ODR – A Solution for Consumer Disputes and Cross-Border E-Commerce Disputes

Abstract:“Online justice” is considerably untapped and lagging behind all types of administrative, civil and commercial services, which have been available online since the mid-1990s. This article presents an overview of the various aspects involved in settling disputes online and some of the reasons that have prevented online dispute resolution (ODR) from succeeding to the extent anticipated over two decades ago, notwithstanding many ODR services have proven that disputes may be settled online. Complainants are often powerless and deprived of seeking remedy because of attendant time and cost required in filing a case in court, which is not warranted for low-value claims.This article reviews mechanisms for the settlement of consumer and businesses cross-border disputes online offered by ODR providers. The article concludes that public and private online justice should be a priority, and that the advantages of access to justice through ODR demonstrate that investment in ODR made now will benefit all stakeholders in the short, medium and long-term.
