Abstract:Background Data processing of health research databases often requires a Data Protection Impact Assessment to evaluate the severity of the risk and the appropriateness of measures taken to comply with the European Union (EU) General Data Protection Regulation (GDPR). We aimed to define and apply a comprehensive method for the evaluation of privacy, data governance and ethics among research networks involved in the EU Project Bridge Health. Methods Computerised survey among associated partners of main EU Consortia, using a targeted instrument designed by the principal investigator and progressively refined in collaboration with an international advisory panel. Descriptive measures using the percentage of adoption of privacy, data governance and ethical principles as main endpoints were used for the analysis and interpretation of the results. Results A total of 15 centres provided relevant information on the processing of sensitive data from 10 European countries. Major areas of concern were noted for: data linkage (median, range of adoption: 45%, 30%–80%), access and accuracy of personal data (50%, 0%–100%) and anonymisation procedures (56%, 11%–100%). A high variability was noted in the application of privacy principles. Conclusions A comprehensive methodology of Privacy and Ethics Impact and Performance Assessment was successfully applied at international level. The method can help implementing the GDPR and expanding the scope of Data Protection Impact Assessment, so that the public benefit of the secondary use of health data could be well balanced with the respect of personal privacy.

Abstract:Recent developments in Information and Communication Technology have paved the foundations for new forms of collaboration between health systems in different countries. These collaborations allow, on the one hand, to monitor recurrent health emergencies on territories, and on the other hand, they allow national health systems to share information about foreign citizens in transit on their territory. European legislation regarding the processing of personal data places strict constraints on the cross-border transfer of personal data. In this case, companies or organizations, operating on information interchange, must adopt robust mechanisms to verify the adequacy requirements, in order to allow monitoring of security levels, identification of possible intervention actions and preparation of updated security plans for inspection visits required by European standards. In this context, Axiomatic Design allows not only to design medical systems and equipment in compliance with current regulations, but also to provide representations of the design artifact already prepared to implant privacy risk assessment mechanisms. This makes it possible to identify the activities/components to be assessed up to a level of elementary granularity such as to allow risk assessment for the single module. At the same time, the axiomatic approach enables the overall recomposition of privacy violation risks on the basis of a modular representation of the whole system according to the well-known V model scheme. This recomposition allows to build the so-called risk privacy coverage matrix, in order to trace the risk level of the elementary modules, associating them with more and more complex components. In this way, the foundations to build a dynamic monitoring system of the privacy risk level of the system can be defined.

Abstract:Personalized medicine leverages genetic, environmental, and lifestyle information to enhance the efficacy and safety of medical interventions. The shift from traditional one-size-fits-all approaches to a more individualized strategy signifies a major evolution in healthcare systems globally, promising improved patient outcomes and cost-effectiveness. A critical aspect of implementing personalized medicine is the role of public participation and their attitudes toward sharing health data. With growing concerns over data privacy, understanding and addressing public perceptions is essential. For this purpose, we designed and conducted a cross-sectional survey in Europe to gather public attitudes toward personalized medicine and health data sharing. The addressed issues range from knowledge and views to means of data sharing, e.g., via digital health instruments and electronic health care records. These insights are crucial for developing policies and practices that can help build trust and foster a secure environment for healthcare data sharing.

Modelling and enforcing privacy for medical data disclosure across Europe

Abstract:The harmonization of data protection legislation in Europe has been theoretically achieved by means of the EU directive on data protection. In practice the harmonization is not absolute and conflicts and inconsistencies continue to exist in the way Member States are implementing the directive. The integration of different European medical systems by means of grid technologies will continue to be challenging if technology does not intervene to enhance interoperability between national regulatory frameworks on data protection. In this paper we present an approach to automate privacy requirements for the sharing of patient data across Europe on a healthgrid domain and ensure its enforcement internally and within external domains where the data might travel. This approach is based on the semantic modelling of privacy obligations that are of legal, ethical or cultural nature. These requirements are for the sharing of personal data between different European Member States. Our model reflects both similarities and conflicts, if any, between the different Member States. This allows us to reason on the safeguards a data controller should ask from an organization belonging to another Member State before disclosing medical data to them. The system will also generate the relevant set of policies to be enforced at the process level of the grid to ensure privacy compliance before allowing access to the data.
Privacy-Preserving Workflow for the Cross-Border Federated Analysis of Clinical Data

Abstract:The motivation behind this research is to perform a privacy-preserving analysis of data located at remote sites and in different jurisdictions with no possibility of sharing individual-level information. Here, we present key findings from requirements analysis and a resulting federated data analysis workflow built using open-source research software, where patient-level information is securely stored and never exposed during the analysis process. We present additional improvements to further strengthen the security of the workflow. We emphasize and showcase the use of data harmonization in the analysis. The data analysis is done using the R language for statistical computing and DataSHIELD libraries for non-disclosive analysis of sensitive data. The workflow was validated against two data analysis scenarios, confirming the results obtained with a centralized analysis approach. The clinical datasets are part of the large Pan-European SARS-Cov-2 cohort, collected and managed by the ORCHESTRA project. We demonstrate the viability of establishing a cross-border federated data analysis framework and conducting an analysis without exposing patient-level information, achieving results equivalent to centralized non-secure analysis. However, it is vital to ensure requirements associated with data harmonization, anonymization and IT infrastructure to maintain availability, usability and data security.
DAISY: A Data Information System for accountability under the General Data Protection Regulation

Abstract:Background: The new European legislation on data protection, namely, the General Data Protection Regulation (GDPR), has introduced comprehensive requirements for the documentation about the processing of personal data as well as informing the data subjects of its use. GDPR's accountability principle requires institutions, projects, and data hubs to document their data processings and demonstrate compliance with the GDPR. In response to this requirement, we see the emergence of commercial data-mapping tools, and institutions creating GDPR data register with such tools. One shortcoming of this approach is the genericity of tools, and their process-based model not capturing the project-based, collaborative nature of data processing in biomedical research. Findings: We have developed a software tool to allow research institutions to comply with the GDPR accountability requirement and map the sometimes very complex data flows in biomedical research. By analysing the transparency and record-keeping obligations of each GDPR principle, we observe that our tool effectively meets the accountability requirement. Conclusions: The GDPR is bringing data protection to center stage in research data management, necessitating dedicated tools, personnel, and processes. Our tool, DAISY, is tailored specifically for biomedical research and can help institutions in tackling the documentation challenge brought about by the GDPR. DAISY is made available as a free and open source tool on Github. DAISY is actively being used at the Luxembourg Centre for Systems Biomedicine and the ELIXIR-Luxembourg data hub.

Abstract:Background With new technologies, health data can be collected in a variety of different clinical, research, and public health contexts, and then can be used for a range of new purposes. Establishing the public’s views about digital health data sharing is essential for policy makers to develop effective harmonization initiatives for digital health data governance at the European level. Objective This study investigated public preferences for digital health data sharing. Methods A discrete choice experiment survey was administered to a sample of European residents in 12 European countries (Austria, Denmark, France, Germany, Iceland, Ireland, Italy, the Netherlands, Norway, Spain, Sweden, and the United Kingdom) from August 2020 to August 2021. Respondents answered whether hypothetical situations of data sharing were acceptable for them. Each hypothetical scenario was defined by 5 attributes (“data collector,” “data user,” “reason for data use,” “information on data sharing and consent,” and “availability of review process”), which had 3 to 4 attribute levels each. A latent class model was run across the whole data set and separately for different European regions (Northern, Central, and Southern Europe). Attribute relative importance was calculated for each latent class’s pooled and regional data sets. Results A total of 5015 completed surveys were analyzed. In general, the most important attribute for respondents was the availability of information and consent during health data sharing. In the latent class model, 4 classes of preference patterns were identified. While respondents in 2 classes strongly expressed their preferences for data sharing with opposing positions, respondents in the other 2 classes preferred not to share their data, but attribute levels of the situation could have had an impact on their preferences. Respondents generally found the following to be the most acceptable: a national authority or academic research project as the data user; being informed and asked to consent; and a review process for data transfer and use, or transfer only. On the other hand, collection of their data by a technological company and data use for commercial communication were the least acceptable. There was preference heterogeneity across Europe and within European regions. Conclusions This study showed the importance of transparency in data use and oversight of health-related data sharing for European respondents. Regional and intraregional preference heterogeneity for “data collector,” “data user,” “reason,” “type of consent,” and “review” calls for governance solutions that would grant data subjects the ability to control their digital health data being shared within different contexts. These results suggest that the use of data without consent will demand weighty and exceptional reasons. An interactive and dynamic informed consent model combined with oversight mechanisms may be a solution for policy initiatives aiming to harmonize health data use across Europe.

Abstract:Legal interoperability constitutes a prerequisite for the provision of high-quality cross border e-health services, like ePrescription and ePatientSummary. A review of EU legislation, policy initiatives and relevant judgments of the European Court of Justice (ECJ) and the European Court of Human Rights (ECHR) was held, concerning personal medical data. Four European social welfare systems, according to Esping - Andersen's typology, were selected and a study of health policy in relation to the national legal framework regarding the data protection regulation is examined. A model of legal interoperability for cross-border eHealth services is proposed for policy makers at EU level based on the following major domains: protection and security of data, transparency and liability, further analyzed in multiple axes and combined with EU targets, policy priorities and basic European legal principles. This model could be viable because of the EU's transnational existence, the coexistence of national and Community law, and the need of novel models of political governance under a unified regulatory and normative base.

Abstract:Sharing healthcare data is increasingly essential for developing data-driven improvements in patient care at the Intensive Care Unit (ICU). However, it is also very challenging under the strict privacy legislation of the European Union (EU). Therefore, we explored four successful open ICU healthcare databases to determine how open healthcare data can be shared appropriately in the EU. A questionnaire was constructed based on the Delphi method. Then, follow-up questions were discussed with experts from the four databases. These experts encountered similar challenges and regarded ethical and legal aspects to be the most challenging. Based on the approaches of the databases, expert opinion, and literature research, we outline four distinct approaches to openly sharing healthcare data, each with varying implications regarding data security, ease of use, sustainability, and implementability. Ultimately, we formulate seven recommendations for sharing open healthcare data to guide future initiatives in sharing open healthcare data to improve patient care and advance healthcare.

Abstract:Background: Timely and high-quality population-level health information is needed to support evidence-informed decision-making, for planning and evaluation of prevention, care and cure activities as well as for research to generate new knowledge. FAIR (Findable, Accessible, Interoperable and Reusable) principles are one of the key elements supporting health research and making it more cost-effective through the reuse of already existing data. Currently, health data are in many countries dispersed and difficult to find and access. Methods: Two EU Public Health Programmes co-funded Joint Actions, Information for Action (InfAct) and Population Health Information Research Infrastructure (PHIRI) have established a European Health Information Portal, a web-based service, to facilitate better findability, access, interoperability and reuse of existing health information. Results: The European Health Information Portal (www.healthinformationportal.eu) has been established including sections on National Nodes, data sources, publications, health information projects within countries and across Europe, research networks and research infrastructures, ethical and legal issues for health information exchange and use, capacity-building activities in all areas of population health and a dedicated COVID-19 section. Conclusions: The European Health Information Portal, being a central place for a wide range of population health information from EU Member States, is an information source for researchers, policy-makers and other relevant stakeholders. It is important to ensure the sustainability of the portal, especially in light of the European Health Data Space (EHDS) Regulation proposal and its requirements regarding the secondary use of health data.
The creation of an adaptable informed consent form for research purposes to overcome national and institutional bottlenecks in ethics review: experience from rare disease registries

Abstract:Background The lack of harmonization of evaluation criteria by Ethics Committees in the European Union (EU) has led to inconsistent ethics reviews received by research sites participating in multicenter non-interventional studies. The European General Data Protection Regulation (GDPR) appears to be implemented at national level with a substantial degree of variance in interpretation. The European Reference Networks (ERNs) were struggling in setting an Informed Consent Form (ICF) for registries, allowing reuse of data for research purposes. The aim of this work is to develop an adaptable ICF for research purposes to be used in ERN registries. Methods To work on this challenge, a team was established within the European Joint Programme on Rare Diseases (EJP RD) to develop a patients’ registry ICF template allowing easy adaptation to ERNs, country, and site-level specificities. ERN and patients’ representatives validated the choice of developing a GDPR-compliant template for research purposes. The feedback received from 34 Ethics Committees on the Clinical Patient Management System ICF, including the submission of patients’ data to the ERN registries and the EU consent regulatory framework were analyzed along with existing ontologies for data access and reuse. An adaptable ICF was developed following iterative cycles of consultation and review by clinicians, research experts, ethics and regulatory advisors, and patients’ representatives. The development of pediatric material for minor participants was also undertaken. Results and Conclusion Research oriented ICF templates for adults and for parents/legal representatives of patients were released in 26 national languages. This adaptable ICF aims to foster, according to patients’ preferences, the reuse of registries data for research purposes in compliance with the applicable laws and standards. Pediatric material is being finalized to collect minors’ assent. ICF machine-readability is also progressing to enhance data discovery and facilitate its access and reuse conditions.

Abstract:Background: The healthcare sector is currently undergoing a significant transformation, driven by an increased utilization of data. In this evolving landscape, surveys are of pivotal importance to the comprehension of patient needs and preferences. Moreover, the digital affinity of patients and physicians within the healthcare system is reforming the manner in which healthcare services are accessed and delivered. The utilization and donation of data are influencing the future of medical research and treatment, while artificial intelligence (AI) is empowering patients and physicians with knowledge and improving healthcare delivery. Methods: In order to evaluate the opinions of patients and physicians regarding the management of personal health data and the functionality of upcoming data management devices in the context of healthcare digitization, we conducted an exploratory study and designed a survey. The survey focused on a number of key areas, including demographics, experience with digitization, data handling, the identification of needs for upcoming digitization, and AI in healthcare. Results: A total of 40 patients and 15 physicians participated in the survey. The results indicate that data security, timesaving/administrative support, and digital communication are aspects that patients associate with patient-friendly digitization. Based on the responses provided by physicians, it might be concluded that future digital platforms should prioritize usability, time efficacy, data security, and interoperability. Conclusions: In terms of expectations for future digital platforms, there is a notable overlap between the needs expressed by patients and those identified by physicians, particularly in relation to usability, time management, data security, and digital communication. This suggests that the requirements of different stakeholders can be combined in a future system, although individual issues may still require attention.

Abstract:Background: Centralized collection and processing of healthcare data across national borders pose significant challenges, including privacy concerns, data heterogeneity and legal barriers. To address some of these challenges, we formed an interdisciplinary consortium to develop a feder-ated health data network, comprised of six institutions across five countries, to facilitate Nordic-Baltic cooperation on secondary use of health data. The objective of this report is to offer early insights into our experiences developing this network. Methods: We used a mixed-method ap-proach, combining both experimental design and implementation science to evaluate the factors affecting the implementation of our network. Results: Technically, our experiments indicate that the network functions without significant performance degradation compared to centralized simu-lation. Conclusion: While use of interdisciplinary approaches holds a potential to solve challeng-es associated with establishing such collaborative networks, our findings turn the spotlight on the uncertain regulatory landscape playing catch up and the significant operational costs.

The growing cooperation of organizations results in the need to share and exchange such data. This collection and sharing, however, is affected by privacy concerns, and organizational and technical issues have to be solved and taken into account. This paper describes the results of an exploratory study in the government sector, focusing on the way public organizations manage identity-related data and the sharing of such data, either with other public agencies or with private organizations. Despite significant progress in harmonizing the legal and administrative provisions and technical standards in the European Union, there are still considerable cross-country differences regarding this subject. These differences—together with the growing mobility of goods, persons, and related data within the European Union—cause particular challenges for information systems in digital government in this region. After discussing and defining the key notions and methodology of the study, we present the status quo in 18 out of 25 EU member states and compare it to the results of a prior study by the same network done in 2001. Finally, we draw conclusions about identity management in cross-border contexts.

Abstract:Management of datasets that include health information and other sensitive personal information of European study participants has to be compliant with the General Data Protection Regulation (GDPR, Regulation (EU) 2016/679). Within scientific research, the widely subscribed'FAIR' data principles should apply, meaning that research data should be findable, accessible, interoperable and re-usable. Balancing the aim of open science driven FAIR data management with GDPR compliant personal data protection safeguards is now a common challenge for many research projects dealing with (sensitive) personal data. In December 2020 a workshop was held with representatives of several large EU research consortia and of the European Commission to reflect on how to apply the FAIR data principles for environment and health research (E&H). Several recent data intensive EU funded E&H research projects face this challenge and work intensively towards developing solutions to access, exchange, store, handle, share, process and use such sensitive personal data, with the aim to support European and transnational collaborations. As a result, several recommendations, opportunities and current limitations were formulated. New technical developments such as federated data management and analysis systems, machine learning together with advanced search software, harmonized ontologies and data quality standards should in principle facilitate the FAIRification of data. To address ethical, legal, political and financial obstacles to the wider re-use of data for research purposes, both specific expertise and underpinning infrastructure are needed. There is a need for the E&H research data to find their place in the European Open Science Cloud. Communities using health and population data, environmental data and other publicly available data have to interconnect and synergize. To maximize the use and re-use of environment and health data, a dedicated supporting European infrastructure effort, such as the EIRENE research infrastructure within the ESFRI roadmap 2021, is needed that would interact with existing infrastructures.
A critique of the regulation of data science in healthcare research in the European Union

Abstract:The EU offers a suitable milieu for the comparison and harmonisation of healthcare across different languages, cultures, and jurisdictions (albeit with a supranational legal framework), which could provide improvements in healthcare standards across the bloc. There are specific ethico-legal issues with the use of data in healthcare research that mandate a different approach from other forms of research. The use of healthcare data over a long period of time is similar to the use of tissue in biobanks. There is a low risk to subjects but it is impossible to gain specific informed consent given the future possibilities for research. Large amounts of data on a subject present a finite risk of re-identification. Consequently, there is a balancing act between this risk and retaining sufficient utility of the data. Anonymising methods need to take into account the circumstances of data sharing to enable an appropriate balance in all cases. There are ethical and policy advantages to exceeding the legal requirements and thereby securing the social licence for research. This process would require the examination and comparison of data protection laws across the trading bloc to produce an ethico-legal framework compatible with the requirements of all member states. Seven EU jurisdictions are given consideration in this critique.

Abstract:Background: The ORCHESTRA project, funded by the European Commission, aims to create a pan-European cohort built on existing and new large-scale population cohorts to help rapidly advance the knowledge related to the prevention of the SARS-CoV-2 infection and the management of COVID-19 and its long-term sequelae. The integration and analysis of the very heterogeneous health data pose the challenge of building an innovative technological infrastructure as the foundation of a dedicated framework for data management that should address the regulatory requirements such as the General Data Protection Regulation (GDPR). Methods: The three participating Supercomputing European Centres (CINECA - Italy, CINES - France and HLRS - Germany) designed and deployed a dedicated infrastructure to fulfil the functional requirements for data management to ensure sensitive biomedical data confidentiality/privacy, integrity, and security. Besides the technological issues, many methodological aspects have been considered: Berlin Institute of Health (BIH), Charité provided its expertise both for data protection, information security, and data harmonisation/standardisation. Results: The resulting infrastructure is based on a multi-layer approach that integrates several security measures to ensure data protection. A centralised Data Collection Platform has been established in the Italian National Hub while, for the use cases in which data sharing is not possible due to privacy restrictions, a distributed approach for Federated Analysis has been considered. A Data Portal is available as a centralised point of access for non-sensitive data and results, according to findability, accessibility, interoperability, and reusability (FAIR) data principles. This technological infrastructure has been used to support significative data exchange between population cohorts and to publish important scientific results related to SARS-CoV-2. Conclusions: Considering the increasing demand for data usage in accordance with the requirements of the GDPR regulations, the experience gained in the project and the infrastructure released for the ORCHESTRA project can act as a model to manage future public health threats. Other projects could benefit from the results achieved by ORCHESTRA by building upon the available standardisation of variables, design of the architecture, and process used for GDPR compliance.

Abstract:Uiergezondheidsproblemen kunnen ontstaan door een verstoring van de balans tussen de infectiedruk en de weerstand van dieren. Er zijn veel factoren van invloed op die weerstand, waarvan de erfelijke aanleg er een is. Fokkerij houdt zich bezig met de verbetering van deze erfelijke aanleg. Het is een bij uitstek op de toekomst gerichte activiteit vanwege het grote generatie-interval. Beslissingen die in de fokkerij worden genomen, bepalen de aanleg van de dieren die op termijn zullen produceren. Als is vastgesteld wat het fokdoel is, moeten de beste dieren voor die kenmerken worden geselecteerd als ouders van de toekomstige generatie. Weerstand tegen mastitis is voor een deel erfelijk bepaald en kan daarom worden verbeterd door middel van fokkerij. Abstract:This study explores public perceptions and engagement in mobile health (mHealth) across eight European countries: Italy, the Netherlands, France, Germany, Spain, Poland, Romania, and Hungary. The focus is on the public's attitudes toward health app usage and data sharing examined through a cross-sectional survey involving 6,581 participants. The survey revealed that 21.87% of respondents currently use health apps, with 42.71% expressing interest in future use. Regarding data sharing, 52.82% are willing to share health data with healthcare providers, and 25.48% would share data with public and private research institutions. However, concerns about data privacy and security are prevalent, with 63.68% fearing hacking of their data and 72.34% afraid that their data might be used for inappropriate purposes. However, prevalent concerns about data privacy and security emerged, with 72.34% expressing worry about data misuse and 63.68% fearing data hacking. The study highlights significant generational and geographical differences in mHealth engagement, with older generations displaying a lower adoption level of health apps. Education level emerged as a crucial factor influencing attitudes toward mHealth, with those having tertiary education more likely to use health apps and demand transparency. These findings underscore the need for targeted strategies to enhance digital literacy, ensure data privacy, and promote equitable access to mHealth technologies across Europe.
