Abstract:In the case of business income under the current Personal Income Tax Act, the criteria for judgment are represented by profitability, independence, continuity and repeatability, among them continuity and repeatability rely on an overly abstract criterion of ‘social convention’, which does not sufficiently guarantee the predictability and legal stability of taxpayers. Therefore, it is necessary to strictly interpret the categories of income listed in the Personal Income Tax Act to determine the types of business that can be taxed as business income in a very limited manner, and to introduce an amount standard that agenda continuity and repeatability for each type of business included in the category. When determining business income according to the interpretation theory of this paper, the business income is determined first according to the listed business and the amount standard, and if neither of them falls under other income or capital gains, a relationship is formed that means tax exemption due to the blank area of the tax law. As an example to strengthen this interpretation theory, we look at virtual asset(cryptocurrency) income. Virtual asset(cryptocurrency) income seems to have enough room for disagreement on income listed as business income, and even if it passes the first hurdle of income listed, the reality that the most important indicator of business income is vaguely judged according to the conceptual factor of “social convention” is far from clear conditions. According to the classification of the project, the criteria for determining continuity and repeatability need to be clearly identified as “number”, and a strict interpretation of the income listed as a premise for this seems essential.
