Unveiling Human Rights Protection in China from the Perspective of Criminal Procedure Law

Abstract:Abstract A significant portion of the misunderstanding surrounding China’s human rights protection stems from a failure to consider its legal progress in light of China’s unique cultural, ideological, and political contexts. The Criminal Procedure Law of China is closely linked to constitutional principles and the fundamental first generation of human rights, providing a clear framework for understanding China’s efforts in human rights protection. As widely accepted standards for human rights codification, Articles 9, 17, and 14 of the International Covenant on Civil and Political Rights (ICCPR) outline the right to personal liberty, privacy, and the defense of the accused. Initially, China’s Criminal Procedure Law of 1979 fell short of meeting these global standards. However, with substantial revisions in 1996, 2012, and 2018, this specific code has progressively aligned with the covenant’s requirements, marking significant strides in human rights protection in China. Despite these advances, there remains room for improving the Criminal Procedure Law, especially under the challenges of the digital age. China, alongside other nations, will focus on building a more comprehensive, robust, and globally integrated legal framework to address the forthcoming issues.

Abstract:In 2015, Sri Lanka underwent a major political change, with the opening of a window of opportunity for both constitutional reform and Transitional Justice (TJ). However, TJ and constitutional reform were routinely presented in mainstream political discourses as two agendas in tension competing for political capital. Furthermore, TJ was perceived as controversial and, for this reason, was isolated conceptually and procedurally from other reform agendas. This reinforced the perception that TJ was a measure benefiting solely minority communities and imposed by foreign powers. This misperception, in turn, fuelled continued opposition to this agenda. After recalling the important links between TJ and the rule of law, I argue that a well-designed communication strategy around TJ should have harnessed the pre-2015 momentum for good governance and rule of law reforms in order to foster greater support for TJ.

Abstract:Transgender is an Umbrella term to define the people whose gender identity and gender expression differ from their gender assign at birth. At present, the concept of transgender has acquired a great attention in the western world and the number of territories legally validate the transgender community and their rights through national legislations. Concerning South Asian context, the third gender concept is recognized by the Indian Supreme Court but unfortunately, the legal system of Sri Lanka is reluctant to amend the laws to ameliorate the position of the transgender community. This research mainly focused on transgender identity and the laws relating to the transgender community in Sri Lanka and India. The purpose of the research is to examine the existing laws relating to transgender identity in both countries. Moreover, this piece of work tries to identify the contribution of law in improving the position of the transgender community in these territories. Further, this work mainly used the comparative research method and based on internet retrieved documents. Through this work it suggests and identifies the ways and means to improve the condition of Sri Lankan transgender community. Recommendations will be made in this respect. Abstract:The necessity of providing required and necessary protection for the victims of crime is a matter of concerns in Sri Lanka today. Since 1995, several penal law amendments have been introduced to the legal system to strengthen the law relating rape and provide the justice- including protection- to rape victims. In 2015, the Assistance to and Protection of Victims of Crime and Witnesses Act No 4 of 2015 (APVCW) enacted with the purpose of ensuring the protection, providing assistance and support to the victims of crime. Even in such scenario, the victims of rape are (re) victimized in the hands of the officials of agencies of the criminal justice system in the country today. Therefore, this study intends to overview the existing substantive law relating to rape and the relevant procedural laws in that regard in order to critically evaluate the dilemmas in those laws which cause rape victims to be re-victimized in the criminal justice process. The paper is mainly based on secondary resources including, domestic penal statutes, international instruments, books, journal articles, web documents, decided cases etc. A brief statistical anlaysis of the offense of rape and observations and opinion of author based on personal interviews conducted with the officials of the criminal justice system in Sri Lanka and rape victims are also included to achieve the objectives of the study.

Abstract:Global developments attempt to rectify serious human rights breaches within the context of legal regulations, as well as to build human rights systems and institutions on a national and global scale. However, in Indonesia, the paradigm shift from authoritarianism to democracy leads human rights as one of most important issues faced by the Indonesia government. In the last two decades, the red record in resolving major human rights abuses has not been attained, necessitating a study to evaluate effective legal choices in settlement of the past human rights violations settlement. This paper employed a statutory method, legal concepts, legal cases, and citations. The comparison validates the direction of this paper's research on the dynamics of national legal concerns in the policy of resolving gross human rights abuses and the selection of law that may be employed in effectively resolving major human rights violations in favor of transitional justice. The obtained results and findings show that problems have emerged in policy orientation at the macro, mezzo, and micro policy strata, as well as the need for future direction in the substance of legislation and the enforcement system, both through judicial and extrajudicial channels, against serious human rights violations.

Abstract:The Sri Lankan law only permits induced or iatrogenic abortion to save the life of the mother. Despite the restricted law, law enforcement mechanisms, and reported high national contraceptive prevalence rate, a significant proportion of pregnant women terminate their pregnancy outside the law. Despite the existence of restrictions and inertia, numerous stakeholders concerned about women’s health have made several attempts to liberalize the abortion law in Sri Lanka. Although several amendments were proposed to rationalize the abortion law in Sri Lanka, nothing has been successful – we are back to square one. Expansion of legal exceptions for induced abortions and improved safe abortion with the revolutionized medical abortion (MA) were observed in numerous countries globally during the past decade. On the other hand, some countries with broadly liberal laws, including the United States, have added restrictions. How these global changes have affected countries like Sri Lanka is worth studying. This article assesses the response of the Sri Lankan government and the society towards those global changes in terms of the policies and practices on induced abortion. Authors argue that the paradigm shift in abortion practices in Sri Lanka, driven by the emerging occurrence of medical abortion, has highlighted the disparity between the existing legal status and the aspirations of most Sri Lankans. Given the widespread support for legalizing abortion in cases of rape, incest, and fetal abnormalities, it is imperative the government seriously consider legal amendments.

Abstract:Beginning around 1990, judicial interpretation transformed public law in Sri Lanka by blending writs with fundamental rights. On the one hand, the Supreme Court has defined and expanded the constitutional right 'to equality and equal protection of the law' by drawing on administrative law concepts of natural justice, reasonableness, legitimate expectation, the duty to provide reasons for decision-making, and proportionality. On the other hand, judges have relied on the Bill of Rights as a standard to assess the decisions of public authorities in writ matters. This relationship between the writs and the rights has had important implications for the growth of public law in Sri Lanka. There has also emerged an incipient ground of review, 'rights-based review', as part of the writ jurisdiction, and the 'public trust doctrine' in fundamental rights review. Public law has been strengthened by the growth of public interest litigation and the use of new judicial remedies. This article looks at how the writ jurisdiction and rights-based review have evolved in recent times and considers how the two remedies have been used and fused, in a country where the legal and constitutional history has taken a different trajectory to some other post-colonial societies. The article concludes by arguing that this fusion of constitutional and administrative law concepts, together with the expansion in the rules of standing and the emergence of the new concepts of public trust doctrine and fairness, have generated a more robust legal framework that can better protect constitutional rights and democratic freedoms.

Abstract:Death is an inevitable human occurrence, and ancient humans experienced anxiety and apprehension when faced with unnatural deaths. Prehistoric humans valued funeral proceedings and ceremonial rites due to their belief in life after death and reincarnation. Dead bodies can be disposed of legally or illegally. Legal methods include soil burials, entombment, cremation, or donation to medical institutions. Legal disposal requires certification by a medical practitioner and a death certificate. Illegal disposal involves secret burials, such as being thrown into waterways or burnt. Ancient societies used customs like burying corpses in uninhabited jungles or constructing “Towers of Silence” to prevent scavenging by animals. Sea burials are also practiced in some cases. To register a death, authorized individuals confirm its occurrence, transfer the body to undertakers for final disposition, and relatives register it with the registrar of birth, marriage, and death. Various death investigation methods have been implemented in different parts of the world, generally varying based on the investigating authority’s jurisdiction.The death investigation system of Sri Lanka is based partly on the English coroner’s system. The death investigation procedure in Sri Lanka is described in Sections 369 to 373 of the Code of Criminal Procedure (CCP) of Sri Lanka 1980. However, the current inquest system has several deficiencies. It is high time to adopt a system. Sri Lanka should contemplate transitioning from the inquest system to the medical examiner system, as the medical examiner system is more efficient, and several countries followed this successfully.
The crime vanishes: Mob lynching, hate crime, and police discretion in India

Abstract:Amidst high-profile incidents of hate violence against religious and caste minorities, the Indian Supreme Court laid down a series of guidelines to address mob violence and lynching in its July 2018 Tehseen Poonawalla order. The order mandated a police supervisory structure and stronger official accountability, more stringent penal provisions, victim and witness protection, and more expansive compensation and rehabilitation schemes. It also recommended the enactment of an anti-lynching legislation. This article contributes to the conversation about the order’s implementation by drawing from the empirical work conducted by Jindal Global Law School’s (JGLS) legal clinic on hate crimes. It focuses on how the police deploy their official discretion in investigating and prosecuting incidents of mob violence and lynching. First, based on detailed interviews of police officials, the article shows how the ambiguity of the category of lynching continues to plague the implementation of the order. Second, taking a case study of a potential hate crime investigation, it shows how the police structures investigations and charges to undermine the goals of criminal law. This article shows that police officials use their discretion to construct lynching — during various stages of investigation and charging — to obscure and invisibilise the crime. This quotidian exercise of discretion is shaped by broader systemic problems in India’s criminal justice system, especially its lack of independence, inadequate training, and institutional bias. The article advocates that these systemic concerns must be integrated in a meaningful response to mob lynching and hate crimes in India.

Abstract:The study is back to back by seeing that legal protection against victims of severe human rights violations is necessary, as the weak should be effective in protecting the law. So the author was interested in doing this study that discussed how the implementation of human rights protection against victims of severe human rights violations in the criminal justice system in Indonesia, What is problematic in the study is how victims of major human rights violations are regulated in Indonesia and whether the implementation of legal protection against victims of severe human rights violations in existing regulations could provide legal protection against victims of human rights violations. The method of research used in this study is normatif juridical or search literature. Research has shown that the rights of victims of gross human rights violations in criminal justice systems are regulated in 190 penal code laws laws on criminal events, the rule 26 year 2000 on human rights on the next human rights court is governed by regulations granting protection to victims and witnesses in 2002 government regulation Number 2 year and government regulation Number 3 2002 on compensation ordinances, Restitution and rehabilitation, act Number 27 in 2004 on the commission of truth and reconciliation, and in the 2006 act Number 13 on the protection of witnesses and victims. The implementation of protection of law against victims of severe human rights violations in Indonesia has not been consistent with the current laws. Where victims' rights are not fully satisfied because of any legal obstacles such as his lack of success in proving a perpetrator in a severe human rights violation. The weakness of legal procedures that make compensating and rehabilitation to victims is difficult to realize.

Abstract:This article focuses on child sexual abuse in Sri Lanka. The background of child sexual abuse in the country and its current status are discussed. The role of the National Child Protection Authority, the primary governmental body concerned with child protection, is also explored. The article also brings to light various cultural dimensions that serve to call attention to the issue of sexual abuse of children in Sri Lanka. These are explored and illustrated with case vignettes from the author's clinical experience. Finally, the article elucidates the main issues and barriers in Sri Lanka that need to be surmounted in order to have an integrated service delivery in the care of the sexually abused child.

Abstract:Sri Lanka's Constitution authorises the state to limit certain fundamental freedoms on the grounds of specific public interests. This article examines how this constitutional limitation regime has become vulnerable to majoritarian influence. It uses a case study approach, supplemented by key informant interviews, to delve into Sri Lanka's constitutional practice with respect to limitations on fundamental freedoms such as the freedom of religion or belief, and the freedom of expression. The article illustrates how organs of the Sri Lankan state have equated notions of 'public interest' with the majority community's conceptions of 'security', 'order', 'health' and 'morals'. It argues that this practice reflects a cleavage between the moral legitimacy and the legal claimability of fundamental freedoms of minorities and satirists in Sri Lanka. It concludes that legal regimes designed to guarantee fundamental freedoms offer very little protection to minorities when the underlying politics driving the application of law is majoritarian.

Abstract:The implementation of legal aid service standards, as outlined in Regulation No. 4 of 2021 by the Minister of Law and Human Rights of Indonesia, was expected to enhance the quality of legal aid services. However, in reality, suspects continue to experience inconsistent access to their rights, especially within the criminal justice system. This study aims to investigate the application of these standards across the police, prosecutor's office, and court sectors. Employing an empirical juridical approach with a qualitative and comparative study method, data was gathered through interviews and literature review, then analyzed using content and comparative analysis techniques. The findings reveal that the enforcement of legal aid service standards in the criminal justice system has been ineffective, marked by frequent violations of suspects' rights. These violations include providing indirect assistance, inadequate representation at various stages of trials, appointing advocates not affiliated with accredited LBH (Legal Aid Institute), and advocates displaying insufficient responsiveness and engagement in assisting suspects. Such violations significantly hinder suspects' access to justice within the criminal justice system.

Abstract:Introduction: Isolation of persons is a key strategy to prevent and control highly contagious diseases throughout the history worldwide and its importance had re-emerged due to COVID-19 pandemic. In Sri Lanka, like other countries, this isolation process is mainly governed by the law. The Quarantine and Prevention of Diseases Ordinance is the main law in this regard where the powers are mainly vested with health authorities.Objectives: To analyses the law of isolation and its legitimacy of practice in Sri LankaMethods: A desk review of laws associated with isolation and quarantine in Sri Lanka was conducted and compared with the actual practice of implementation of these laws during COVID-19 epidemic.Results: Quarantine and Prevention of Diseases Ordinance of Sri Lanka and its regulations contain strong provisions on isolation of persons which are incorporated in to legal scenarios of disease locality, infected house/place, self-quarantine and observational hospital/place and linked to face mask and social distancing rules. However, these legal provisions are misused and not legitimately implemented by authorities.Conclusions and Recommendations: Quarantine and Prevention of Diseases Ordinance of Sri Lanka and its regulations can be used to prevent and control COVID-19 effectively as adequate and powerful provisions are available, especially in relevant to isolation of persons. However, the relevant law is often wrongly interpreted and imposed by authorities as well as non-authorities. Authorities and Authorized Officers need to be empowered on their powers and limitations to implement the law legitimately in order to achieve the maximum control and prevention of COVID-19 and other infectious diseases.
State legal aid and undertrials: are there no takers?

Abstract:While the crisis in India’s legal aid system is well documented, the extent of utilization of legal aid lawyers for representation in court has received little attention. In this article, based on existing public data, we seek to demonstrate the extent of underutilization of legal aid services among prisoners nationally. The data reveals that over a period of 4 years, between 2016 and 2019, only 7.91% of the undertrials admitted into prisons utilized the legal aid services they were entitled to. This phenomenon of underutilization raises uncomfortable questions about the performance of India’s legal aid system, particularly in the context of socio-economic vulnerability of prisoners. However, the limitations of the data mean that it is not possible to determine the reasons for such underutilization – whether underutilization is being driven by lack of awareness of legal aid or by socio-economically vulnerable undertrial prisoners choosing other options despite being aware of free legal aid.

Abstract:Recent media reports regarding the alleged involvement of some officers of Police Narcotic Bureau (PNB) in drug deals suggest that drug trafficking can be a major source of money laundering activities in Sri Lanka. It is an ill-fated situation when the Police Department, being the main law enforcement authority, is required to undertake investigations to detect assets reported to be illegally acquired by some of their own officers attached to PNB. Stories revealed by the media regarding the financial transactions and luxury properties owned by the alleged criminals, who were taken into the legal custody, suggest that there are serious gaps in the legal framework applicable to money laundering activities and the compliance therewith by relevant stakeholders. Undetected money laundering creates more room for bribery and corruption at the level of critical gatekeepers in the legal system and thereby weakens action against unlawful activities. It can also undermine the socio-political fabric of society. This article focuses on lacunas observed in the implementation phase of anti-money laundering laws in Sri Lanka.
The effectiveness of a short-term training program on child protection among Sri Lankan police officers

Abstract:Child abuse is a complex problem. It is sensitive in nature and requires a comprehensive police investigation. Police officers are at the forefront of this issue and hence it is important that they have optimal skills when investigating cases of suspected child abuse. This article evaluates the effectiveness of a short-term, 6-hour, child protection training provided to 39 Sri Lankan police officers (37 female). The effectiveness of the program was assessed using a scale at pre- and post-program. The results indicated that the training significantly increased participants’ knowledge on aspects of child abuse. However, the program did not significantly affect their attitudes about child abuse or their perceived skill in managing cases of abuse. Qualitative feedback from the participants and their superior officers, obtained during a group discussion, indicated that the training had been effective and the learning outcomes had been achieved. This article makes recommendations for improving the child protection services in middle-income countries such as Sri Lanka, in terms of multiphasic and comprehensive training for police officers.
