10 years of controversy, twists and turns in the Perruche wrongful life claim: compensation for children born with a disability in France

Abstract:Since March 1st, 2010, French citizens have been able to call on a new legal procedure for defending their rights: the priority preliminary ruling on issues of constitutionality (question prioritaire de constitutionnalité, QPC). If, during a trial, a citizen considers that a provision of the applicable law is inconsistent with the Constitution of the French Republic, he/she may request that the matter be referred to the Constitutional Council. One ofthe first QPCs concerned legislation related to the Perruche jurisprudence. In a ruling on November 17th, 2000, the French Supreme Court of Appeal had granted the child Nicolas Perruche the right to financial compensation for the material costs related to his physical disability (caused by congenital rubella). In response, Article 1 of the Patients' Rights and Quality of Care Act (passed on March 4th, 2002) prohibited the award of compensation to a child "just because he/she has been born [with a disability]", i.e. in "wrongful life" claims. Since the enactment of the Act, compensation in a case like Perruche may only be awarded to cover the parents' psychological suffering, rather than the child's status at birth. The application of this "anti-wrongful life claim" legislation has since been subject of heated debate. In a QPC ruling on June 11th, 2010, the Constitutional Council found that Article 1 of the Patients' Rights and Quality of Care Act was (with the exception of its transitional provisions) indeed consistent with the Constitution of the French Republic.

Abstract:Until now France has always refused to recognise any parent-child relationship as a result of surrogacy. All petitions for recognition were refused first on the grounds of public policy and then on the grounds of fraudulent process including towards a biological parent. Having been condemned on the basis that children born from surrogacy abroad suffer from an infringement regarding their right of respect to their private life, France will have to modify its position. On 3 July 2015 the French Cour de Cassation found that a fraudulent process can no longer prevent the registration of the particulars of the birth in the French register of civil status, provided that the foreign birth certificate was regular and that its details were accurate. Yet many questions remain open, including the interpretation of the ECtHR rulings. But whatever interpretation is chosen, it will call for a deep reform of the very definition of parent-child relationship in the French legal system.
Investigation of Methods Suitable for the Matrix-Assisted Laser Desorption/Ionization Mass Spectrometric Analysis of Proteins from Ribonucleoprotein Complexes

Abstract:A variety of protein isolation and purification techniques for ribonucleoprotein (RNP) complexes were investigated for their compatibility with downstream analysis by matrix-assisted laser desorption/ionization time-of-flight mass spectrometry (MALDI-TOF MS). Ribosomal proteins from Escherichia coli 70S ribosomes were obtained using methods such as phenol extraction and precipitation by organic solvents or acids. Under optimal conditions, more than 90% of the expected ribosomal proteins were detected in a single MALDI-MS experiment. The most effective approach combined ribosome denaturation by buffer exchange with acid precipitation of the ribosomal ribonucleic acids. An improved acid precipitation approach, involving the sequential additions of acetic and trifluoroacetic acid, yielded more complete protein coverage while minimizing loss of ion signal from lower molecular weight proteins. With phenol extraction, substantial gains in ion abundance of higher molecular weight proteins are noted, although some of the lower molecular weight proteins were not efficiently extracted. These results illustrate several effective approaches for protein isolation from protein complexes such as RNPs that are MALDI-MS compatible, and these approaches should extend the use of MALDI-MS for proteomics-based analyses of other protein–nucleic acid complexes.

Abstract:Specialists who carry out abortions and male or females sterilizations which are legally controlled under the penal law in the category of voluntarily accepted assaults on the body can risk legal actions against the doctors as a result of parents seeking damages for detriment suffered following failure of legally performed terminations of pregnancy or of sterilisation, which had been considered as certain, resulting in preservation of fertility. The authors have looked through the western literature and found that there is both a moral and a financial detriment which plaintiffs can plead after the birth of a normal or a malformed child after an attempt at termination of pregnancy or at sterilisation. They take note of a list of cases of claims which have given rise to a whole body of jurisprudence in France since 1976 and which show that magistrates have some resistance to awarding damages for such detriment.

Abstract:On 4 October 2019, the French Cour de Cassation finally put an end to the struggle of Sylvie and Dominique Mennesson, and their twins who were born from a gestational surrogacy arrangement in California in 2000. It delivered a verdict that the family had expected for 19 years: it validated the transcription into the French civil registry of the foreign birth certificates that designate Mr and Mrs Mennesson as the father and the mother of their daughters Fiorella and Valentina.1 This article focuses on and examines a particularly decisive stage in the Mennessons' crusade to justice: the Advisory Opinion delivered by the European Court of Human Rights ('the Court' or 'the ECtHR') on the issue of recognition in domestic law of the legal relationship between a child born through gestational surrogacy abroad and the intended mother.2 Against the background of the Court's previous case law on surrogacy, this Opinion is herein approached as a further opportunity to (re)consider what kind of link—ie genetic, gestational, and social/intentional—makes someone a legal mother in the era of reproductive technology. Being the first of its kind, this Opinion offers the chance to reflect also on the advisory mechanism itself, and what it can concretely add to the Court's jurisprudence.

Abstract:A 56-year old woman, with the diffuse form of bronchioloalveolar cell carcinoma, developed massive bronchorrhea, resulting in severe fluid and electrolyte depletion when her oral intake was compromised. Chemical analysis of the bronchial secretions and the ultrastructural features of the tumor cells support the concept of an active secretory process. The lactic dehydrogenase (LDH) isoenzyme pattern of the fluid is similar to that found in fetal cells. The neoplastic cells may acquire a more primitive LDH pattern.
Laparoscopic Cholecystectomy: Cost Analysis

Abstract:Recently laparoscopic cholecystectomy (LC) has become an accepted alternative to the traditional open cholecystectomy (OP). The purpose of this study was to compare laparoscopic cholecystectomy to open cholecystectomy with respect to four variables: (a) operative time, (b) length of hospital stay, (c) total hospital cost, and (d) morbidity and mortality rates. The most recent 200 LCs performed at HCA West Side Hospital were selected for comparison in the study. Demographic data, including age and sex were collected for all patients. The medical record for each patient was then reviewed to obtain the study variables. A control group of 200 patients undergoing elective open cholecystectomy over the same period was selected. Complications occurred in 12 patients (6.0%) in the LC group with one postoperative mortality. Nineteen patients (9.5%) suffered complications in the OC group with no operative mortality. The difference between the two groups was not statistically significant. The average length of operation (recorded in minutes) in the OC group was 87.79 (SD ± 20.69) as compared to 103.78 (SD ± 29.01) in the LC group. This difference proved to be slight, but significantly greater (p < 0.0001). The average length of stay (recorded in days) in the OC group was 4.43 (SD ± 1.29) versus 1.13 (SD ± .93) in the LC group. Again, the difference proved to be statistically significant (p < 0.0001). The corrected average total hospital charge from OC was $3,006 (SD ± 755) versus $2,312 (SD ± 484) for LC, a difference that was statistically significant (p < 0.0001). Laparoscopic cholecystectomy is a safe, effective, and cost-efficient alternative to open cholecystectomy. The procedure can be performed as an outpatient procedure in virtually the same amount of time and with no increased risk to the patient. The hospital stay was found to be significantly shorter, resulting in a substantial savings to the patient.
Pediatric injuries in the back of pickup trucks.

Abstract:Travel in the back of pickup trucks has not been adequately addressed as an occupant protection issue. This study compares injuries sustained by children riding in the back of pickup trucks with those of children riding in the cab. Data were obtained from a multihospital monitoring system and the coroner in a single urban county. The series of injured children consisted of 290 children 0 through 14 years of age, 201 of whom had been riding in the cab and 89 in the back. Age distribution of the children demonstrated that it is most frequently the 10- to 14-year-olds who travel in the back. Children riding in the back were more frequently injured in noncrash events (absence of a collision), had more ejections, had more injuries, and sustained more severe injuries as measured by the Maximum Injury Score. With increased restraint use in the cab, it is likely that even greater differentials in injury severity and patterns would be realized. Education regarding the hazards of travel in the back of pickups and stronger legislation limiting the transport of children in the back of trucks are recommended.

Abstract:Access to arbitral justice can be obstructed by the refusal of the respondent to pay its share of the advance on costs. Such default can be the result of dilatory tactics or of the respondent’s impecuniosity. Likewise, a claimant that has consented to arbitration may later be unable to resort to arbitration for lack of financial means. In these circumstances, how can the arbitration agreement be enforced? French courts have long attempted to guarantee effective access to justice (whether arbitral or court justice) in the presence of an arbitration agreement and to balance the need to enforce the arbitration agreement with the parties’ right to have their day in court. The decision rendered by the French Cour de Cassation on 9 February 2022 relied on “the principle of procedural loyalty governing parties to an arbitration agreement” to hold that a party that had caused the withdrawal of the arbitration proceedings by failing to pay its share of the advance on costs, was not entitled to rely on the arbitration agreement to object to the jurisdiction of the French courts. Although this solution is not new, it has divided the doctrine in France.

Abstract:It is important to not conduct a substantiality analysis by dealing with the copied features piecemeal. The “abstraction” of a work to the essence of what makes it original and the exclusion of non-protectable elements at the outset of the analysis would prevent a truly holistic assessment. This approach focuses unduly on whether each of the parts of the work is individually original and protected by copyright law. Rather, a cumulative effect of the features copied from the work must be considered, to determine whether those features amount to a substantial part of the author’s skill and judgment expressed in his work as a whole.The question of whether there has been substantial copying focuses on whether the copied features constitute a substantial part of the plaintiff’s work – not whether they amount to a substantial part of the defendant’s work. The alteration of copied features or their integration into a work that is notably different from the plaintiff’s work does not necessarily preclude a claim that a substantial part of the work has been copied.Disgorgement under Sec. 35 of the Copyright Act goes no further than is necessary to prevent each individual defendant from retaining a wrongful gain. Defendants cannot be held liable for the gains of co-defendants by imposing liability for disgorgement on a solidary basis.As regards punitive damages, they cannot be awarded on a solidary basis. The punitive damages regime under the Charter is autonomous from the extra-contractual civil liability regime established under the Civil Code of Quebéc. Article 1526 of the Civil Code of Quebéc applies to extra-contractual fault causing injury and cannot ground the solidarity of punitive damages awarded under the Charter. Both the objectives of punitive damages and the factors relevant to assessing them suggest that awards of punitive damages must be individually tailored to each defendant against whom they are ordered. This requirement of individualization militates against awarding punitive damages on a solidary basis.

Abstract:Children, i.e. people between 0 and 18 years old, have human rights. This is undisputed and the Convention of the Rights of the Child is a sufficient indication of this fact. What remains problematic is what they can do with their rights when they get in trouble or when legal proceedings are started that deal with their rights and interests. The Council of Europe has nominated justice for children as one of its key priorities and subsequently drafted guidelines on child friendly justice. These guidelines put forward the notion of justice proceedings, in the broadest sense, being adapted to cater for the needs of children and young people. As rights holders, they too should be able to turn to the justice system to have their rights protected and to have that done so in a child friendly way, taking into consideration their level of understanding, their specific vulnerabilities, their position and their best interest(s).These guidelines serve as a tool, aiding the daily work of judges, lawyers, police officers, social workers and other relevant professions. Their true impact will only be felt once they have been made widely available to all concerned professionals as well as to children and young people themselves. This way, the justice system can become more accessible and can better uphold children’s rights.

Abstract:We consider a generic reaction-diffusion system in which one of the parameters is subjected to dichotomous noise by controlling the flow of one of the reacting species in a continuous-flow-stirred-tank reactor (CSTR) -membrane reactor. The linear stability analysis in an extended phase space is carried out by invoking Furutzu-Novikov procedure for exponentially correlated multiplicative noise to derive the instability condition in the plane of the noise parameters (correlation time and strength of the noise). We demonstrate that depending on the correlation time an optimal strength of noise governs the self-organization. Our theoretical analysis is corroborated by numerical simulations on pattern formation in a chlorine-dioxide-iodine-malonic acid reaction-diffusion system.
The Legal Framework for the Fight against Female Circumcision: From Cultural Indulgence to Human Rights Violations. The French Example

Abstract:The harmful consequences of female circumcision for women's health have been demonstrated and are regularly recalled by the World Health Organisation. Whereas in the past, the cultural dimension of the practice was emphasised, which result in impunity or absence of guilt, it is now considered by the United Nations as a violation of human rights, especially of the right to health. In 2012, the General Assembly asked States for a total ban on the practice. Despite the consensus on the punishability of female circumcision, its enforcement diverges, in particular in Western Europe. France is considered as a model in this area, that's why this study focuses on it. Yet, under French law, there is no special legislation criminalising the practice: female circumcision is punishable on grounds of mutilation. However, the French success is not complete: the prevention of such acts could be improved.

Abstract:This chapter describes administrative procedure and judicial review in France. In French public law, no constitutional provision provides for judicial review of administrative measures. Nor is there a convention providing for judicial review of administrative measures. This is only envisaged by the laws and regulations, in particular the Administrative Justice Code and the Code of Relations between the Public and the Administration. The administrative courts exercise extensive control over the acts or measures of the public administration, including both individual decisions and regulatory acts, but some are nonetheless beyond judicial review. Where an act or measure is contested on procedural grounds, judicial review takes place only under certain conditions: the procedural defect must have deprived the applicant of a guarantee or it must have influenced the meaning of the decision taken. Two types of judicial remedy exist in administrative law: it is therefore up to the applicant to limit their application before the administrative judge.

Abstract:Assisted reproductive technologies (ART) have changed life for the past 25 years and many ethical and social issues have emerged following this new method of conception. In order to protect individuals against scientific and ethical abuses without inhibiting scientific progress, a specific legal framework is necessary. The first French law on Bioethics was voted after an extensive debate in 1994 then reviewed in 2004. This review previously scheduled every five years is currently being discussed. Legal provisions applying to ART are part of a large framework including the protection of the patients' rights and biomedical research. The key principles consist of respect for human life and ban on commercial practices of human body parts, eugenic practices and any kind of cloning. These key principles apply to ART. Donation is anonymous and free. Created in 2004, the Agence de la biomédecine is a government agency and one of the main tools of the French regulations. The missions focus on improving the quality and the safety of the management of ART. Evaluation of activities is available to all from the annual report. The agency represents the French competent authority for medical and scientific aspects of ART. Substantial differences in European legislations exist from the open-up "laissez faire" to the most restrictive one. As a consequence a large reproductive tourism has developed particularly for egg donation or surrogacy. The medical and ethical conditions of management of patients and donors represent the main critical points. In order to avoid ethical abuses, homogenization regarding the key principles is necessary in Europe. It is an opportunity to reassert that human body parts should not be a source of financial gain.

Legal Issues in the Digital Age

Abstract:The use of artificial intelligence in France is growing and intensifying in many areas, particularly in the field of justice. French President Macron has made it one of his government’s priorities to build on these assets and make France a world leader in AI. In parallel, the French government has deployed some efforts towards anticipating the regulatory challenges related to AI, the “National Strategy for Artificial Intelligence” launched as part of «France 2030» . As an illustration of the developments in artificial intelligence and its specific regulation, the French parliament passed a law to ensure the proper conduct of the 2024 Olympic and Paralympic Games (Law N° 2023-380 of 19.05.2023). The law permits the use of the experimental “augmented video-protection” technology, which uses cameras equipped with AI systems to detect and report specific events in real time. French regulations begin already now in the area of justice and must continue in the fields of AI liability and intellectual property. AI is a source of fears, particularly for the respect of human rights, and requires a very elaborate legal and ethical environment that is flexible enough to avoid slowing down the development of AI. The AI Liability EU Directive complements the Artificial Intelligence Act by introducing a new liability regime that ensures legal certainty, enhances consumer trust in AI, and assists consumers’ liability claims for damage caused by AI-enabled products and services. But the new European AI Act does not resolve all issues that therefore need to be addressed nationally.

Abstract:This paper considers the development of new clinical and medical practices in the early 2000s in France, after the adoption of legal reforms aiming at the prevention of sexual infractions and the protection of minors. The paper explains how the reform led to the creation of a new form of punishment for sexual offenders, l' obligation de soin (therapeutic obligation), which can be described as long-term mandatory therapeutic monitoring. This paper offers an analysis of the implementation of this measure from the standpoint of the specialized mental health care unit which were entrusted the mission of caring for the new group of convicted patients, i.e., patients sentenced to undergo mandatory therapy, after this legal reform. In the new regime these mandatory therapies created, clinicians are tasked to combine their conventional mission of care for the patient in the present, with the judicial mandate of detecting and preventing the patient's relapse qua recidivism in the future. Mobilizing ethnographic examples that evidence the way clinical care comes to encompass a penal mandate of long-term surveillance of convicted patients, I argue that the dual injunction of procuring care while preventing relapse-recidivism constrains the psychodynamic forms of clinical intervention deployed by French clinicians, realigns both psychiatric and clinical interventions along penal lines, and revives interest in some of the diagnostic categories and aims of criminal psychiatry which were important for the development of psychiatry in France.

Abstract:The Constitution of Kenya, 2010 provides for a comprehensive Bill of Rights that seeks to ensure the protection of rights with an emphasis on 'marginalised' and 'vulnerable' persons. A dedicated clause and other specific provisions in the Bill of Rights detail the rights for children. Since 2010 the Kenyan judiciary has adopted a progressive stance by interpreting these provisions in ways that affirm children's autonomy and agency while recognising the reality of children's vulnerability and their need for protection. The expansive provisions of the Constitution have also enabled Kenyan courts to more readily embrace systematic remedial measures, such as judicial recommendations for the reform of the applicable legal framework and implementation of new policies to give effect to rights.
