Given the heterogeneity among managed mental health care organizations--each with differing practices--it is difficult to sift the ethically defensible concerns from the indefensible ones. In this paper we identify and examine the different moral concerns about managed mental health care and mark which problems have been addressed or are in need of resolution. We also identify which problems are unique to managed mental health care.

Abstract:A fundamental consideration for potential users of stock index futures is the determination of the futures’ break-even price or fair value. Conceptually, being able to sell futures at prices above the break-even or buy futures at prices below the break-even offers opportunity for incremental gain. This article points out an important, though widely unappreciated caveat. That is, no single break-even price is universally appropriate. Put another way, the break-even price for a given institution depends on the motivation of that firm as well as its marginal funding and investing yield alternatives.

Abstract:Vacuolar localized Ca(2+)/H(+) exchangers such as Arabidopsis thaliana cation exchanger 1 (CAX1) play important roles in Ca(2+) homeostasis. When expressed in yeast, CAX1 is regulated via an N-terminal autoinhibitory domain. In yeast expression assays, a 36 amino acid N-terminal truncation of CAX1, termed sCAX1, and variants with specific mutations in this N-terminus, show CAX1-mediated Ca(2+)/H(+) antiport activity. Furthermore, transgenic plants expressing sCAX1 display increased Ca(2+) accumulation and heightened activity of vacuolar Ca(2+)/H(+) antiport. Here the properties of N-terminal CAX1 variants in plants and yeast expression systems are compared and contrasted to determine if autoinhibition of CAX1 is occurring in planta. Initially, using ionome analysis, it has been demonstrated that only yeast cells expressing activated CAX1 transporters have altered total calcium content and fluctuations in zinc and nickel. Tobacco plants expressing activated CAX1 variants displayed hypersensitivity to ion imbalances, increased calcium accumulation, heightened concentrations of other mineral nutrients such as potassium, magnesium and manganese, and increased activity of tonoplast-enriched Ca(2+)/H(+) transport. Despite high in planta gene expression, CAX1 and N-terminal variants of CAX1 which were not active in yeast, displayed none of the aforementioned phenotypes. Although several plant transporters appear to contain N-terminal autoinhibitory domains, this work is the first to document clearly N-terminal-dependent regulation of a Ca(2+) transporter in transgenic plants. Engineering the autoinhibitory domain thus provides a strategy to enhance transport function to affect agronomic traits.

Abstract:Cost pressures and changes in the health care environment pose ethical challenges and hard choices for patients, physicians, policymakers, and society. In 2000 and 2001, the American College of Physicians, with the Harvard Pilgrim Health Care Ethics Program, convened a working group of stakeholders--patients, physicians, and managed care representatives, along with medical ethicists--to develop a statement of ethics for managed care. The group explored the impact of a changing health care environment on patient-physician relationships and how to best apply the principles of professionalism in this environment. The statement that emerged offers guidance on preserving the patient-clinician relationship, patient rights and responsibilities, confidentiality and privacy, resource allocation and stewardship, the obligation of health plans to foster an ethical environment for the delivery of care, and the clinician's responsibility to individual patients, the community, and the public health, among other issues.

Medicare Advantage Under Fire: Public Criticism and Implications

Abstract:Congressional hearings and public reports have drawn attention to problems afflicting Medicare Advantage (MA), the privatized version of Medicare. Private plans became a staple of Medicare through the passage of the Tax Equity and Fiscal Responsibility Act of 1982 (TEFRA). Congress passed this law during a furor of privatization, when think tanks and powerful financial interests emphasized the power of corporations' profit incentive to improve the efficiency and quality of social enterprise. Yet the surging criticism of MA suggests a misalignment between the financial interest of some MA plans and the well-being of their patient populations. The criticisms range from deceptive marketing, ghost networks, and patient cherry-picking to unethical prior authorization denials and defrauding the government. In total, MA plans cost the federal government 22% more per patient than if these patients in question were enrolled in traditional Medicare. Moreover, it is not clear that this additional funding is producing proportional benefits. These developments raise questions about the presence of a profit incentive in Medicare, and perhaps health care more broadly.

Are Helicobacter Pylori and Other Helicobacter Species Infection Associated with Human Biliary Lithiasis? A Meta-Analysis

Abstract:Background Since the isolation of Helicobacter species in biliary system, a hypothetical question was raised about the role of these agents in the development of cholelithiasis. This meta-analysis is to explore the association between the Helicobacter infection and biliary lithiasis. Methodology/Principal Findings A systematic literature search was performed to identify all eligible articles. Meta-analysis which was carried out using odds ratio and random effect model, 95% confidence intervals for odds ratio was calculated. Quantitative assessment of heterogeneity was explored by chi-square test with significance set at P value 0.10 and was measured using I 2 statistic. Eighteen studies published between 1998 and 2011 were finally eligible for meta-analysis. H. Pylori, H. Bilis, H. Hepaticus, H. Pullorum and H. Ganmani were studied. With heterogeneity (I2 = 69.5%, P<0.0001), significantly higher pooled infection rates of H. Pylori (OR: 2.59, 35.82% versus 26.75%, P = 0.01) and H. Hepaticus (OR: 3.13, 31.30% versus 12.12%, P = 0.02) were observed in lithiasis group. Higher prevalence of H. Pylori in cholelithiasis patients were reported by studies from East Asia, South Asia and South America. Evidences supporting the higher presence of H. Pylori in cholelithiasis patients could be found by PCR for detecting 16s rRNA in bile, 26kDa protein gene in biliary tissue and immunohistochemistry. Using multiple detection tests could increase the detection rate of H. Pylori. Conclusions/Significances Our meta-analysis suggests a trend of higher presence of H. Pylori in cholelithiasis patients than control group and this trend was significant in the regions with higher prevalence of this agent. Evidences supporting the association between Helicobacter and cholelithiasis could be found by using different tests but the gold standard for the identification of these bacteria in biliary system has yet to be established. Considering obvious heterogeneity, a large multi-center study will facilitate us to further clarify the association between the Helicobacter infection and cholelithiasis.

Abstract:REVIEW QUESTION / OBJECTIVE What is the effectiveness of interventions to prevent heat loss at birth in premature and/or very low birth weight infants? The objective of this review is to identify the effectiveness of interventions to prevent hypothermia at birth in premature and/or very low birth weight infants. Specifically, the objective is to identify the effectiveness of interventions to prevent heat loss among this group of patients at admission to the Neonatal Intensive Care Unit. Interventions can include plastic wraps and/or plastic hats. INCLUSION CRITERIA Types of participants This review will consider studies that include premature and very low birth weight infants of any ethnic background within the following categories: gestational age (< 28 weeks, 28-32 weeks and 33-37 weeks)’and birth weight (<1500g). In this review, infants with increased risk of heat loss related to omphalocoele and gastroschisis will be excluded. Types of intervention(s)/phenomena of interest This review will include studies of single or a combination of interventions that evaluate the effect of interventions to prevent hypothermia at birth in the preterm and low birth weight infant within 10 minutes after birth in the delivery room. These interventions will be compared with standard care, which includes wiping away amniotic fluid and swaddling the infant. Types of outcomes This review will consider studies that include the following outcome measures: infant temperature on admission to Neonatal Intensive Care Unit. The impact of market-based 'reform' on cultural values in health care

Abstract:The many issues managed care poses for providers and health networks are crystallized in the moral problems occasioned by its shifting of the financial risks of care from insurer to provider. The issues occasioned by market-based reform include: the problems presented by clashes between public expectations and payer restrictions; the corporatization of health service delivery and the cultural shift from humanitarian endeavor to business enterprise the depersonalization of treatment as time and money constraints stretch resources, and the culture rewards efficient "business-like" behavior the underfunding of care for the poor and uninsured, even as these populations grow the restructuring of care and reengineering of healthcare roles as the emphasis shifts from quality of care to conservation of resources rapid mergers of both health plans and institutional providers with all the inherent turmoil as rules change, services are eliminated, and support services are minimized to save money the unhealthy competition inherent in market-based reform that posits profit taking and market share as the measures of successful performance the undermining of the professional ethic of advocacy the use of incentives that pander to greed and self-interest. The costs of sophisticated technologies and the ongoing care of increasingly fragile patients have pulled many other elements into what previously were considered "privileged" professional interactions. The fact that very few citizens indeed could pay out-of-pocket for the treatment and ongoing care they might need led to social involvement (few people remember that both widespread health insurance and public programs are relatively recent phenomena--only about 30 years old). However, whether in tax dollars or insurance premiums, other people's money is being spent on the patient's care. Clearly, those "other people" never intended to give either the patient or the professional open-ended access to their collective pocketbooks. Just what form their involvement ought to take is being tested as "managed care" attempts to control the costs. What limits are acceptable to providers?: lower profit margins? quality controls? acceptable risk levels? To patients?: restricted choice? restricted mobility? restricted access to high tech? And to the general public?: decreased access to high tech? higher taxes? underserved populations? Abandonment of the sick or poor? Which "techniques" are acceptable, and which are not?: risk-sharing with providers? financial incentives for decision makers? rationing access? imposing behavioral parameters? The issues posed by market-based managed care cannot be adequately addressed merely in terms of social resources, nor will answers be found in subordinating human rights to practical materialism. Negotiating ethical guidelines for the "safe" handling of such problems to the good of individuals and of society requires a revitalization of the "old" values: the old commitment to master craftsmanship and altruism, the old emphasis on patient advocacy and human rights. However, these old values must be applied with the "new" knowledge of lifestyle choices (and thus personal responsibility), likely outcomes (and thus reasonable options), and the limits of success (and thus fair redeployment of health resources).
Cost effectiveness of teicoplanin and ceftriaxone: a once-daily antibiotic regimen.

Abstract:There is a high incidence of staphylococcal infection in febrile neutropenic children with a central venous line. These patients are usually initially treated with empiric antimicrobial therapy that provides broad spectrum coverage. In a study evaluating a conventional regimen of vancomycin 40 mg/kg/d plus ceftazidime 100 mg/kg/d given in three divided doses to 41 febrile children with leukemia or lymphoma, the response rate was 87% after a mean treatment duration of 16 days. A once-daily regimen of an investigational antibiotic, teicoplanin, 10 mg/kg/d and ceftriaxone 50 mg/kg/d evaluated in 47 febrile children with leukemia was found to produce an equivalent rate of success and require the same mean duration of therapy. A cost-effectiveness analysis comparing the economic impact of replacing the conventional regimen with once-daily teicoplanin-ceftriaxone revealed that a 16-day course of the latter treatment would produce cost savings in terms of the cost of the antibiotics and other nonreusable materials, as well as in nursing time. Using French drug pricing data, the savings calculated for drugs and materials were 478 FF ($80 US). The teicoplanin-ceftriaxone regimen saved approximately 14 hours in nursing time per patient. Extrapolations based on estimates of hospital occupancy and the ratio of days a patient receives antibiotic therapy to the total duration of hospital stay suggest that an average hospital ward could achieve monthly costsavings of 7,641 FF ($1,273 US) for antibiotics and materials.

Abstract:The Emergency Medical Treatment & Active Labor Act (EMTALA) is a healthcare law specific to screening, stabilizing, and transferring (or accepting) patients with emergency medical conditions and active labor. This law, contextual to Medicare-participating hospitals, ensures public access to emergency medical services, regardless of the individual's ability to pay. The Defensive Medicine (DM) model and Physician Responsiveness to Standard-of-care Reforms (PRSRs) model are two medical malpractice frameworks leveraged in this paper. The nodes of these frameworks comprise of the treatment-versus-no-treatment dynamics and cutoff thresholds. Cutoff thresholds are specific to health risks and treatment price rates. Health risks stem from those with treating or not treating a patient as well as those inherent from the patient's ailment. Treatment price rates are subcategorized into customary and efficient price rates. Given the above nodes of these frameworks, this paper examines how the above medical malpractice models synchronize and sequentially align with the legal obligations of this law. This paper, furthermore, contemplatively describes how the incentivize/penalize dynamics interrelate to the push/pull dynamics of the PRSRs malpractice model. Thereafter, this paper applies the above push/pull dynamics contextual to the three specific obligations of this law, essentially, screening, stabilizing, and transferring (or accepting) emergency care patients. Conclusively, this paper illustrates the above network in a cascading algorithm that ligates the nodes of these frameworks to EMTALA's obligations.
[Individual medical services with no entitlement to reimbursement: general conditions relating to german social legislation and liability law]

Abstract:Physicians owe their patients the necessary duty of care in both examination and treatment. A physician who disregards this basic level of care acts negligently and may be held liable for damages. The same level of duty applies to contracting physicians (Sect. 76 para. 4 SGBV). The efficiency principle of Title Five of the German Social Code (SGB V), and in particular the jurisdiction of the Federal Social Court has already taken into account the strained financial situation of the Statutory Health Insurance Systems through increasing rationing elements: Panel patients' entitlement to benefits is limited by the procurement rights of the contracting physician so that actually the two-class medicine strictly denied by politicians has become reality long since. For the physician, a new legal obligation to inform his patient arises from the divergence between the civil and criminal part of the medical statutes on the one hand and the restrictive regulations for physicians practising under SGB V, creating considerable potential for conflict the extent of which will generally remain hidden from the medically ignorant patient. In its decision of December 6, 2005, the Federal Constitutional Court (BVerfG) has set limits to the increasingly restrictive jurisdiction of the Federal Social Court referring to the welfare state principle. The dictate of humanity of Section 70 SGB V must not be degraded to the rank of a mere political statement.

Regulators across the country are confronted with a growing consumer backlash against managed care. As a result, states have passed managed care reform legislation at unprecedented rates. In doing so, states are confronted with a patchwork of federal intervention and preemption. We examine the stages of these recent state and federal developments and evaluate them in terms of the traditional objectives of a reasonably functioning health care system: quality care, access, and cost containment.

Abstract:Patients who allege negligent treatment by their psychiatrists can sue to be compensated for the harms they experience. But what if the harms result from a criminal act committed by the patient that the patient claims the psychiatrist should have prevented? A long-standing common law rule bars plaintiffs from being compensated for harms caused by their own wrongdoing. The Supreme Court of Pennsylvania recently considered the scope of this rule in the case of a psychiatric patient convicted of murder. Even when the rule is upheld, various exceptions may exist, and there is pressure to do away with an absolute bar on recovery of damages.

Abstract:Data Mining is concerned with the discovery of interesting patterns and knowledge in data repositories. Cluster Analysis which belongs to the core methods of data mining is the process of discovering homogeneous groups called clusters. Given a data-set and some measure of similarity between data objects, the goal in most clustering algorithms is maximizing both the homogeneity within each cluster and the heterogeneity between different clusters. In this work, test cases are used to demonstrate that the Euclidean Distance widely in literature is not a suitable metric for capturing the quality of the clustering.
Patient liability, treatment adherence, and treatment persistence associated with state bans of copay accumulator adjustment programs

Abstract:Background: Health insurers have increased the use of copay accumulator adjustment programs (CAAPs) to control costs; however, some states within the United States have banned the use of CAAPs to protect patients from rising out-of-pocket expenses. Objective: To assess the impact of state CAAP bans on patient liability, treatment adherence, and treatment persistence. Methods: This was a retrospective cohort study using administrative claims recorded in the IQVIA PharMetrics Plus database. Data were extracted for patients with fully insured commercial plans receiving autoimmune or multiple sclerosis drugs between January 1, 2017, and December 31, 2021. Patient liability was defined as the difference in insurer allowed and paid amounts. Treatment adherence was measured as the proportion of days covered over a 1-year period, with "adherent" defined as a proportion of days covered greater than or equal to 80%. Treatment persistence was defined as time from treatment initiation to discontinuation (a period of 60 days without supply of treatment). The analysis compared differences in outcomes in states that implemented a CAAP ban during the study period (Arizona, Georgia, Illinois, Virginia, West Virginia) with states that did not, for before and after the date of ban. Results: States that implemented a CAAP ban had relative reductions in patient liability after the first 2 months, which ranged from 41% to 63%, with monthly savings ranging from $128 to $520. Patients in states with a CAAP ban had 14% greater odds of being adherent to their treatment after policy implementation than patients in states without a CAAP ban and a 13% reduction in risk of discontinuing. Conclusions: The implementation of state legislation to restrict the use of CAAPs in state-regulated plans was associated with reductions in patient liability and improvements in treatment adherence and persistence for the 5 states that were early implementers of a CAAP ban. These results may offer insights for states that have recently implemented a CAAP ban, as well as for those considering enacting similar legislation.

Abstract:Metabolic bone disorder develops during chronic renal failure and chronic dialysis treatment, continues after successful kidney transplantation, and is further aggravated by corticosteroids and immunosuppressants. The recognized risk factors for bone loss, i.e. parathyroid hormone (PTH) secretion, age, duration of hemodialysis, sex and post-transplantation period, were examined in this cross-sectional study of 91 stable kidney transplant recipients. Patient age was 21-67 years, time spent on dialysis 1-216 months, and post-transplantation period 1-228 months. Bone mineral density was measured by dual energy x-ray absorptiometry at the lumbar spine, femoral neck and radius. T-scores (bone mineral density expressed as standard deviation of healthy young population) were used in statistical analyses to avoid sex differences in bone mass. PTH was measured by a commercial kit (9.07 +/- 11.81 pmol/L). The femoral neck and radius correlated negatively with PTH and hemodialysis duration both in simple correlations and multiple regression, and femoral neck additionally with age. The lumbar spine correlated negatively only with PTH. Post-transplantation time did not correlate significantly with the three densitometry sites. Also, the frequency of osteoporosis or osteopenia for the femoral neck and spine did not differ between the first 12 months and subsequent period, but was positively influenced by hemodialysis duration. There was no sex difference for the variables analyzed in the study. The results indicated that prolonged hemodialysis treatment and consequently increased PTH secretion had unfavourable effect on the femoral neck and radius bone in kidney transplant recipients. Regarding predictors in this study, only PTH was found to adversely affect the lumbar spine. Further deterioration of change in the skeletal status could not be demonstrated, which might be explained by the reduction in PTH secretion and possibly by improvement of the bone disorder.

Abstract:If the potential for Caremark liability hangs like the sword of Damocles over corporate directors of Delaware corporations, then that sword has been considerably more secure than that of the original myth. For decades, Chancellor Allen’s description of a Caremark claim as “possibly the most difficult theory in corporation law upon which a plaintiff might hope to win a judgment” held true. Caremark claims that survived a motion to dismiss were for decades few and far between. That changed in 2019. In the space of little over a year, Delaware courts have allowed five Caremark claims to survive in the corporation context and one claim to survive in the limited partnership context. The thread holding that sword is beginning to look more like the single horse hair of myth. The scope and likelihood of Caremark liability are matters of considerable interest and concern for directors. Under most circumstances, a board simply doing its job poorly is relevant only to the directors’ duty of care and protected by the business judgment rule, exculpatory provisions under Section 102(b)(7), and advancement and indemnification. Failure to monitor under Caremark, however, is a breach of the duty of loyalty. A breach of the duty of loyalty is not protected by the business judgment rule. It cannot be exculpated. And it cannot be covered by indemnification.2019 marked an abrupt shift in Caremark in application, if not in theory. In June of that year the Supreme Court of Delaware (“Delaware Supreme Court”) reversed a decision by the Delaware Court of Chancery (“Chancery Court”) dismissing a claim against the directors of Blue Bell Creameries, Inc. (“Blue Bell”) under Caremark. Within a little over a year, the Chancery Court would sustain Caremark claims in four cases. In Clovis, the Chancery Court sustained a Caremark claim against directors of a pharmaceutical company who allowed the company to misrepresent the clinical trial success of one of its three drugs. In Hughes, the Chancery Court sustained a Caremark claim against directors of a Chinese company incorporated in Delaware that suffered from severe and pervasive accounting issues. In Teamsters Local, the Chancery Court sustained a Caremark claim against directors of a large pharmaceutical company who allowed an indirect subsidiary to essentially operate a criminal enterprise. And in Boeing, the Chancery Court sustained a Caremark claim against directors of an airplane manufacturer who did not pay attention to safety issues. Cybersecurity has become just such a mission critical risk for large corporations. This Article makes four key arguments. Black letter Caremark doctrine has not changed, but it is newly reinvigorated and the risks of Caremark liability for directors is greater than just a few years ago. Future Caremark liability will be centered on failure to provide board-level oversight of mission critical risks. Cybersecurity is mission critical to effectively all large companies today. The risk of Caremark liability can be mitigated by taking a few simple steps to ensure that the board is addressing cybersecurity. This Article is the first to make these arguments together and the first to make the final argument.
