Abstract:Many developing countries are now facing the ethical challenges of regulating embryonic stem cell research. In Latin America the recent Brazilian Supreme Court decision allowing such research in the country was the first case in the region. There are other countries in Latin America with the scientific capacity to develop embryonic stem cell research, but they do not have the laws or regulations that would allow this research, as is the case in Argentina and Mexico. However, the main challenges for developing countries are not solely the technological conditions or the legislation, but also the religious pressures against research with human embryos. It is worth remembering that abortion is against the law in many developing countries with the potential to conduct stem cell research. Differently from developed countries, where the political debate about abortion was conducted before the emergence of embryonic stem cell research, in developing countries both debates are being conducted simultaneously. The Brazilian Supreme Court decision is an example of how singular the process of embryonic stem cell regulations is in developing countries. In 2005, Brazil approved a law authorizing stem cell research with surplus embryos from fertility clinics. The law was immediately contested by the Catholic Church and the case was decided by the Supreme Court. The law was considered conservative by the scientific community, as it allows this research only with non-viable, surplus embryos from the reproductive process. This idea of non-viable embryos is similar to the position of a Portuguese law from 2006. These two countries are the only ones to specify the circumstances in which surplus embryo research will be allowed. Although Portugal is not a developing country, there are many political similarities between Brazil and Portugal – the main one being the Catholic influence on politics. In both countries, the Catholic Church is a powerful institution pressuring the State in areas related to reproduction and the end of life. The idea of the non-viable embryo from the reproductive process is a curious concept. In Brazil it means the embryo without potentiality for reproduction. In the case of transference to the woman’s womb, the non-viable embryo does not have the potential to develop into a fetus; nuclear division is absent. In Portugal the concept includes the presence of serious genetic diseases as well. In both cases, however, the emergence of the entity of the non-viable embryo facilitated the political debate because it avoided the discussion of the beginning of life and the potential of the embryo to be a future person. The non-viable embryo was a new ethical and scientific category to trace the line between the abortion and stem cell research political debates. As the embryo is non-viable, the pro-life arguments were largely out of the debate: the embryo will not survive on its own, even in the case of the State forcing a woman to transfer it to her womb. These two cases demonstrate how bioethics has to face the political, cultural and religious particularities when analyzing ethical issues. Embryonic stem cell research is a new topic on the bioethical agenda in developing countries and will be at the top of the agenda for years to come. Iran is a country now starting to face the regulation of this matter. The research has been conducted, so far, by using ethical regulations and fatwas (religious announcements).
