Abstract:The article is devoted to the analysis and generalization of the results of research on the state of combating drug crimes in Ukraine. The causes and conditions of drug addiction in terms of social phenomena in modern society are analyzed. Statistics on the commitment of crimes of drug trafficking are provided. Regarding some ways about improvement the fight against drug crimes are proposed. 23,163 cases of law violations in the field of drug trafficking and circulation of narcotic drugs were recorded in Ukraine during 2019. Among the general crime structure in Ukraine, drug trafficking crimes consistently take second place after crimes against property and has 12-14 % in total. This situation absolutely facilitates by the presence of organized crime in the country. Every year around 400 criminal groups and crime organizations are revealed, most of which are related to the illegal drug business. This fact indicates the group’s interest in the existence of such phenomena as drug addic-tion, to earn huge amount of money. Current situation is due of presence of an extensive network of drug trafficking both abroad and in the country. The reason of that is the fast development of excess profits (annual turnover of drug dollars in the world is over 500 billion US dollars, for Ukraine this number is about 1 billion US dollars). The public danger of drug trafficking is that it causes drug addiction of a huge part of the population of Ukraine, provokes the penetration of drug subculture on potential drug users, penetrates into educational institutions, the environment of gambling and entertainment business, it is related with general crime, contributes to HIV and AIDS. Unfortunately, presented information indicates that drug addiction and related drug businesses are potential threat to the national security of our country. There are not so many years for our country to correct current state, and to take under control the situation with drug trafficking, psychotropic substances, precursors and their analogues.

Abstract:The article notes that the smuggling of narcotic drugs, psychotropic substances, their analogues and precursors is one of the main sources of filling the black market with drugs. Europe has become a priority market for drug manufacturers and suppliers. Ukraine occupies a certain place in their plans. It is located at the crossroads of several international drug transit routes. Therefore, the illegal circulation of narcotics at the regional, national and international levels has reached large scales, and the international criminal activity associated with it poses a threat to the security of the sovereignty of states. Part of transit drugs remains in Ukraine. This, to a certain extent, determines the fact that in recent years in Ukraine there has been a spread of drug addiction and an increase in crime related to it.Therefore, it is no coincidence that the Government has put the problem of effective countermeasures against the spread of drugs and drug-related crime in Ukraine among the most important. A particular threat to the country is illegal activities related to the sale of opium, heroin, cocaine, and synthetic narcotic drugs that illegally cross the territory of Ukraine. The state is actively working to identify and arrest smugglers who try to illegally transport drugs through its territory.The article notes that the considered problem is complex and requires joint efforts of the government, law enforcement agencies, public organizations and the whole society. Implementation of effective strategies and programs aimed at preventing smuggling and reducing the spread of drugs will be an important step towards ensuring the security and well-being of the country.In general, the article highlights the seriousness of the problem of drug smuggling and shows the presence of real threats to Ukraine, calling for active measures to combat the illegal circulation of narcotic substances on the territory of the country.Undoubtedly, the success of the fight against crimes related to drug trafficking, including smuggling, depends on the compliance of the current legislation with modern realities and its effectiveness in judicial practice.

Abstract:The study presents an interdisciplinary study focusing on the critical issue of suicide among young people in two European countries, Ukraine, and Estonia. The research aims to shed light on the multifaceted nature of the problem by exploring the complex interactions within the system of legal relations involving the key stakeholders: doctors, patients, pharmacists, and lawyers. Suicide rates among young individuals have reached alarming levels in Ukraine and Estonia, highlighting the urgency of addressing the problem comprehensively. To investigate this issue, an interdisciplinary approach is adopted, drawing from the fields of medicine, psychology, pharmacy, and law. The first aspect of the study examines the role of healthcare professionals, particularly doctors, in identifying and managing mental health concerns in young patients. The second dimension explores the involvement of pharmacists in dispensing medications, particularly those related to mental health, and the critical role they play in ensuring patient safety. The third perspective delves into the legal framework surrounding mental health care and suicide prevention in both countries. The study analyzes the existing laws and regulations, as well as potential gaps in the legal system that may hinder effective interventions. Additionally, the role of lawyers in advocating for better mental health policies and legislation is examined. By integrating insights from the medical, pharmaceutical, and legal fields, this research aims to provide a comprehensive understanding of the factors contributing to the rise of suicide rates among young people in Ukraine and Estonia. The findings are intended to inform policymakers, healthcare providers, pharmacists, and legal professionals to collaboratively develop effective strategies for suicide prevention and mental health support. In conclusion, this interdisciplinary study underscores the urgency of addressing the issue of suicide among young people in Ukraine and Estonia through an integrated approach.

Abstract:The article is devoted to the study of drug addiction among convicts who have been sentenced without isolation from society, suspended or replaced with something else - without isolation from society, and have also been granted a deferment of serving their sentence or parole. Purpose: to review and evaluate the results of K.V.’Luttseva s dissertation research on the topic “Crime of drug addicts registered with penal inspections: characteristics, determinants, prevention” in the context of the modern development of the drug situation. Research methods: the basis was the dialectical method of understanding drug addiction as a complex socio-legal phenomenon based on current areas of legal regulation and scientific research data. A critical and problematic analysis of K.V.’Luttseva s dissertation was carried out, expressed in the author’s opinion on the problem of criminality of drug addicts registered with penal inspections. Conclusions: it is proved that there are significant features in the content of the study of crime among drug addicts registered with penal inspections, as well as the need for adequate and coordinated prevention. Scientific and practical significance: the article has scientific significance, providing a comprehensive overview of current problems in the context of combating recidivism among drug addicts. The practical significance lies in the study of strategies based on modern theories, which can serve as the basis for improving legislation and practical interaction in the field of countering drug addiction.
THE CURRENT STATE OF MENTAL HEALTH IN THE XXI CENTURY IN THE CONTEXT OF HEALTH CARE REFORM

Abstract:The monograph provides a comparative analysis of the medical and demographic situation in Ukraine in recent years: population, birth and death rates, natural increase (decrease) in citizens, average life expectancy at birth, disability, morbidity. Also, an analysis of the Human Development Index in Ukraine and other countries according to the UN (2018) is carried out. From the investigation of the report of statistical data of the Ministry of Health of Ukraine on the structure of hospitalized patients in hospitals of Ukraine for 2019 adult population among all diseases: the first place has occupied by diseases of the circulatory system – 23.19% (including coronary heart disease – 10.93%, cerebrovascular diseases – 5.95%, angina – 4.02%), second place-diseases of the digestive system – 9.07%, third place belongs to tumors – 8.96%, fourth place respiratory diseases – 8.04%. At the same time, the state of mental health of the population of Ukraine is not insignificant, and according to the statistics of the Ministry of Health of Ukraine in 2019, cerebral and behavioral disorders amounted to 4.54% and diseases of the nervous system – 4.16%. The average length of stay of adult patients in psychiatric institutions is from 33.3 to 48.7 days in Ukraine compared to European countries in Lithuania up to 20.8 days, in the Republic of Poland up to 20.3 days. In Ukraine, the treatment of patients with mental disorders and behavior remained as in Soviet times, the Semashko health care model, the priority of inpatient treatment in the old premises that have been building in the XVIII-XIX centuries, and therefore there is a crisis in the field of mental health and mental health. The reform of mental health facilities in European countries has been completing in 2000, and they have moved to a multidisciplinary model for the treatment of the mentally ill. For people with changes in mental health, new Mental Health Centers have been building, and the old premises of psycho-neurological hospitals have been reconstructing for comfortable stay of patients, creation of "therapeutic, healing environment" for quick marriage, return of patients to society. A comparative description of the provision of medical workers in the field of health care in Ukraine with similar indicators of the EU countries is provided. The study aims to analyze the ways of reform in the EU and Ukraine, to show mistakes in the incomplete health care reform of Ukraine and examples of overcoming the crisis and improving the mental health of the population as in European countries. Ukraine should learn from the experience of other European countries by increasing funding for health care and prevention measures to reduce disease and improve the mental health of the population. One way to overcome the crisis is to have a strong link between the various Ministries of Social Policy, Health to provide timely health care to vulnerable populations and to stratify socio-demographic and lifelong mental health indicators as in the EU. It is possible to strengthen the mental health care system through highly institutionalized services to public/religious organizations that are more person/ patient-oriented.
[THE LEGAL STATUS OF A PSYCHIATRIC EXPERT DURING A FORENSIC PSYCHIATRIC EXPERTISE]

Abstract:The purpose of the article is to determine the feasibility and necessity of the mandatory participation of a psychiatrist in the conduct of a forensic psychiatric examination under the legislation of Ukraine and Georgia. The task is to outline the ways of improving the norms of the criminal law of both countries in the legal and medical spheres based on the analysis of the norms of the Criminal Procedure Code of Ukraine and the Criminal Procedure Code of Georgia. It has been established that the constitutional provision of the right to human health (in particular the researched one) in Ukraine and Georgia is contained not only in the codes and medical legislation of both states, but also in a number of international legal acts that have been ratified by their parliaments. The analysis of the relevant norms carried out in the article revealed the imperfection of concepts and terms, methods and methods of implementing the norms that should reflect the specified right. The authors of the article found that the main problem of realizing the human right to full legal and medical protection in the conduct of forensic psychiatric examination, as well as in the exercise of the rights and duties of an expert psychiatrist, is the lack of a clear procedure for the participation of a doctor in the conduct of judicial and investigative actions. Scientific research has established that the Criminal Procedure Code of Ukraine, the Criminal Procedure Code of Georgia and methodological recommendations regarding the participation of a psychiatrist in carrying out procedural measures to collect evidence in the commission of a crime have common features, wording and requirements. The authors of the article revealed that the requirements of international legal norms and a certain specificity of the situation for conducting a forensic psychiatric examination dictate the need to amend the criminal procedural legislation of Ukraine and Georgia. Changes in the legislation of these countries should be aimed at a clearer formulation of the basic concepts and terms of the doctor's participation in the conduct of judicial and investigative actions. These new norms of the law will act as a guarantee for the realization of the right to health, meet the basic international principles and requirements in the field of health care and law.

Abstract:The article is dedicated to the study of foreign experience of crime prevention of foreigners and stateless persons with the formulation of scientifically based prospects for its implementation in Ukraine. The relevance of the selected issues is explained by the following circumstances: firstly, in the conditions of the ongoing war, a significant part of the population of Ukraine was forced to emigrate abroad and can potentially become either subjects or victims of criminal offenses; secondly, international cooperation in the most dangerous types of criminality is increasing, in particular: smuggling, illegal trafficking of weapons, drugs, human trafficking (including involvement in prostitution), theft of cultural and historical values, etc.; thirdly, the identities of criminals (criminal offenders) – foreigners and stateless persons – have not been fully studied, especially their criminogenic behaviour in the conditions of modern national and world realities. It is emphasized that crime prevention of foreigners and stateless persons in Ukraine is impossible without a study of the positive experience of law enforcement agencies functioning in foreign countries, which assign a priority role in their activities to the prevention of criminal offenses in a certain area. The conducted research on the study of the experience of developed foreign countries in the field of crime prevention of foreigners and stateless persons provides grounds for determining the following forms of its implementation to preventive activities in Ukraine: 1) use of the experience of the USA and European countries in the preparation of conceptual legal acts in the field of crime prevention of foreigners and stateless persons; 2) use by law enforcement structures (in particular, the police) and non-state structures of civil society of positive foreign practices of crime prevention by foreigners and stateless persons; 3) use of opportunities for international cooperation in the field of combating criminality of foreigners and stateless persons, as well as preventing the commission of criminal offenses against these categories of persons who are on the territory of Ukraine. PROTECTION OF HUMAN RIGHTS BY THE CONSTITUTIONAL COURT OF UKRAINE IN THE FIELD OF HEALTH CARE (REVIEW)

Abstract:The article explores the issue of human rights protection in the field of health care by the Constitutional Court of Ukraine. The decisions of the Constitutional Court of Ukraine in the case of K. G. Ustimenko (1997), the case of paid medical services (1998), the case of free medical care (2002), the case of judicial control over the hospitalization of incapacitated persons into psychiatric institute are analyzed (2016), as well as the new legislation of Ukraine in the light of radical reform in the healthcare sector. Attention is drawn to the principle of friendly attitude to international law, constitutional complaint, legal positions of the Constitutional Court of Ukraine in the above-mentioned cases and the prospect of their application into the development of new legislation of Ukraine in the context of radical reform of the health care system of Ukraine. It is emphasized that the legal positions of the Constitutional Court of Ukraine, with regard of peculiarities of the national legislature, can serve as a source of inspiration for the courts of other countries. The purpose of the article is to specify the role and place of the Constitutional Court of Ukraine in the system of judicial protection of human and citizen rights, to determine the prospects of applying the legal positions of the Constitutional Court of Ukraine within the development of new legislation of Ukraine in the light of radical reform of the health care system. The object of the study is the social relations that arise during protection of human rights in the field of health care by the Constitutional Court of Ukraine. The methodological basis of the research are general and special methods of scientific knowledge (formal-logical method, comparative-legal, structural-logical). As a result of the conducted research, the role and place of the Constitutional Court of Ukraine in the system of judicial protection of human and citizen rights, the role of the decisions of the Constitutional Court of Ukraine in the case of K. G. Ustimenko, the case of paid medical services, the case of free medical care, the case of judicial control over hospitalization of incapacitated persons into psychiatric institution in the formation and development of domestic constitutional proceedings are defined. It is emphasized that the introduction of the constitutional complaint concept (institution) contributed to the improvement of the national mechanism of human rights protection in the field of health care. Conflicts of constitutional regulation of the human right to free medical care have been identified, and proposals have been worked out regarding possible ways and methods to eliminate them.

Abstract:Background: This article is prompted by the increasing levels of crime in the sphere of illicit trafficking in narcotic drugs, psychotropic substances, their analogues, or precursors using information and telecommunication systems. The aim of the article is a comprehensive analysis of the problem of the use of electronic evidence in proving crimes of trafficking in these substances. Methods: A number of methods were used in this article, namely: theoretical analysis – the study and analysis of official documentation, scientific, methodological, and educational literature, summarising information to determine the theoretical and methodological foundations of the study; logical analysis – to formulate basic concepts and classification; concrete-historical analysis – to demonstrate the dynamics of development of the use of electronic evidence in criminal proceedings; the dialectical method – to reveal the meaning of concepts of ‘electronic evidence’. The judicial practice of the Supreme Court of Ukraine regarding the recognition of electronic proof as appropriate evidence in cases is disclosed. The definition of electronic proof in the Ukrainian legal system, as well as the forms and features of electronic proof, are also considered. Results and Conclusions: It is established that the main causes of drug trafficking crimes include insufficient legal regulation of cyberspace, the lack of geographical boundaries, the spread of information about drugs on the Internet, especially on the Darknet, and the uncontrolled development of the cryptocurrency market.

Abstract:The subject of the study is the coverage of problematic issues and ways of reforming the criminal procedure legislation of Ukraine in the context of European integration. Methodology. The methodological basis of the study is a dialectical method of scientific knowledge, through the application of this method the legal, functional, organizational and procedural aspects of methodological approaches to the understanding of problematic issues are considered and the ways of reforming the criminal procedure legislation of Ukraine in the context of European integration are considered. The results of the article analyze the current criminal procedure legislation of Ukraine and the legislation of the countries of the European Union. When analyzing the French criminal procedure, two main features can be identified, which distinguish it from the Anglo-Saxon legal system and are criticized by experts from Great Britain and the United States. In France judges are vested with considerable powers. The first feature of French criminal procedure is the institution of preliminary interrogation of the accused by the presiding judge. The judge verifies the sufficiency of the evidence for a conviction. Conclusion. So, based on the above, it is possible to conclude that the Criminal Procedure Code of Ukraine was created in the spirit of democratic values, but some of its norms need to be reformed in order to improve the mechanism of protection of the rights, freedoms and legitimate interests of an individual. The practical experience of France, the Federal Republic of Germany and Great Britain is relevant. The shortcomings of the Criminal Procedure Code of Ukraine are highlighted. The prospects for their reform are outlined and amendments to the current legislation in the context of European integration are proposed. Prospects for further research: a) the study of the experience of individual foreign countries in the context of the improvement of criminal procedural norms; b) analysis of the possibility of harmonization of criminal procedural legislation of Ukraine with the norms of the European Union; c) development of an effective mechanism of relations between the subjects of criminal proceedings. The issue of the relevance and admissibility of evidence is also important. Articles 87-89 of the CPC of Ukraine establish the grounds and procedure for declaring evidence inadmissible. However, judicial practice shows a large number of criminal proceedings against public persons, which the court had to terminate due to the lack of evidence, due to the inadmissibility or improper nature of the evidence. The authors believe that the legislative regulation of the process of collecting evidence in the UK is a positive experience for Ukraine.

Abstract:The article discusses the legalization of medical cannabis in Ukraine. The main draft laws on the regulation of the circulation of hemp plants (Cannabis) for medical, industrial purposes, scientific and scientific and technical activities, the state of their consideration and the main conclusions of the specialized committees of the Verkhovna Rada were analyzed. It has been established that the process of legalizing medical cannabis involves a special mechanism of organizational and legal regulation of activities related to the cultivation of cannabis for medical purposes, transportation, processing of plants and extracts of cannabis, the manufacture of appropriate medical devices using them as raw materials, as well as the conduct of scientific research. Such a mechanism establishes the procedure for obtaining permits, restrictions and rules for cultivation, transportation, processing, production and sale in terms of organizational, administrative and legal aspects. The article notes that the current regulations do not cover social relations in the field of the production of medicinal products based on cultivated medical cannabis, and such activity itself may be associated with a corruption component in terms of permit procedures, the activities of control and inspection bodies and institutions, dishonesty of private laboratories, etc. It is proposed to conclude that the process of regulating sowing, cultivation, production of medical cannabis, etc. is in the realm of civil, economic, and administrative procedures, but ensuring legality and compliance with the rules and mechanisms established by these industries requires the participation of criminal-legal means. Such measures include the establishment of new and revisions of existing criminal prohibitions in order to ensure the criminal protection of social relations that may occur in connection with the legalization of medical cannabis. Abstract:The article is dedicated to the consideration of factors influencing the state of the situation in Russia in the field of detection and repression of the smuggling of narcotic drugs, psychotropic substances, their precursors, and analogues. In the methodological field it is an analytical research based on documentary, close to legal hermeneutics. Specifically, thearticle analyses Russian legislation, offers options to solve problems in the field of smuggling narcotic drugs, psychotropic substances, their precursors, and analogues. The authors consider the real problems of countering the drug threat, which is currently a serious obstacle to the development of the state. By way of concluding the nature and magnitude of the negative consequences, illicit trafficking in narcotic drugs, psychotropic substances, their precursors, and analogues can be classified as direct threats to national security. Today, the issues of countering the illegal circulation of narcotic drugs, using modern information technologies, improving mechanisms to convert goods obtained from illicit drug trafficking into state revenue are relevant.

Abstract:The article is a criminological study of the phenomenon of interaction between the police, the prosecutor’s office and the State Border Guard Service of Ukraine in countering organized criminal offenses related to smuggling, illegal trafficking of weapons and drugs, terrorism and illegal crossing of the state border of Ukraine. Based on the results of the research, the social danger of these phenomena in the conditions of war was characterized and outlined, the persons who commit them were highlighted, war was identified as the main factor of changes in the quantitative and qualitative parameters of crime. In the work, the distribution of measures for the prevention of organized criminal offenses related to smuggling, illegal trafficking of weapons and drugs, terrorism and illegal crossing of the state border of Ukraine and strategies for reducing opportunities for committing crimes was carried out. The study highlights the main directions and means of interaction between the police, the prosecutor’s office and the State Border Guard Service of Ukraine in combating offenses related to organized criminal offenses, related to smuggling, illegal trafficking of weapons and drugs, terrorism and illegal crossing of the state border of Ukraine. According to the results of the study, it is emphasized that the interaction between police units with the bodies of the State Border Service of Ukraine and the prosecutor’s office during the detection and termination of organized criminal offenses related to smuggling, illegal trafficking of weapons and drugs, terrorism and illegal crossing of the state border of Ukraine. The crime reduction strategy should be based on the application of a combination of public and non-public countermeasures; have a large-scale, complex, well-planned and organized character, aimed at reducing the level of these types of crime as a prerequisite for the existence of other antisocial manifestations.
Trends in Injection Risk Behaviors among People Who Inject Drugs and the Impact of Harm Reduction Programs in Ukraine, 2007-2013

Abstract:The study examined trends in injection risk behaviors among people who inject drugs (PWIDs) and assessed the impact of harm reduction programs in Ukraine during 2007-2013. We performed a secondary analysis of the data collected in serial cross-sectional bio-behavioral surveillance surveys administered with PWIDs in Ukraine in 2007, 2008, 2011, and 2013. Using data from 14 Ukrainian cities, we assessed short-term trends in injection risk behaviors with the Cochran-Armitage test for trend and multivariable logistic regression models, adjusted for age, sex, region, marital status, education level, occupation, age at injection drug use initiation, experience of overdose, and self-reported HIV status. The overall test for trend indicated a statistically significant decrease over time for sharing needle/syringe during the last injection (p < 0.0001), sharing needle/syringe at least once in the last 30 days (p < 0.0001), and using a common container for drug preparation (p < 0.0001). The prevalence of injecting drugs from pre-loaded syringes was high (61.0%) and did not change over the study period. After adjusting for all significant confounders and comparing to 2007, the prevalence of sharing needle/syringe during the last injection was unchanged in 2008 (OR = 1.06, 95% CI = 0.92, 1.21), and declined in 2011 (OR = 0.18, 95% CI = 0.15, 0.22) and 2013 (OR = 0.17, 95% CI = 0.14, 0.21). Sharing needles/syringes in the last 30 days significantly decreased when compared to that in 2007 (2008: OR = 0.81, 95% CI = 0.74, 0.89; 2011: OR = 0.43, 95% CI = 0.38, 0.47; and 2013: OR = 0.31, 95% CI = 0.27, 0.35). The prevalence of using common instruments for drug preparation also decreased compared to that in 2007 (2008: OR = 0.88, 95% CI = 0.85, 0.91; 2011: OR = 0.85, 95% CI = 0.85, 0.90; and 2013: OR = 0.74, 95% CI = 0.71, 0.76). The observed reduction in the prevalence of injection risk behavior over time is encouraging. Our findings suggest that prevention programs in Ukraine have positive impact and provide support for governmental expansion of these programs.
Perspectives on formation of medical cannabis market in Ukraine based on holistic approach

Abstract:Background: Nowadays, medical cannabis still remains inaccesible for patients in the former Union of Soviet Socialist Republics (USSR). Even registered medicinal products based on herbal or synthetic cannabinoids, like Sativex, are practically unavailable due to their high cost and narrow scope of application (for example, in Lithuania). However, before the absolute prohibition of medical cannabis in the USSR, in line with Single Convention of 1961, the State Pharmacopoeia of the USSR (eighth edition) published monographs on such medicinal products as "Herba Cannabis indicae", "Extractum Cannabis indicae spissum" and "Fructus Cannabis", which could be prescribed by physicians with precaution. Objectives: Formation of a holistic approach aimed at the creation of appropriate conditions for the development of medical cannabis market and the improvement of life quality and health of Ukrainian patients. Methods: We analyzed legislation and regulation mechanisms for medical cannabis in the USSR, and the present availability of these products for patients in the former USSR, such as Lithuania, Georgia, Estonia, Russian Federation, and Ukraine. Four hundred thirty-five Ukrainian pharmacy students participated in the quantitative analysis (a survey) that took place on April-May, 2019 at Bogomolets National Medical University (Kyiv, Ukraine). They were surveyed about legalization of medical cannabis in Ukraine, advisability of including cannabis and cannabinoids related data into educational programs, and other issues. Qualitative analysis we applied consisted of the stakeholder analysis and Strength, Weakness, Opportunity, and Threat (SWOT) analysis. We classified the key stakeholders into the patients, healthcare professionals, legislative and regulatory bodies, pharmaceutical companies, pharmacies, etc., and ranked them based on their power and interest in the development of potential medical cannabis market in Ukraine. We also identified their expectations and goals. SWOT analysis allows us to evaluate predictable risks and opportunities, as well as strong and weak aspects of the effective development of medical cannabis industry in Ukraine. Results: According to the survey among pharmacy students, about 80% support the legalization of cannabis for medical purposes. However, two-thirds of them think that there is a risk of illicit turnover. Nearly half of the respondents are not informed or poorly informed about cannabis therapeutic properties. At the same time, nearly 90% consider that materials on medicinal properties of cannabis and cannabinoids should be included in the training program. Nowadays, such stakeholders as legislative and regulatory bodies have the highest power over the development of potential medical cannabis market in Ukraine: more than two million Ukrainian patients still cannot access an effective cannabinoids based treatment. There are over 20 thousand children among them suffering from drug-resistant epilepsy due to the lack of adequate legislation. Moreover, a lot of stakeholders with high level of interest, such as growers, manufacturers of cannabidiol (CBD) products, pharmaceutical companies, pharmacies, higher education institutions, even scientists and healthcare professionals are still waiting for the legalization of cannabis for medical and scientific purposes in Ukraine. SWOT analysis shows that present business structures, educational and scientific institutions, regulatory bodies, and the competency of domestic specialists are strong enough to develop a new market of cannabis-based medicinal products in Ukraine. However, a long-term ban on medical cannabis requires more time for creating the entire ecosystem. This market can be quite attractive in Ukraine. It is characterized by high growth rates, low entry barriers and a substantial demand. Yet, its advancement depends significantly on the appropriate regulatory framework, high level of awareness among health professionals and society as a whole, and involvement in scientific study to become a part of the global medical cannabis market. Discussion: The holistic approach is aimed to improve health and life quality of Ukrainian patients through cannabis-based medicinal products. It consists of three components: changes in legislation and regulation procedures; changes to value orientations in society; observance of stakeholders' interests and purposes. Specific recommendations are worked out to realize this approach in Ukraine.

Abstract:The article explores the issue of driving drunk drivers to criminal liability and the prospects for its development. Increasing the responsibility for drunk driving by transferring it to the criminal plane is logical, but does not have a mechanism for proceedings in cases of administrative offenses. Article 266 of the Code of Administrative Offenses and the Instructions defines the procedure for examining the state of intoxication at the stop of a vehicle and in a medical institution, i.e. to criminalize the relevant article in our opinion it is necessary to develop a new Instruction. The ability to prosecute perpetrators. Further, with regard to the new version of Article 130 of the operation of vessels in a state of intoxication, drugs or other intoxication, it is necessary to consider this issue in more detail, because on water the risk of driving in a state of intoxication is also too great, so we believe that it is necessary to criminalize this article in a complex. Abstract:In modern society, digitalization and technology play a key role in the fight against crimes related to drug addiction. This study examines various aspects of the use of digital technologies to combat prescription drug abuse and drug trafficking. The introduction of electronic prescriptions, centralized systems for monitoring drug sales and digital patient databases makes it possible to effectively monitor and control the process of prescribing and receiving drugs. The use of artificial intelligence and big data analytics helps identify patterns associated with drug addiction and early detection of abnormal activities. Online platforms for public information and education, as well as mobile applications for self-control and support, have a significant impact on preventing the development of addiction. As a result, digital technologies provide significant support in the fight against pharmacy addiction by increasing transparency, accountability and safety in the pharmaceutical field.
Tendencies for the falsification of medicinal products in ukraine: general analysis and areas of counteraction

Abstract:Objective: Introduction: Ukrainian counterfeit pharmaceutical market affects pharmaceutical manufacturers' image and threatens citizens' lives and health. The aim:of the article is to identify and systematize the causes and methods of pharmacy drugs' falsification, grounding the need for certain areas of counteraction. Patients and methods: Materials and methods: Empirical base includes Ukrainian legislation, international acts, statistical data of the WHO, State Register of Medicinal Products of Ukraine, General Prosecutor's Office of Ukraine, Unified State Register of Court Decisions, media materials, journalistic investigations. Methodological basis is a set of general and special research methods of scientific cognition. Conclusion: Conclusions: Expired drugs' repackaging; production in non-licensed enterprises; replacement of drugs by non-pharmacological substances, etc. were established as the most common methods of falsifying pharmacy drugs in Ukraine. The authors systematized the reasons for uncontrolled production's growth, established distribution channels for pharmacy drugs in Ukraine and offered the most effective ways for counteracting drug falsification.
