butler-Reeds-Dawson (1981) algorithm to solve this optimization problem in three steps. In the first step, the data are compressed using singular value decomposition (SVD) of the kernels. The tensor-product structure of the kernel is exploited so that the compressed data is typically a thousand fold smaller than the original data. This size reduction is crucial for fast optimization. In the second step, the constrained optimization problem is transformed to an unconstrained optimization problem in the compressed data space. In the third step, a suboptimal value of the smoothing parameter is chosen by the BRD method. Steps 2 and 3 are iterated until convergence of the algorithm. We demonstrate the performance of the algorithm on simulated data.

Abstract:Immigration policy, particularly regarding migrants crossing the US-Mexico border, has been a highly debated topic for years. There is a continued debate on how to maintain national security while protecting the health and dignity of migrants. In this commentary, we argue that the Biden Administration's "Proclamation on Securing the Border" issued on June 4, 2024, alongside the Department of Homeland Security (DHS) and Department of Justice's (DOJ) Interim Final Rule, poses a significant threat to the health of migrants seeking asylum at the US-Mexico border by forcing more migrants to wait in encampments in border towns. Specifically, migrants are more likely to face increased exposure to disease, mental health effects, and violence as a result of this proclamation. We call for structural policy reform and propose several alternative policies that can be enacted at the regional and national levels to help maintain the health and dignity of migrants while still prioritizing border security.

Abstract:When countries experience a surge of migrants at their borders, they search for ways to assert control, often using strategies aimed at slowing, reducing, discouraging, or blocking entry. To the extent that national and international law confers rights on some migrants, in particular laws allowing individuals to cross borders to claim asylum, the tools for directly impeding entry may be limited. In this context, states may develop administrative practices to accomplish indirectly what they cannot accomplish directly by law. This article examines the case of metering in the US as an administrative strategy of border control. It traces an unusual path to this strategy, from its origins in informal street-level practices to its evolution into a formal administrative policy extending and ostensibly legitimating those practices. This analysis brings a comparative street-level perspective to the socio-legal analysis of law-in-practice.

Abstract:This article aims to analyze the results of the border security policy agendas of the federal governments of the United States and Mexico, as well as the consequences of migration management, in terms of integrating various aspects such as everyday coexistence in the northern and southern borders of Mexico reflected, among other things, by documented transit; as well as the historical sequence of migrant detentions at different borders in Mexico and in the southern United States. The 2022 US electoral process heightened a nationalist vision that fostered a policy of greater migration control, reflected in a higher number of undocumented migrant detentions.
Title 42 and the Impact on Asylum Seekers: Exploring the Effects of its Termination and its Changes on the US Immigration System

Abstract:The repeal of Title 42, an emergency immigration restriction, represents a significant policy shift in how the United States treats migrants who arrive at the southern border, particularly those seeking asylum. For over three years, U.S. border officers used Title 42 to deport hundreds of thousands of migrants to Mexico or their home countries, claiming that their presence could contribute to the spread of the coronavirus. While Title 42 is allegedly a public health policy, it has been utilized to regulate and prevent unauthorized border crossings. Democrats and campaigners have denounced title 42 because it prevents refugees from obtaining asylum, a legal right they normally have once they reach US territory. Republicans described it as an effective border control tool, requesting that Title 42 should be codified into law so that it may be utilized outside of the pandemic setting. The period of Title 42 ended, which created more obstacles than solutions for asylum seekers. As the US ends Title 42, the rules for asylum seeking are changing once again, the United States will revert to Title 8 under the new standards. The Title 8 Code outlines a strict asylum policy which makes it harder for immigrants to file claims and to seek asylum. Under this new regulation everyone coming from Latin-America, except for Mexico, has to face the harsh reality that the requirements of Title 8 make most of them ineligible for asylum. How does the repealing of Title 42 affect the US immigration system and how will it influence the 2024 elections as the termination was introduced at a critical time, when Biden is seeking a second term?

Abstract:Background: Recent U.S. immigration policy has increasingly focused on asylum deterrence and has been used extensively to rapidly deport and deter asylum-seekers, leaving thousands of would-be asylum-seekers waiting indefinitely in Mexican border cities, a large and growing proportion of whom are pregnant and parenting women. In the border city of Tijuana, Mexico, these women are spending unprecedented durations waiting under unsafe humanitarian conditions to seek safety in the U.S, with rising concerns regarding increases in gender-based violence (GBV) among this population during the COVID-19 pandemic. Given existing gaps in evidence, we aimed to describe the lived experiences of GBV in the context of asylum deterrence policies among pregnant and parenting asylum-seeking women at the Mexico-U.S. border. Methods: Within the community-based Maternal and Infant Health for Refugee & Asylum-Seeking Women (MIHRA) study, we conducted semi-structured qualitative interviews with 30 asylum-seeking women in Tijuana, Mexico between June and December 2022. Eligible women had been pregnant or postpartum since March 2020, were 18-49 years old, and migrated for the purposes of seeking asylum in the U.S. Drawing on conceptualizations of structural and legal violence, we conducted a thematic analysis of participants' experiences of GBV in the context of asylum deterrence policies and COVID-19. Results: Pregnant and parenting asylum-seeking women routinely faced multiple forms of GBV perpetuated by asylum deterrence policies at all stages of migration (pre-migration, in transit, and in Tijuana). Indefinite wait times to cross the border and inadequate/unsafe shelter exacerbated further vulnerability to GBV. Repeated exposure to GBV contributed to poor mental health among women who reported feelings of fear, isolation, despair, shame, and anxiety. The lack of supports and legal recourse related to GBV in Tijuana highlighted the impact of asylum deterrence policies on this ongoing humanitarian crisis. Conclusion: Asylum deterrence policies undermine the health and safety of pregnant and parenting asylum-seeking women at the Mexico-U.S. border. There is an urgent need to end U.S. asylum deterrence policies and to provide respectful, appropriate, and adequately resourced humanitarian supports to pregnant and parenting asylum-seeking women in border cities, to reduce women's risk of GBV and trauma.
Offshoring Migration Control: Guatemalan Transmigrants and the Construction of Mexico as a Buffer Zone

Abstract:Abstract During the late Cold War, the United States and Western European countries offshored migration control to less powerful nations by converting them into buffer zones. Buffer zones had long been used to provide nations with military protection; now they were imagined as protecting nations from migrants by obstructing their movement. This practice had human rights implications. Beginning in the 1970s, the idea flourished that the defense of individual human rights was a transnational mandate that extended beyond the protections granted by particular nation-states. Ironically, the transnational practice of extending migration controls beyond individual nation-states that developed in the 1980s opened the door to increased human rights violations. This essay explores these dynamics by focusing on how, during the 1980s, U.S. officials pressured Mexican authorities to enter into a Faustian bargain that limited Mexico’s sovereign right to determine its immigration practices. U.S. policymakers insisted that they would turn a blind eye to Mexican migration if Mexican officials suppressed Central American migration into and through Mexico. In turn, Mexico’s leaders instituted measures to stop Central Americans from reaching the United States. These measures did not curtail transmigration, but they did lead to widespread violence and human rights abuses.
Immigration Detention in the United States: Identifying Alternatives That Comply With Human Rights and Advance Public Health

Abstract:Under international law, the United States is obligated to uphold noncitizens' fundamental rights, including their rights to health. However, current US immigration laws-and their enforcement-not only fail to fulfill migrants' health rights but actively undermine their realization and worsen the pandemic's spread. Specifically, the US immigration system's reliance on detention, which precludes effective social distancing, increases risks of exposure and infection for detainees, staff, and their broader communities. International agreements clearly state that the prolonged, mandatory, or automatic detention of people solely because of their migration status is a human rights violation on its own. But in the context of COVID-19, the consequences for migrants' right to health are particularly acute. Effective alternatives exist: other countries demonstrate the feasibility of adopting and implementing immigration laws that establish far less restrictive, social services-based approaches to enforcement that respect human rights. To protect public health and realize its global commitments, the United States must shift away from detaining migrants as standard practice and adopt effective, humane alternatives-both amid COVID-19 and permanently.
Biogeopolitics of COVID-19: Asylum-Related Migrants at the European Union Borderlands

Abstract:In biogeopolitics, the key state stakeholders develop and aim to accomplish their geopolitical goals by (mis)management and biopolitical governance of vulnerable population. In this paper, this population refers to asylum-related migrants who use or aim to use an asylum request as their entry mechanism to the European Union. This paper explores the emergence of biogeopolitics at the EU borderland between Turkey and Greece during the COVID-19 pandemic in 2020. Statistics about irregular migration from Turkey to Greece, field observations in Lesvos (Greece) as well as media and social media discussions about COVID-19 in Lesvos are analysed. In the biogeopolitics of COVID-19, the governance and (mis)management of asylum-related migrants include policies and practices to let these migrants to live or die, including regulating illegal border-crossings, everyday living conditions at the reception centres, and actions regarding the pandemic. The COVID-19 pandemic was used as an additional tool to foster biogeopolitics.

Abstract:Abstract People on the move are often left out of conversations around technological development and become guinea pigs for testing new surveillance tools before bringing them to the wider population. These experiments range from big data predictions about population movements in humanitarian crises to automated decision-making in immigration and refugee applications to AI lie detectors at European airports. The Covid-19 pandemic has seen an increase of technological solutions presented as viable ways to stop its spread. Governments’ move toward biosurveillance has increased tracking, automated drones, and other technologies that purport to manage migration. However, refugees and people crossing borders are disproportionately targeted, with far-reaching impacts on various human rights. Drawing on interviews with affected communities in Belgium and Greece in 2020, this chapter explores how technological experiments on refugees are often discriminatory, breach privacy, and endanger lives. Lack of regulation of such technological experimentation and a pre-existing opaque decision-making ecosystem creates a governance gap that leaves room for far-reaching human rights impacts in this time of exception, with private sector interest setting the agenda. Blanket technological solutions do not address the root causes of displacement, forced migration, and economic inequality – all factors exacerbating the vulnerabilities communities on the move face in these pandemic times.

Abstract:Despite proposed increases in spending on personnel and equipment for border enforcement, the complex geography of border militarization and the violence it produces require further examination. We take a geographical perspective to determine the role of violence in both its official forms, such as the incarceration and punishments experienced by undocumented migrants, as well as through abuses and violence perpetrated by agents in shaping border and immigration enforcement. By drawing on the Migrant Border Crossing Study (MBCS), which is a unique data source based on 1,110 surveys of a random sample of deportees, as well as research with family members and return migrants in Puebla, Mexico, we provide an innovative and robust account of the geography of violence and migration. Identifying regional variation allows us to see the priorities and strategic use of violence in certain areas as part of enforcement practice. We assert that understanding the role of violence allows us to explain the prevalence of various forms of abuse, as well as the role of abuse in border enforcement strategies, not as a side effect, but as elemental to the current militarized strategies. Abstract:Anti-immigration policies have been on the rise over the past four decades. The present study explored how anti-immigration policies and rhetoric impacted the psychological and material experiences of Latinx immigrant young adults across legal statuses. Furthermore, the present study examined the ways the COVID-19 pandemic was experienced by Latinx immigrant young adults. We analyzed semi-structured interviews with 30 immigrant young adults (ages 18–25; M = 20.93; SD = 2.03) from Latin America. Results suggested that restrictive immigration policies and the threat of deportation produced stress and interrupted key developmental milestones among Latinx immigrant young adults. Results also show how the vulnerabilities experienced during young adulthood were further compounded by the pandemic. Findings can inform policy and practice aimed at supporting immigrant young adults during the transition to adulthood within the context of heightened anti-immigration policies and the pandemic.

Abstract:US Immigration and Customs Enforcement (ICE) detainers—the requests from ICE to a state or local law enforcement agency to hold someone until the person can be taken into immigration custody—have been instrumental in supporting the growing number of deportations from the United States. However, as migrant detentions expanded after 9/11, law enforcement agencies have been increasingly reluctant to comply with ICE's detainers, due to the cost incurred by detention centers when holding immigrants for an extended period and the possible violation of migrants’ civil rights. Such reluctance has earned these law enforcement agencies the label of “sanctuary cities.” ICE has denounced this behavior, arguing that it interferes with the agency's ability to obtain custody of convicted criminals and makes communities less safe. Using data on detainers at the local law enforcement-agency level, we assess ICE's claims. We find that sanctuary policies do not hinder ICE's ability to obtain custody of convicted criminals and question the argument that such policies might make communities less safe. These findings are relevant for migration scholars and policymakers interested in gaining a better understanding of the public-safety implications of sanctuary policies aimed at immigrants in various receiving nations, including Canada, the UK, and the United States.

Abstract:Among the most visible forms of violence migrants face on their journeys to and toward the United States are the ways in which they must navigate difficult and hazardous spaces along the U.S.-Mexico border. From the infernal and mountainous Sonoran Desert to the erratic Rio Grande, hundreds of migrants perish confronting these dangerous and hostile conditions every year. But while much work has focused on states' use of environmental landscapes in enforcing borders and immigration from afar, such as deserts and open waters, few have considered the importance of urban landscapes. Through this manuscript, I explore the role of "killing cities" in contemporary border and immigration enforcement. As I demonstrate, United States border and immigration enforcement has increasingly relied upon urban landscapes to impede and incapacitate migrants at the fringes of its territory. Drawing from recent policy, I show how migrants were pushed into cities scattered across northern Mexico, where they became vulnerable to disappearances, kidnappings, and death. I argue that the lived effects of this policy worked to control and regulate migrants' mobility as a managed form of violence that was characteristically urban, thereby marking a key shift in the United States' weaponization of landscape.

Abstract:This chapter analyzes the shift in border policy in the United States. The shift evolved with what was framed as the surge of undocumented immigration after 1980, and the securitization of what had been a circulation of workers from Mexico to and from the United States. The perception of failure of immigration policy emerged not from a widespread reaction to a sense of failed integration, as in Europe, but to the increased political focus on the growth of the population of undocumented immigrants. The progressive reinforcement of the border, particularly after 1992, had the perverse effect of providing an incentive for migrants to remain on the US side in larger numbers than ever before. The growth of the undocumented population weighed on the political process in three ways. First, it fed a growing perception of failure of the adequacy of southern border controls. Second, as the issue of the border became politicized, it began to undermine stable understandings of policy within the policy network on immigration. Third, the border became a growing focus for intra- and interpolitical party conflict, and was accelerated by federal dynamics.
Border town authorities and the multilevel politics of the ‘transit migrant’ emergency

Abstract:The article takes the approach of multilevel politics to analyse the way the presence of illegalized 'transit migrants' is dealt with within the urban space of Ventimiglia – a medium-sized city located south of the French–Italian border – by the town government and its mayor after heightened French border controls. It focuses on the period between 2015 and 2019. Within the unneutral and criminalizing framing of 'transit migration', border towns have narrow room for political manoeuvre, and yet they can be seen as the contentious scene of migration policies and politics. Presented and justified as a pragmatic compromise between the migrants' humanitarian needs and the inhabitants' claims for security and decorum, Ventimiglia's municipal policy of encampment was built on cooperation, conflict and contestation with both higher tier authorities and grassroots civil society, thus showing an intricate system of multilevel politics. Followed by widespread discontent which partially translated into electoral disavowal, the town government's actions eventually reinforced the framing of 'transit migration' policies as emergency measures and strengthened the migrants' invisibility and precariousness in the urban space. This ethnography-based case study thus provides greater understanding of the particularities of local and multilevel migration politics in border towns and how these contribute to shape and enhance the exclusionary border regime.
New trends in South-South migration: The economic impact of COVID-19 and immigration enforcement

Abstract:This paper evaluates the impact of the pandemic and enforcement at the US and Mexican borders on the emigration of Guatemalans during 2017–2020. During this period, the number of crossings from Guatemala to Mexico fell approximately by 10%, according to the Survey of Migration to the Southern Border of Mexico. Yet, there was a rise of nearly 30% in the number of emigration crossings of male adults travelling with their children. This new trend was partly driven by the recent reduction in the number of children deported from the US. A one-point decrease in the number of children deported from the US to Guatemalan municipalities resulted in 14 additional crossings from Guatemala to Mexico made by adults, and nearly 0.5 more emigration crossings made by adult males travelling with their children. However, the surge of emigrants travelling with their children was also driven by the acute economic shock that Guatemala experienced during the pandemic. During this period, air pollution in the analysed Guatemalan municipalities fell by 4%, night light per capita fell by 15%, and homicide rates fell by 40%. Unlike in previous years, during the pandemic emigrants were fleeing poverty rather than violence.
