CONCEPTUAL AND LEGAL PROBLEMS OF DETERMINING A REASONABLE TIME FOR PRE-TRIAL INVESTIGATION IN A CRIMINAL CASE

Abstract:The article considers the issues related to defining criteria and boundaries of the reasonable period of pre-trial investigation in a criminal case, as well as the conditions that ensure compliance with the legislative provisions on a reasonable period of criminal proceedings. The purpose of the study is to define the concept and disclose the essence, as well as to justify the need and ways to comply with a reasonable period of criminal proceedings in the pre-trial phase. Materials and methods. To achieve the goal of the study, the author uses the judicial practice and scientific articles, methods of materialist dialectics, comparative studies, formal logic, comparison, generalization, and structuring. Study results. The concept of a reasonable period of legal proceedings was analyzed; its criteria, features of compliance, as well as the importance for timely initiation and objective investigation of a criminal case were considered. The ratio of protection of the legitimate interests of not only the suspect, the accused (persons in respect of whom criminal prosecution is carried out), but also the protection of the legal rights of the victim in the criminal process from the standpoint of the reasonableness of the proceedings in the criminal case is shown. Conclusions. Modernization of the domestic criminal proceedings, as well as ensuring the rights of its participants, as one of the program requirements implies compliance with a reasonable period of criminal proceedings. At the same time, it should be noted that today, at the doctrinal and legal level, a unified approach to determining the definition of a given period has not been formed, its criteria and circumstances taken into account when stating a violation have not been determined. The article makes an attempt to solve these problems in relation to the pre-trial phase of the proceedings.
