Abstract:In recent years, due to a number of notorious sex offense cases against minors, a new punitive public attitude emerged in China and pressed for harsher crackdown and punishment against sex offenders. In particular, an "engagement in prostitution with a minor" law (Article 360 of the Criminal Law) was targeted as "unjust" based on the belief that offenders of such crimes often received "lenient" punishment, and many called for its abolition. In this study, based on 440 adjudicated sex offense cases, we examine potential differences across three sex offenses (including rape, child molestation, and engagement in prostitution with a minor) in the demographics of defendants and victims, offending characteristics, and trials and sentences of convicted offenders. Our empirical inquiry pointed to the unique nature of engagement in prostitution with a minor. Offenders of such crimes seemingly carried a different profile, compared with offenders of the other two sex crimes. Moreover, our data casted some doubt on the "lenient" punishment received by offenders of engagement in prostitution with a minor. Policy implications were also drawn based on our findings.

Abstract:Efforts to classify sexual offending and offenders continued to evolve over the years based on criteria such as offender and victim characteristics, offender-victim relationships, the nature of sexual offenses, and other situational factors. This current study draws up a typology of sexual offending against minors based on 436 adjudicated rape and child molestation cases in China. Specifically, sexual offending against minors is classified into six major categories, including opportunistic offenses, serial offenses, dating couple offenses, educator abuses, gang/party offenses, and incest offenses. Based on this empirical typology, a number of crime prevention measures are suggested. These suggestions aim at involving multiple players and institutions to focus on education, target hardening, and crime investigation. This study makes a significant contribution to comparative studies in this field, and the results could be potentially applied in other cultures.

Abstract:Human trafficking is a harmful, widespread and pressing issue that demands attention. However, the prevalence of such crimes may vary across different countries and time periods, which means that there may not be a universal solution to addressing them. In response to the recent public outcry sparked by the incident of the woman chained in Feng County, Xuzhou, this article provides a comprehensive review of China's legislative and judicial responses to crimes against women and children who are abducted and sold, as well as the corresponding governance effects and causes. This study examines whether the punishment for buying and trafficking women and children should be increased through criminal law amendments and whether the current public outrage calling for equal punishment for buyers and sellers is justified. To provide a rational response to these issues, the article reviews all relevant laws, regulations, judicial cases, and typical cases from 1979 to 2022. An analysis of the change in case processing over the years was conducted using MATLAB software with the baseline panel regression model, robustness checks, and mechanism tests. This study reveals a decline on human trafficking crimes in China, but four provinces (Yunnan, Henan, Shandong, and Fujian) have a higher incidence. The article offers a comprehensive analysis from both macro and micro perspectives. National macro factors such as economic development, social welfare policies, rural revitalization, and COVID-19 prevention contribute to the decline. From a micro perspective, local differences in these provinces are a significant reason for high incidence from a micro perspective. This article suggests that legal amendments to increase punishment would be ineffective. Instead, existing legal provisions should be applied, and decision-making rules from typical cases should be utilized.

Abstract:In recent years, exposés on the trafficking of women have caught the public's attention in China. However, due to data scarcity, the scope and nature of such criminal activity are not well understood. The authors of this study provide a new angle in the analysis of human trafficking by digitizing and analyzing court sentencing documents on trafficking in China during 2014–2015.Through mapping court data to geographic information and performing network analysis, the study presented a comprehensive picture of intra-provincial, inter-provincial, and international trafficking patterns. The data showed that international trafficking has become the largest category in the trafficking of women, and victims were typically young women in their 20s originating from Vietnam, Myanmar, and North Korea who were sold into central provinces. Domestically, inter-provincial trafficking outnumbers intra-provincial cases. Across provincial borders, women were trafficked from southwest to central provinces. Intra-provincial trafficking was concentrated in four provinces: Henan, Anhui, Shandong, and Hebei.

Abstract:Gradual enhancement of the law system and modernization do not prevent human trafficking crime away from Chinese people’s lives. The considerably large buyer's market due to the imbalance of economic and cultural development, the difficulty of cross-regional criminal investigation, and the deficiencies of legislation related to human trafficking incentivize criminals to take risks for economic benefits. When discussing the ways to “activate” each link on the chain of the social system that eventually results in crimes, the role of social organizations, especially the Women’s Federation is often neglected. This paper will first focus on the empowerment of social organizations in the process of settling down victims and offering mental therapy and re-employment training. This part will also examine the challenges of empowerment and the potential solutions. The Women's Federation is at the front line of contact with women victims of abduction and has abundant information at its disposal; therefore, legal improvement and aid assistance are also what social organizations can provide. Then the paper will emphasize the approaches for social organizations to utilize their resources and connections to assist local governments, law institutions, and police officers in facilitating the work of preventing human trafficking. After investigating the specific functions social organizations can execute after rescuing the victims, the paper will highlight how they play a role in preventing crimes from taking place by educating the most vulnerable group of people. A combination of precaution and remediation measures is necessary and complementary in keeping people safe from human trafficking.

Abstract:Child trafficking remains a serious public concern in China, which is related to several forms of exploitation on children as well as threatens public security and endangers the stability of the country. This paper used the latest judgment documents from the court as a new data source, and identified the key nodes and trafficking paths by using a series of network indicators to enhance the public’s understanding of the crime mechanism of child trafficking. By contrast with the results of the previous literature, some new trends of child trafficking crime in China were discovered: (i) Child trafficking is developing towards the direction of trans-provincial and trans-regional crime. (ii) There is a growing tendency for the trafficked children to migrate from the southwest to the east coastal area. (iii) Non-capital cities were playing an increasingly important role in the national trafficking network. Moreover, the obvious gender difference of child trafficking was observed: (i) Buyers from South China show a clear preference for boys, while buyers from Hebei, Henan and Zhejiang tend to buy girls rather than boys. (ii) Boys have a higher probability to be trafficked within-province rather than girls. Based on these findings, the possible causes of these phenomena were discussed; and corresponding countermeasures were proposed to help the government further combat child trafficking crime for illegal adoption more effectively. Verification of these findings and further study on this problem can be launched based on more actual trafficking cases in the future.

Abstract:Child pornography poses significant risks to children's well-being and safety, with the proliferation of digital platforms exacerbating its accessibility and prevalence. This paper conducts a comparative analysis of child pornography laws in the United States and China, highlighting key differences in definitions, enforcement measures, and protection of children's rights. While the US legal system has made strides in addressing child pornography through stringent penalties and protective measures, China's legal framework exhibits deficiencies, relying on outdated regulations and lacking specific provisions for combating this crime effectively. Recommendations for revising Chinese criminal law include clarifying the concept of child pornography, strengthening legal protections for children's rights, expanding regulations to cover possession and virtual child pornography, and enhancing victim protection measures in criminal proceedings. Aligning with international standards and enhancing enforcement mechanisms can improve China's ability to combat child pornography, safeguard children's rights, and create a safer online environment. Adapting legal frameworks to address evolving digital threats is crucial in ensuring the protection and well-being of vulnerable individuals, particularly children, in today's digital age.

Abstract:Women being sold or forced into marriage is nothing new in China; however, forced marriage involving foreign women is a recent development. Enterprising agents in the gray market of matchmaking businesses in China are increasingly networking and coordinating with partners over vast distances in luring and entrapping unsuspecting women into their profitable efforts. Using the data extracted from official sources in the Chinese judicial system, we analyzed a total of 189 convicted cases of forced marriages involving 536 Vietnamese women who were trafficked into China, spanning a period of over 5 years (January 2014 through April 2019). We found people of diverse backgrounds participating in the trafficking business, most were of low education and unemployed or underemployed. Little formal organizational structures appeared to be needed in these trafficking activities. The vast majority of traffickers were Chinese nationals, who were well connected with the cross-border trade as well as traditional matchmaking business. Most trafficking occurred under the guise of employment opportunities, in which Vietnamese women were offered jobs in interior China. Implications for policy and future research are also discussed.

Abstract:From the perspective of legal doctrine, whether the perpetrator constitutes this crime should be judged strictly from the legal right protected by this crime. The sexual assault by person with care duties protects the right to sexual autonomy and the right to physical health of minor females aged 14 to 16 under care, rather than simply assuming that a person with care responsibilities constitutes this crime as long as he has sexual relations with a female under care. "Sexual relations" is an inherent expression of Chinese law, the scope of which must be determined not only according to the law but also according to the level of social development. In addition, the act of indecent assault should also be included in the scope of sexual relations. This crime is a pure identity offense, in which the perpetrator must formally have special care duties and substantially use the advantageous position arising from the special duties to have sexual relations with a minor female between the ages of 14 and 16. In the situation that the perpetrator is mistaken, the victim's age and the will of the perpetrator must be accurately determined in order to properly convict and punish.

Abstract:Violence Against Women, Ahead of Print. This study contributes to the marriage trafficking literature by highlighting its demand, unique forms of exploitation, and conducive context through a qualitative study in China–Vietnam border areas. The findings indicate: (a) local demand for marriage constitutes a premise for the emergence and development of a marriage trafficking market, (b) three forms of exploitation distinguish marriage trafficking from other trafficking forms; (c) the local contexts conducive to the formation and facilitation of marriage trafficking also impede trafficked women's agency. In-depth interviews were conducted with marriage trafficked women who have not exited the trafficking situations, and with key local social network actors in the trafficking areas.

Abstract:China has made remarkable progress in preventing and intervening in domestic violence against women. Scholars have reported on this development. Methodologically, this paper, which draws on 3362 references selected from the China National Knowledge Infrastructure, uses the bibliometric method to summarize the characteristics, evolution, and frontiers of key topics into research on abused women in China between 1993 and 2020. The paper has three key findings. (1) The volume of literature has grown continuously, but in three stages: initial, rapid growth, and peak fluctuation; (2) the topic has five research hotspots: fundamental issues in domestic violence against women; new legislation, notably the 2015 Anti-Domestic Violence Law; social support for abused women; matrimonial disputes involving abused women; and conviction and sentencing of abused women who kill their husbands; and (3) the current research frontiers lie within the defects of the Anti-Domestic Violence Law and challenges in the implementation of the law. In addition, the paper examines characteristics and limitations of the study on abused women in China and suggests changes in practice, policy, and directions for future research.

Abstract:In many parts of Asia, critics have noted the common but hitherto under-researched practices of detaining victims of human trafficking in semi-carceral institutions or ‘shelters’, in the name of victim protection and rescue. Although the formal justification for immigration detention and ‘protective custody’ may be different, there are clear parallels between the experience of trafficking victims in semi-carceral institutions and what Kalhan has termed ‘a quasi-punitive system of immcarceration’. This article seeks to add to the critical work on the changing nature and harms of immigration control by exploring the logic and practices of protective custody in Asia. How can we make sense of the regulatory purposes performed by semi-carceral institutions for trafficking victims? What do we know about women and girls’ experiences of protective custody in South and South-East Asia? In what ways does the dominant anti-sex trafficking discourse of ‘protection’ and ‘rescue’ intersect with gendered notions of belonging and citizenship? And, ultimately, what can a study of gendered carceral practices tell us about the problems and paradoxes of trafficking control?

Abstract:Human rights are universal and should be protected by the rule of law. However, if social governance excessively relies on criminal law, it is likely to lead to great risks to the rule of law. When solving structural human rights issues such as the abduction and rescue of patients with mental disorders, it is especially prone to problems such as the simplification of governance initiatives and the neglect of the real demands of subjects. The online field investigation of the Xuzhou chained woman incident shows that public opinion and governance actions of the state were focused on the governance of trafficking crimes, while the core issue of rights protection for women with mental disorders has been ignored, reflecting the dependence of social governance and human rights protection on the path of criminal law in China. In order to fully realize the equal protection of human rights, it is necessary to properly learn from the qualitative research methods in the field of sociology, enter the concrete life situation of the parties, fully respect the subjectivity of “the protected”, hearing their voices, and letting them to participate (indirectly) in the construction process of law and policy as the subject.

Abstract:Youth represent the future of the nation and are the beacon of hope for people. Their actions significantly impact the country's trajectory and destiny. Juvenile delinquency has always been a focal point of societal concern. In recent years, incidents of juvenile crime have proliferated, affecting not only the development of the youth but also the progress of the nation. This study aims to compare juvenile crime protection policies between China and the United States. Through this comparison, areas where China can draw references and insights to fill the gaps in its juvenile crime protection legal framework are identified. China proposes effective measures to foster holistic development of youth, enhance the government's comprehensive governance capacity, and effectively drive societal progress and development. This research employs analogy analysis and mixed scanning theory to study the laws and policies of China and the United States. Results indicate differences between the two countries in aspects such as the establishment of juvenile courts, educational guidance, and online privacy. China can strengthen the construction of juvenile courts in underdeveloped regions, intensify community education and guidance efforts, and focus on protecting the online privacy rights of adolescents.
Analysis of geographical migration networks of bride trafficking crime from 2000 to 2018 in China

Abstract:The objective of this article was to analyze the spatial patterns of bride trafficking crime in China. Based on the origin-destination (OD) information of 2273 cases, three levels (provincial-level, city-level, and district/county-level) of bride trafficking networks were constructed. By using social network analysis, the geographical migration mechanism of bride trafficking on different scales was revealed: (i) Bride trafficking showed a macroscopic pattern from the border areas to the inland areas, especially for the 'foreign brides'. (ii) Short-distance migration was more likely to occur for the brides with mental illnesses rather the healthy ones. (iii) A small number of core cities controlled a large share of trafficking crime. (iv) The distribution of bride trafficking hotspots was related to traffic conditions and poverty to some extent. Based on these findings, targeted strategies for different types of bride trafficking crime were proposed. The analytical methods used in this study could be applied to other crimes like drug trafficking and cargo smuggling. (C) 2020 Elsevier B.V. All rights reserved.

Abstract:In recent years, China has endeavored to implement individualized sentencing for cases of intimate partner homicide (IPH), using both legal and extralegal factors, to protect potential female victims and female defendants. This study examines the factors influencing the sentencing of IPH, utilizing a sample comprising 921 cases from 2016 to 2021 on the China Judgments Online website. The results show that: (1) the legal factor "victim's fault" is the main reason for the leniency of sentencing for female defendants compared to male defendants; and (2) intimate partner relationships between defendants and victims can have a protective effect on sentencing.

Abstract:Sentencing Proposal is the integral part of the right of public prosecution and should be included in the meanings of the right.It is one of the rights of judicial claim,but it does not have any substantial legal effect and will not invade the jurisdiction.In most countries and regions,Sentencing Proposal is adopted in practice.Sentencing Proposal will help to protect the justice on sentencing,to save judicial resources and to improve the efficiency of the proceedings.It is a pity that Chinese Criminal Procedure Law does not provide for the System of Sentencing Proposal.The system has the corresponding theoretical basis,legal basis and foundation of policy in China.To amend the code of Criminal Procedure Law,we should draw on the experience of other countries and regions' legislation,only in this way can we establish the System of Sentencing Proposal in China scientifically.
A Quantitative Analysis on the Sentencing Disparity in Online Romance Scam Cases in United States: A Focal Concern Theory Perspective

Abstract:Crime &Delinquency, Ahead of Print. An online romance scam occurs when a criminal creates a fake online identity to manipulate a victim into developing affection and trust before financially exploiting them. It has resulted in billions of dollars in losses globally, impacting victims financially emotionally. Based on focal concern theory, this study is the first to examine the fairness of sentencing for this group of scammers in the United States. The study quantitatively analyzes 148 sentencing cases, which is the current most comprehensive dataset available, obtained from Pacer Monitor. The findings indicate that sentencing outcomes for scammers in the United States are primarily influenced by legal considerations. A comparison with similar studies conducted in China shows a consistent overall conclusion, although there are slight differences in the specific legal factors that have an impact. This study contributes to academic literature by addressing a notable gap in research within Western countries. The application of focal concern theory provides additional contextual insights, enriching the current understanding of this complex issue. Recommendations include prioritizing international collaborations, conducting detailed assessments of victim numbers and defrauded amounts, and proposing specialized laws to address the complexities of online romance scams.

Abstract:Various places in cities are essential carriers of crime, and changes in environmental design strategies can effectively suppress the occurrence of crime to a certain extent. This study focuses on child trafficking in China. It reveals the invisible corner in the city from the perspective of environmental criminology, in which areas of children's activities are not accessible to be monitored by guardians or the public. The results show that the functional characteristics of facilities lead to some places becoming attractive places for child trafficking. The small spatial size reduces the guardians' awareness of monitoring children's activities, while the layout of facilities (such as cars, shelves, landscape, etc.) intensifies the complexity of the space, making it difficult for guardians and the public to monitor them in terms of physical factors. The mental blind area and the monitoring blind area together intensify the formation of spatial blind areas, and are used by criminals. The novelty of this study lies in the use of network video surveillance data to restore the crime process and crime method based on the crime script theory, and analyze the impact of facility function, spatial form and facility layout on the spatial monitoring and user perception of child trafficking.
