Abstract:The United Nations Convention on Contracts for the International Sale of Goods (CISG), on which this book is a commentary, has now gained worldwide acceptance. Since its entry into force on 1 January 1988, the number of Contracting States has risen to 94. Most notably, the Convention entered into force in Portugal in 2021. As of today, more than 80 per cent of the world’s trade in goods is therefore (potentially) governed by the Convention. Efforts to unify the law on the international sale of goods, which began in the 1920s, have thus succeeded to an extent far beyond the expectations of those involved. The year 2020 marked the 40th anniversary of the CISG. Further States are considering their accession to the Convention and significantly more international case law applying the CISG has become available since 2016. This makes a new edition of the Commentary necessary and timely. This edition has been thoroughly updated with new international case law and legal writings. In addition, three new chapters have been added that are dedicated to pertinent topics that each touch upon various CISG articles, including data-related transactions, FOB and CIF contracts under the CISG. Since the publication of the first edition in 1998, the book has become an invaluable source for the comprehension and discussion of the Convention. It provides expert analysis, and combines judicial and scholarly views from numerous jurisdictions. This is the most comprehensive and authoritative commentary on the CISG, and an invaluable resource for scholars and practitioners alike.
